    These Collection agency (CA) scumbags would make you think you must talk to them or bad things will happen. WRONG! I laugh in their face since 90 plus percent of them CANNOT provide any written proof of the debt. Send a written demand for proof of the debt and demand that all further communication be only in writing. Believe me they will disapear faster than a snowball in Vegas in July. If they dont then learn the laws about debt collection (FDCPA, TCPA, and your state's own laws) and SUE SUE SUE!

    Demanding proof of the debt is exactly right.  If they cannot prove it they have to (by law) remove it.  Also, you do not have to put up with them being abusive to you.  That includes scare tactics like Vandenberg is quilty of using.  If (any) debt collector is abusive to you in any way, shape, or form file a lawsuit.  It is money in your pocket.

    I demanded proof and it took about a week but they were able to provide me with the contract i signed from ace checking. whats should i do? theres no way around this right? how is it possible to get around when they have the contract?

    If there is a contract with your signature, then yes you should pay. They sent you proof in the mail. This is the way it is supposed to be handled. I am a bit surprised that they were so cooperative. Unless of course, this is another work of fiction from our friend Rick. *Yawn*

    Bad check recovery is the reason for a business to employ the services of a collection agency. When a company cashes a bad check this causes a business to have a deficit. Even though there is no signed agreement to pay money that is owed, a creditor can still collect the money because it was obtained by fraud. A business may enlist the help of a collection agency to collect the debt but if the amount of the check is of a substantial about, this is a criminal offense that can be prosecuted.

    Is this true? i found it online. I got a call and I've already asked for proof... I'm waiting for a call back. I'm just worried about what will happen if they show proof. I honestly did write the check and signed a contract and I've been avoiding it. Any ideas to how I can just make this go away?

    Great. Now we have employees of the company masquerading as "deadbeat" debtors. "Any ideas to how I can just make this go away?" Your kidding, right? Just go back to making phone calls, because you are not impressing anyone here.

    I've said it before and I'll say it again:

    Paying bills = GOOD

    Giving out money and personal information to scary voices on the phone with no proof of debt = BAD

    A "way around this" could me the date of the contract. Contracts have statute of limitations.

    This same situation happen to my boyfriend.  He recived a number from 404-249-1099 at his mother from some guy who said he had a warrant for an unpaid debt.  He tried to keep it secret but when the story came out it kid of seemed strange to me.  Thsi man had my boyfriend scared and he is far from a punk!!! So when he expressed to me that he really was worried about the stiuation as was sounding scared and sad i went off! I knew the debt was not a legal issue for example a fine from court because they told him it was a pydayloan.  So i called the number back shook up the 18 year old operator by asking him all kind of question.  I got him so darn good he began to studder really bad. To the point where he couldnt even speak. I asked him questions like are there officer inthe buliding who can serve warrents, if so let me speak to one. NEGATIVE!!! He said there where people there who could do such a thing but they werent cops! I notice he kept trying to get me off the phone to a agent who knew more but i wanted to find out by a rookie because they'll tell it all. I figured out that the warrent officer was actually the "agent" who where calling with the lies. After i finally realize this was some kind of scam i let him connect me to a agent.  I could tell the difference from the stupid operator off the top. She triend not to answer any questions at first.  I cursed her every name in the book!  And threaten if they called again they would answer to me, the judge, and a lawyer!!! It was funny because instead of hanging up on me she keep trying to explain her self and keep asking for a account number.  If the called again they'll wish they havent!!! I couldnt stand to see my boyfirend worried sick like he was.....

    Hello, I have a family member who used my name and now some how i owe these #$#$#heads money, I dont want my cousin to go to jail for fraud, I get called 50 times a day to pay, but its not my fault is there anyway that i can get around it and not pay?

    Ken this is not directed at you in any way.  Please don't be offended.  Just because their is a contract with your signature does not mean you have to pay anything.  They still have to file a lawsuit against you in a court in your county to force you to pay this debt.  Of course you risk the fact that they could place negative information on your credit reports.  Of course they may have done that already anyway.  Keep in mind you don't owe these people anything.  They bought that bad debt from Ace or whoever.  If they spent money on an old debt with the idea of collecting money on it then in my opinion that's their screw up.  Also keep in mind if an old debt is sold to a collection agency such as this you don't owe that debt to the original creditor any longer.  In my humble opinion you don't owe it to the collection agency either.  Nobody forced them into purchasing an old debt.  And to keep it even more real.  If they did buy this old debt they only paid pennies on the dollar for it.  What does that mean.  If the Pay-Day loan was for $300. then you can bet the collection agency paid less than $15.00 for that debt.  $15.00 would be like 5% and I doubt if they even paid that much.  

    Not a lawyer here but I know the facts.  In my opinion, screw them.  Or as I usually put it.  "Bite Me"  Of course this is only my opinion.

    All they are doing is just trying to sell back your debt. They just bought from the person who originally had the transaction with. I would just pay it and get proof of it for records. They called me and I already dealt with something like this before because of a medical dispute. If you pay for it, it will just solve the issue.

    I was threatened as well, but then I joined Sterlla Corley’s Karate Academy and now I have self confidence, Perseverance, Determination, and a Positive Attitude! It can help me in defending myself from Collection Agencies and Phone Scammers! I pay only $70 a month; I think you all should join! I know I’m a new person now and I can never be threatened over the phone anymore. Thanks to Sterlla and my other sensei's!!

    Well it may sound like I am blowing my own horn here but I'm not.  It's not hard for somebody like myself with knowledge like myself to see this company is new and to say the very least a joke.  

    Employees hiding as debtors attempting to collect.  What a piece of work you are.  Your not going to make it in this business unless you change your ways.  Your going to be giving away a lot of your money you make to consumers and their lawyers because of your continued lack of knowledge or lack of caring regarding the laws that protect consumers.  

    I have been contacted by several consumers you've contacted.  Your a joke and your tactics are even more of a joke to somebody who knows the law.  First of all a consumer cannot write a check to Ace and then have some other entity throw that consumer in jail.  The check was written to Ace, not another party.  That other party has no rights to file criminal charges against that consumer.  There is no fraud unless the check you gave to Ace was not yours in the fist place.  Ace knows that in most cases the money is not in the account at the time the contract is signed.  After all that's why your there in the first place.  

    There is nothing Vandenberg can do other than attempt to collect on this debt.  So what you if they have a signed contract even if they can produce it.  Still a contract.  Don't pay it if you don't want to.  It's just a collection agency.  And if you find out that they put this collection account on your credit report I still would not pay the debt unless they signed an agreement to remove the debt from the credit report if you paid it.  

    I agree with another person on this board.  Because of the amount of the debt the company will most likely not persue collection other than a few phone calls.  They have to file charges [ civil not criminal ] in your state, not theirs.  This in my opinion would be to costly for them to do that.  

    If they continue to call you and threaten you document each call.  Take down as much information about the conversation as you can and then after a few instances find an attorney and file a  law suit against them.  

    Collection agencies have laws they must adhere to.  This group of idiots are sure not doing that.

    You've made good points, but it didnt answer my question...By the way the only thing questionable is that you're saying not to pay your debt, cause from what i know they can sue you... I owe alot and it hasnt been done yet(thank God) But i'm pretty sure you can get sued.

    Anybody can sue anybody else at anytime. The real question is: Is it economical for Vandenberg to sue a debtor? The answer is: Probably not.

    What your missing here is this.  You don't have to prove anything to this company.  They have to prove it to you.  And, if your concerned about it being reported on any of your credit bureaus the information reported must be accurate.  If the debt is not yours and it's reported, sue them.  It's a violation of your consumer rights.  

    If you allowed this family member to use your personal information then this is how you owe these #$#$#heads as you put it.  

    If your concerned about your cousin going to jail then one of you need to take care of the matter.  Paying the debt would certainly stop the company from coming after it.

    A collection agency cannot call you several times a day to collect a bad debt.  Again a violation of your consumer rights via FDCPA.  

    The only way you could get around not paying it is either not pay it or have somebody else pay it.

    I got a call for my fiance`on my personal cell phone! What happened to collectors not calling cell's; and these people are the rudest!  I was threaten that if I did not give them a debit card # that they were sending the sherriff over to serve a summonize! And that he was looking at 6mths to 2 years in county!  Well first in the state of Ohio they can only hold you for 18mths in county then you go to the State!  But I am to talk to these
    a--holes again today by 3:45 or they are sending they sherriff!  Will be checking back for sudgestions!

    Anna - there's a book out called "Don't Sweat the Small Stuff" you should read it.  I agree totally with Jim and if Rick had read Jim's message correctly in the first place he would have realized that ACE was in the wrong because they deposited his wife's check before the date the contract agreed to.  Personally, I received a call from Charles at Vandenburg and because my daughter (who posted a response earlier and works for a collections law firm) received a call the same day found out that they are totally in violation of the FDCPA rules.  Not only did this guy go to the extent of threatening me with being thrown in jail, but he alluded to the fact that it would be in the "SUPREME" COURT.  Not superior, Supreme!!
      My daughter called and spoke with some guy saying he was a "supervisor" and that this Charles / Chuck guy would be fired immediately and that they would be "settling" my case with me immediately.  Well, Lies Lies and more Lies they tell -- not only did I receive another call from Charles (some 3 weeks after he was suppose to be fired) with more threats, but just yesterday I got a call from some other guy there - they can't even communicate within their own company as to who is handling what account.  
       So, I'm contacting the big guys in charge of collection agencies and the FDCPA as should any and all of you that have been verbally abused by this company.  Here's a hint - if they leave a message on your voice mail, be sure you get a recording of it then you have documented proof of their threats!  
        Good luck to everyone - we really should put these type of collection agencies out of commission.  

        As far as the Payday Loan companies go, they should be regulated more.  Sometimes people get behind the eight ball and when they turn to a payday loan company for help, all they get raped by the excessively high interest and if they can't get it paid back (loss of income due to health or some other reason), they get made to look like some deadbeat - Stuff happens and the payday loan companies make enough profit they could be a little more lenient for extenuating circumstances.
        And to Rick and the other's who insinuated those of us who are in this situation should just be responsible and pay our debts, maybe you should step back and put that silver spoon back in your mouth.  Some of us don't have the luxury of family money or inheritance or some other out of the ordinary circumstance that allows us the freedom to have that "rainy day" account.
