- TP replies to justcuriousI worked for a phone company......If any company or person calls someone one more then 5 times a day or before the hours of 8AM or after 9PM, then you should clal the Annoyance Call Bureau or also can be known as UBC for your area. It is considered a harrassing phone call and you will have to be willing to press charges against the individual calling. Hope this helps. :o)
- LAABOMBAThey called me and said they wanted me to settle my orchard supply account for six hundred and fifty that they were willing to take four hundred and fifty. I told them I don't know what they are talking about I don't have an orchard supply account. I shop there but use my Sears card for purchases. He wanted to ask me more personal information but I just told him he had the wrong person and hung up. Yes those calls are annoying.
- belindaUse to get phone calls from them til I changed my cell number but now I get harassing letters from them saying I owe money from RIVERWALK HOLDINGS LLC which I don't know who they are and yes I know about the many calls from them they also called on sundays I guess they have no life....

US CODE: Title 15,CHAPTER 41 SUBCHAPTER V is very helpful on this issue. There is a letter format you can use to stop the harrassing phone calls. If they have received the letter then call you they are libel for the debt. You can go through your local Attorney General if they do. Some of the slimeballs out there will call you a liar and say that there is no such code when you tell them but if you co to http://www.law.cornell.edu/uscode/15/usc_sup_01_15_10_41_20_V.html you can getr all the info you need. SO PASS IT ON. - AnnoyedIt is 9:36 pm here in CT. I just received two telephone calls from this company. (I thought that debt collectors weren't allowed to call you before 8 am or after 9 pm?)
Anyhoo, the first time I answered, I said "Hello" twice, and the person on the other line just said "Sorry" twice, so I hung up. The second time they called, I picked up the phone and asked who it was. They asked for me and I told them that it was after 9:00 pm. The woman on the other end said, "9:00 pm? It's not even 9:00 pm here; we're on Central Time." I told her, quite nastily, that I am on Eastern Time, it was after 9:00 pm, and to not call me so late. I then took the liberty of slamming the phone down in her ear.- Call type: Debt collector
- Debtor in California| 2 repliesHello All,
The collection agency, Malcolm S Gerald, is located in Chicago. If you received a call from them, there is only one reason; They want your money. They want you to open your check book, or debit card. Don't be fooled. Even if you OWE the debt, you should NEVER pay to the collection agency. You do not owe them anything. The original creditor has written-off the debt and got their tax break from uncle Sam. So if you pay to the collection agency, it does not satisfy anything, it does not good to your credit. If anything, it will make your credit WORSE, because your FICO will trigger this account as a recent activity. So please, never pay a dime to a debt collector.
If you get call, or if you receive a dunning letter from them, send them by cerified mail, the following letter and keep a copy for youself. In addition, get a copy of your credit report, log every phone call, browse consumer boards and educate yourself about the law called FDCPA.
This letter is called, Validations of Debt. It is the ultimate weapon against debt collectors.
