This is what you need to do:

You need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter (think of it as the best $6.47 you ever invested).  Also send it first class mail in case no one will sign for it.  Make a notation of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):  http://www.consumeradvocates.org/

Everything else you need to know follows including where to report their criminal activities.

    Looks like they were sued:
    http://www.law360.com/cases/4e973d60e5849859b3000001

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Read up on your rights here and also make a complaint at this government site:  http://www.consumerfinance.gov/

They can't send you to jail for not paying the debt there are no debtors prison that I know of In the united states and even if there was you still have to go to court and then they would have to show Just Cause why you should pay it or why they think their collections agency should get some kind of money out of it if the debts policyowner had your name on it yes you would be liable if it has only her name on it or their name on it then only they are liable but don't say anything about the property they owned  is a different matter as part of the estate if a person has property car truck House that would be a estate property if that was sold or there was none then there's no property to claim so they can't really get you to pay them anything tell them to take it up with the cardhilder if anyone else asks any questions say that he/she relocated to a new address and give the address of the cemetery

Bad info. The link is a general link with no link for info about deceased debts. The Office of Public Affairs # is just a recording and you cannot talk to a person about questions. Please don't bother to respond to questions if you are just going to post useless general info. This was a huge waste of time for me.

Received a call from "Ascencion".  I had never heard of them.  They would not tell me who they represent other than that they were handling probate affairs for a deceased relative.  Read Google info.  Yep, they are a collection agency preying on relatives of the deceased.  How gross!  Told them no information and hung up.  The call came from  888-806-9073  x2136    Nina Smith

No one but the person appointed by a probate court (executor or administrator) is authorized to handled the probate of an deceased person's estate.  This is just more deception from this "Ascension Point" group.  Simply ignore and block the call.

This company specializes in getting ahold of anyone they think might have some interest (or not) in the estate of a deceased person,  in an attempt to collect a debt the deceased might have owed.

In my opinion this is just  a legalized debt scam.

Fact is, depending on the state where the deceased died, payment of the deceased's debts is the duty of an executor or administrator.  And that's only if there are enough assets in the estate to pay them.  This  of course, requires an actual probate proceeding.

But this company doesn't care about  legal niceties, they continually try to contact relatives of the deceased in an attempt to somehow (psychologically ) strong-arm the relative to pay the debts of the deceased even though the relative is not liable.

Sad to say, this group is quite successful financially.

They sometimes use deception to make a person think he or she  IS responsible.  Don't fall for it.

Ignore and block any calls received from this group. If you're thinking of paying. even though your are not legally responsible, make sure they send you a debt validation letter by US mail.  E-mail no good.

If there IS an estate, make sure that all communications are directed to the executor or administrator.

How does anyone know these people aren't getting information off of the obituaries then going through the internet to find information on the deceased, then calling random people who are connected to them?  This kind of information is all over the internet.  Scam???

My husbands niece died 3 months ago.  These people have been calling our house phones in 2 states and our cell phones.  I am just an aunt by marriage, why they think I would be responsible is beyond me.  She was disabled and on welfare so I can't imagine she racked up that much debt.   Her father is still alive, I don't know why they aren't able to resolve this with him.  They are getting annoying.  We have told them at least 6x we are not responsibl for her.   Hadn't even seen her in the 15 years before she died.
