    I get calls on my cell phone almost every day from this #. I am not the person they are looking for and actually the call is rejected. Finally someone left a message with their name. Thanks for all your info. I'll try to call them .

    Just another one of those companies that in their own mind they Think they are Special and maybe in their world they are but their Not in anybody elses world. Now sometimes companies call simply to see If and when someone may answer their calls and thats why they call at all different times then that provides information to the person who wants to call and make contact so be aware of that one that Maybe what some of their calls are doing, Now another thing is Be Aware there are Statutes of Limitations on debts and those varie state to state and sometimes the Statute of Limitations are Much shorter than you relize or think I'm sure there must be links on the Internet that provide Debt Statutes of Limitations by state and having known a couple people that worked in that Industry at one time helps because they said when they did that Collection Job it was common practice to use tactics that upset the person into paying and often they would give a spectacular reduced amount If the person will pay right Then while on phone, Just like TV comercials that put a sense of urgency in them

    I received 2 calls (neither of which I can understand - sounds like a 7 year old mumbling, yet eating the phone at the same time!) - I ran a search on the internet and seen that they are a debt collector.....well - I have no outstanding unpaid bills.
    So - I called back @ 9:50 EST and some female answered AFTER I let it ring @ 20 times. She put me on hold twice, said "let me get rid of this other call", then came back and said she would transfer me; then hung up on me - AFTER I asked her what this company was. She never asked me any ?'s. So I must have hit redial at least 20 times in the next 10 minutes......they hung up on me every time! STRANGE. Absolutely annoying me w their calls.

    Malcom S. Gerald has been calling me for about two months now.  They ask for my wife since the "account" is under her name and wouldn't talk to me.  After getting permission from why wife, they agreed to talk to me.  I asked why we were receiving calls since we were already making payments to the original creditors.  The best they came up with was for us to call the creditor, cancel the payment arrangements and set it up through them.  That is a line of bull.  Any real bill collector trying to collect a debt on behalf of the original creditor would call to verify.  Bottom line, after speaking to who we owe the bill to, they stated our payments were being received, and they would contact this company to find out whats going on.  Never deal with debt collectors unless you contact the original creditor first.  Most companies will take your account out of collections if you deal directly with them.  Otherwise, part of your payment goes to paying the collector.

Gerald and Associates, Inc.; 322 s michigan ave, ste 600, chicago, il 60604; 800.265.3796; 312.922.6500; 312922.7869; and mikebafia@msgerald.com...this guy shouldn't even be in business, especially as a debt collector. i took out bankruptcy in 2005 and guess who was trying to include himself in my bankruptcy? yep. Malcolm S Gerald. The Federal Bankruptcy Agency has him listed as a "fraudulent predator collector.”  It is best to ignore him and he will eventually melt into the earth. He is scum and tries to make a living by approaching very old, old, old collections that the original creditor has sold many times and no longer wants to pursue. I wrote to the credit reporting agencies and told them the debt Malcolm s Gerald and associates attempts to collect, is not mine and I'm leaving it at that. Let him keep calling, I'll just watch his company die a slow death. Continue to discredit his activity by reporting to anyone and everyone you can.

    hello "sees it real"...i do know about the statute of limitations on debts. do not discuss the statute of limitations with a debt collector unless you admit to owning the debt they are discussing. if you just can't help it, write them a letter and make sure you do not admit to any debt without receiving first all the documentation on it. you assume ownership of the debt when you bring up statute of limitations. also, just because the debt is old enough to avoid collection attempts, a court of law will tell you it is still collectable because you admit to creating it. like i said previously, this guy or woman or whoever they are, are known as fradulent preditor collectors and are not to be respected.

    i have made a complaint to chicago and northern illinois better business bureau about the way they handle complaints regarding malcolm s gerald and associates, inc. here is the complaint:

    "many complaints regarding malcolm s gerald and associates inc are regarding ghost calling. telephones ring and the caller hangs up.  according to the federal telecommunications rules, this constitutes harassment when the caller continues to call and hangs up when answered.  chicago and northern illinois better business bureau has been and continues to be blind to the harassment issue when a complaint of this nature is made by consumers. this is a blatant act of favoritism toward the annoying and predatory debt collector aka malcolm s gerald and associates, inc.
    also many complaints are made regarding malcolm s gerald and associates, inc in that they never follow-up communication with documented evidence of (alleged) debt(s) owed which is a violation of all debt collection practices yet chicago and northern illinois better business bureau states: consumers are unwilling to accept resolution."

    my desired settlement description reads:

    "consumers demand resolution to satisfy consumer rights and we want it now!
    force malcolm s gerald to quit making ghost telephone calls and demand malcolm s gerald to document in written correspondence, alleged debt validation; which is a legally correct response.  only then can chicago and illinois bbb know for a fact the consumer either accepts or denies resolution."

    Depending on what kind of mood I am in.....I will either answer the phone "9~1~1, what's your emergency" or "County Morgue, Embalming Department" or  I will hit a saved ringtone on my phone that says "A**hole calling, A** Hole calling, there's an a**hole on the other end of the line, answer it quick to you can talk to the big A**hole, or I will say "FCC, Complaint Department"........ahhhh the benefits of these dumba** people calling and thinking they have the upper hand.......yes I too used to work for a MAJOR Telecommunications Company

    A collection agency.  They left a message on my phone machine.  They call the telephone number provided by the person who has a bad debt that they are trying to collect (no matter how old the information is).  I explained that I've had my phone number for over a year, that the number was issued to me by AT&T, and that I've had calls asking for this person before.  A polite customer service rep said he would delete my phone number from their computer system---hopefully that will happen.

    After researching this company that just called me, I now know they are more of a "scam collections".
    We were billed once by ACCESS ONE for a 4 year contract we did not agree to.  We had them for 4 years, paid our bills and canceled the service when the contract was up.  And they billed us for $2,000.00.  We disputed it with them, and they have since dropped trying to collect that money. We've received NOT ONE collection letter, NOT ONE statement from Access One since.  They know they are in the wrong and they apparently dropped the issue.  8 months later, out of the blue, this Malcom S Gerald starts calling, with extremely little information on this account, just Access One's name and our company name and phone number. I told him we've received NOTHING in the mail with further attempts to collect this money (which we do not legally owe).  He told me to fax all my paperwork to dispute these charges.  After doing this little research, I'm not sending them a thing except this letter you have shared with us. THANK YOU AGAIN!
