- Sue replies to david gee| 5 repliesIt doesn't go null and void after 7 years. There are parameters and stop guards in place to protect businesses and people from exploiting this law. If they've contacted you ONCE (letter, phone call/message), the clock starts over on the 7 years. Just wanted to advise people avoiding calls and throwing out letters won't work.
- Tred replies to Sue| 1 replyYes, isn't it always a debt collector troll not citing any references and blindly acting like such statements are absolute. Funny how these threads are full of the deceptive and corrupt business practices displayed by the predatory and cowardly debt collection industry but here you are blaming the victims. As a family member who does answer their phone the industry is full of cowards and predators not abiding by any state or federal consumer protection laws. Their show of predatory cowardice and lack of integrity is even more evident as a family member who does put it in writing.
- Gandalf-The-Grey replies to Sue| 1 replyIncorrect.
Please refer to the following site
http://credit-collections.ca/statute-of-limitations-on-canada-debts/
In the event that a judgment has been filed against a consumer, limitations are still set of the time that judgement can be collected. Specific cases and questions regarding limitations after a judgment has been filed against you can be found asked in the forum.
It is also important to note that limitation can be reset. Limitations begin when a cause of action arises, this is typical the date of last activity or the date of last payment, therefore if you have a bad debt and you start making payments, the statute of limitations resets. - Gandalf-The-Grey replies to TredHey Tred - don't bother... Sue doesn't have a clue.
- Pete replies to Gandalf-The-GreyThat is an excellent site to review and is for Canada. They give you very good advice on how to deal with them effectively. Lots of reading but worth it.
- Samm replies to Ang| 1 replyWe have been called by this agency for years. They are looking for a Delores Martinez. We have never heard of this person. Our phone number has been attached to our family for over 25 years. I repeatedly have told them that we don't know this person and they have our # attached to her name in error. They keep saying that they will change this information, but the calls keep on coming. Usually I don't answer any number which is unknown or unexpected, but visiting family answered the phone and here they are again!
- Slim replies to SammIf you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:
http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors - Mary replies to SueWRONG! A phone call, letter, email etc. does not "restart" the clock. The consumer must acknowledge the debt and agree to payment IN WRITING or send a payment in order to "restart the clock." Nice try shill
- Rick BlahsoIt's a boiler room scam folks. I receive calls monthly from this company and it's various incarnations. This time they claim their name is Global Credit and Collections. I've received calls about the person they claim to be looking for going on a year now. The company name changes as people catch on to the scam, but the speil stays the same. You tell them to remove your number and they promise to.....but it never happens. A nice new game is they'll block the number they call you on, so if you call them back you'll get a "number not in service" message. How cute! Just call them back from a different number and ask for the person they called you about, tell them you know where the person they're looking for is and then give the scam artists the non-emergency number to your local police department. It's a scam folks. They hunt down expired old debt and then keep fishing until they find someone they can scare into sending them cash. They aren't cops so they can't arrest you, if they claim to be call your local police or attorney generals office. They're professional scam artists folks. Tell them to send you everything by mail or get lost. Here's their New York area office where they hide....they shut them down and they just pop back up under a different name.
