You need to take that person's name who ever said this to you and report them to the attorny general, they can not seize anything from you. You are not reliable for the debts only the estate is, if your mother didn't leave an estate then it just goes unpaid. This is in violation of the FDCPA and is not acceptable.

    So COLLECTOR TROLL.

So in your stupid opinion -

Anyone who dies and does not have an estate to pay an "alleged" debt is a theif?

Not sure how you came up with that disgusting idea.

As no one KNOWS when they are going to pass on and certainly did not PLAN to pass on JUST TO AVOID paying the "alleged" debt.

My Dad's estate has been closed for 9 years and they are calling now?  We followed the law in California, published the death notices, etc.  No idea why they are calling now, but under California law, they are out of luck on whatever it is they think they are trying to collect.

We closed my father's estate with money to spare, following the laws California.  You need to realize that not everyone has the ability to pay off an estate that has extensive debt, especially if the dearly departed didn't have life insurance, or what monies where there were eaten up by long term care.

My parents paid all their bills on time and my Dad left a nice, sizable estate for my Mom to continue to live off of.  She now has cancer and the costs that aren't covered by her health insurance come out of her pocket and mine.  You need to get a reality check of your own.

I have been contacted as well by this company, the message is the same as another 800 debt collector leaves.  I wish to thank all of you that have posted information regarding this company, and since there was no estate for my late husband and I am not liable for his past debts I will consider  contacting this company to have them close their file.  I did not even know the name of this company that has been leaving messages until now.

We are receiving calls at our place of buisness from Ascension Point regarding a formal employee who recently passed away. Very disturbing, since some of us are still grieving the loss. They ask if you are responsible for the estate of "xyz" and gave the call back number 888-420-2510.

We initially received numerous calls from a company at all hours of the day never leaving a message, one day I finally answered to find out they were trying to collect a debt of our son's. I explained to them that our son passed away with no assets.  She apologized and said we would not receive anymore calls.  Received a voice message from AscensionPoint, called them told them that our son died with no assets.   Now a letter came to the house addressed to the Estate of xxxxxxx xxxxxx.  (all this for a few hundred dollars)  Well, there is NO estate, our son was a college student living at home and had no assets.

What can we do to get this to stop??

They are not scammers. They are, however, hired by businesses to try to collect from the deceased persons estate. They called us for my deceased brother-in-law who died without a job and no insurance. They were calling on behalf of CitiBank for a Credit Card my brother-in-law owed money on. They then reported to the credit card company that my brother-in-law did not have an estate and no probate was opened for his creditors to collect on. The credit card company will have to eat that bill. If they call you, just answer the phone and give them the information of the lawyer handling the estate.

Who is Responsible for a Deceased Relative's Debts?
If your relative leaves unpaid debts when he or she dies, do you have to pay?
According to the Federal Trade Commission, the nation’s consumer protection agency, surviving relatives usually have no legal obligation to pay the debts of a family member who has died. Generally, that person’s estate is responsible for paying his or her debts. But if there isn’t enough in the estate to cover the debts, they typically go unpaid.
After a relative dies, debt collectors may contact family members and ask them to pay their loved ones’ debts. The rights of surviving relatives are covered by the Fair Debt Collection Practices Act, which the FTC enforces. The FTC has developed a new consumer alert about this issue titled Paying the Debts of a Deceased Relative: Who Is Responsible? To learn more, go to http://www.ftc.gov/bcp/edu/pubs/consumer/alerts/alt159.shtm.
The Federal Trade Commission works for consumers to prevent fraudulent, deceptive, and unfair business practices and to provide information to help spot, stop, and avoid them. To file a complaint in English or Spanish, visit the FTC’s online Complaint Assistant or call 1-877-FTC-HELP (1-877-382-4357). The FTC enters complaints into Consumer Sentinel, a secure, online database available to more than 1,500 civil and criminal law enforcement agencies in the U.S. and abroad. The FTC’s Web site provides free information on a variety of consumer topics.

Well you would not get a call from a deceased collection agency if someone would not  have told a lie to the creditor to begin with. Funny dont ya think. What a horrible ie to even come out of someones mouth.

Received call form this company, about a person who is not related or anyone we know.  This is so stupid.  It seems like the company reads this so I hope they do a little research before they call. Don't know or have ever heard of the person or no nothing about a estate of which they are calling about.

Dude, its a two way street. If you don't communicate, you can't expect results. Presumed a good number unless you inform them verbally that it is a) incorrect, or b) that you do not want any more calls. Its simple. The rain never stopped because I wished, but I can always get an umbrella.

Did not receive a call, but a letter. Stated my wife owed on a student loan debt. SHE IS STILL IN SCHOOL!!! Working on her masters. According to how student aide works, if you are still a student, you do not have to start repaying your loans until 6 months after graduation. This company seems like a joke. We are going to call them on Monday and tell them that if they don't like how the Federal government works its loans to call their representative and complain on capitol hill.

Anyone else get a letter like this? let me know.

    Thanks,

    Duditz

This company continues to call my home and ask for my deceased father (he passed away April 13, 2009). When I told them that he was deceased & to stop calling they said it would take 24-72 hrs. for that information to be put into their system.

Then they started calling asking for a "family member or person responsible for the estate of" my father. I haven't returned their calls and don't plan to.

    Thank you!
