ascension point called my son asking if he was in charge of his fathers estate 14 months after his death.  I owe nothing on any bills. and to call my son confusing him with questions, incorrect details and saying his dad owes money is cruel.  This is a scam for sure and just know you do not have to pay any bills your deceased family member leaves behind.  EVER  no matter what they say  please block the numbers  do not send them money and tell them you are onto them.

The person you are seeking advice from posted here in 2010, so I doubt he will see you reply.  Further, you can generally be assured that anyone here professing to be an "attorney" probably isn't.  Even if he was he would be a Texas attorney and couldn't advise you on laws in other states.

Now, as to how to stop this, you need to send them a certified, return receipt cease and desist calling letter.  You need to report them to your respective state Attorney General's as well as to the CFPB.  In order to not become a victim of this crime, you need to learn what the law says.  Here is your starting point and be aware that they have already violated the law if they have not sent out this letter:

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.

Tell them you only want to discuss through the mail, Legally they are allowed to call one more time afterwards, tell you are recording the message.

Got a call from this number. It just said Toll Free on the caller id. There was a recording that said the call would be recorded and then a lady came on the line, said she was with Ascencion, and wanted to know if I was a person who was allowed to discuss the financial matters of my late sister-in-law (who BTW is very much alive). I told her no and she politely said Thank you and hung up.

This is just the weirdest scam to date. What kind of people take jobs to do something like this? What happens if someone says that okay, they'll pay a dead relative's debts. Don't these workers want to hang their heads in shame?

Interesting that this company has an "A" rating with the BBB. Not saying they, in any way deserve it, but maybe if more of these complaints were lodged there.....just saying.

I had a message from a Janette Hill from Ascension Point at 888-420-2510 x2138.  She said to call her back regarding 'the late' Charlotte Tally's estate/financial matters.  I decided to check the number on-line before returning the call.  I was going to let them know I did not know this person and that they had the wrong number but since it sounds like it's part of a scam, I will not be returning the call.

I have received several calls concerning my mother.  In fact, as I type this I just received another.  I have called back and not spoken with anyone, but left a message for one of the people who have called.  The interesting thing, and is in direct response to your post, is that all 3 of my siblings have received this call also.  My guess is that they get the obituary and use it to obtain names.  My mother lived with me the last 3 1/2 years of her life.  I see how they got me but none of my brothers have had any responsibility.  So, a judgment, I think not.  Fishing to see if anyone takes the bait, yes.

These people have been calling me for years about a dead ex-mother-in-law. This is just unbelievable. I have already complained several times to the FTC, so hopefully they're busy building a case against Ascension Point and will stop them soon. My name is obviously on a list somewhere and I often end up in class-action suits as a result. They just take forever to get to the final judgment is all.

So, now Ascension Point is leaving voice mails? Is this so that they won't have to pay so much in the upcoming class-action suit against them? They are still going down, no matter how closely they try to follow the rules for appearing-to-not-be-scammers. As far as I know, it is still against the law to invent debt balances and then use this to harass complete strangers into giving away all their money. Leaving voice mails is not going to save them.
