Send them a cease and desist letter which you have every right to do under the Fair Debt Collection Practices Act. Better yet fax it to them at: 404-249-9599 and tell them to stop contacting you. By law they can call you one more time to let you know that they may take legal action. And don't lose sleep over that threat either. Unless you owe tens of thousands of dollars, this outfit ain't going to court over a couple hundred bucks. They can't afford to. They are just trying to recoup the money they paid to buy the debt. If they continue to contact you, record the phone calls and file a complaint with your state's attorney general.
- Jonty replies to JimWell, we could probably get a class action suit going. I have never heard of anything so unprofessional as this outfit. Everyone has the right under the Fair Debt Collection Practices Act to send any debt collector a cease and desist letter asking them not to contact you any further. After I faxed my letter to them, some smart [***] called me right back and said that they were going to take legal action. Any debt collector can call you ONCE after they receive the cease and desist to tell you they may take legal action. THAT'S IT. They cannot call you anymore and if they do, record the phone calls for evidence. Get in touch with your state's Attorney General's office and file a complaint. And don't lose any sleep over their empty threats to take legal action. For the small amounts they are trying to collect, it would cost them more than it's worth. This place will be out of business before long. The sad thing is they will get back into business under a new name.

And the people who are posting here using multiple pseudonyms claiming that you should just go ahead and pay the bill are merely Vandenberg, Chase & Associates employees. These people will be out of business by the end of the year if not sooner.

I doubt if Vandenberg is that smart. They sure have not proven anything to me except the fact that their methods of collection will get them into deep trouble. I've seen these type of collection tactics before.
Anyway, the trick the collection agency does is to have an attorney file a complaint with the courts. They could do it themselves if they knew how. Again doubt if they are that smart. Once the complaint is served on you then you have like 20 days to file what is called an answer. What happens is people most of the time ignores the complaint. Once you fail to respond a judgement will be entered against you. This judgement can be enforced. Wage guarnished. Property seized and so on. What I have seen many times is the compliant will simply state breach of contract. The reason that this is done most of the time is because the debt is usually time barred or it's beyond the statute of limitations in which you can be sued for the debt. Check your local state laws.
The idea behind this type of complaint is for the collection agency to get that judgement against the person. It's a trick that does work. In many cases you can get the judgement vacated or thrown out but that's going to cost you money to do that. And by that time it may be to late and the court may have already issued the writs to guarnish your pay or seize your property.
I'm just giving you some in-sight on at least one of their options. I agree with what has been said on this board. It's obvious Vandenberg has no clue on how to run a collection business. If anybody from Vandenberg is reading this I personally think your all a joke. I also think your website is a bigger joke. Telling visitors you abide by the FDCPA. I doubt if any of you at Vandenberg can spell FDCPA let alone abide by whats written in it.
In closing I also agree with another post here. It's obvious to anybody that has a brain here to easily see it's employees writing many of the posts written here. I also agree that your life as a collection agency is going to be short lived unless you start following the rules.
Again people... FILE A COMPLAINT WITH THE FEDERAL TRADE COMMISSION concerning your ordeal with Vandenberg. If enough people file a complaint they will look into it.

At no time did the caller "Bob Davis" identify himself as a debt collector or advise me of my rights in regard to the debt collection which he is required to do by law. He told about a check he stated I fraudently wrote over three years ago and that was a crime that they could prosecute me for. When I asked him for more information and something in writing he got angry and more threatening. Nothing worse that calling someone who actually has information on the FDCPA. I don't know what this debt is and he demanded I make arrangements when I have never received anything in the mail in regards to this debt. Then I proceeded to tell him that he needed to send me something via mail and not call me at my place of business again. This made him even angrier. I don't know about this company but this person clearly violated several parts of the FDCPA when calling me. I received an address from him o99f 887 W. Marrietta St. NW Ste J102 Atlanta GA 30318. I will be responding to them via mail, also contacting the FTC and the attorney general because this person was representing himself as an attorney which he clearly was not.

- Rhianna replies to Jinx| 1 replyWhen they called me initially, some woman started going off on me that they had an outstanding warrant for my arrest due to some alleged fraudulent check I had written. I was ROTF LMAO. I guess this tactic works with the uninformed general public, but she had no idea that she had reached an attorney. I laughed at her, told her that I knew she was a debt collector and proceeded to hang up the phone. Within 60 seconds another woman called wanting to verify my employment and once again I was ROTF LMAO and hung up the phone.
I went on-line and looked up this outfit and sure enough, sleazy small time debt collectors. When I tried to fax a cease and desist, I got a recording that the line was disconnected. So I played their little game, called them to verify the fax number, was put on and off hold for 10 minutes before they reluctantly confirmed their stupid fax number.
I faxed the cease and desist and they immediately called to tell me they were turning the matter over to their legal department. Wait a minute, I thought they were the Legal Dept. LOL, LOL. Whoooooooooooooo, now I am really shaking in my boots.

- myexperience| 3 repliesAfter weeks of harrassing phone calls, I finally called them back about a month ago. They told me they were "expediting a warrant" for my arrest for a PayDay loan I'd obtained from Ace Cash Express in 2005 that was unpaid. The way the rep explained it to me, was that it was just like writing a bad check, which is basically theft by check. I had totally forgotten about the check, (insert sob story here...I basically was starting my life over shortly after I took out that loan..leaving an abusive relationship and moving away) so 3 years later here I was with an accrued balance of $1100 from a $300 dollar loan. When the rep contacted me and told me the terms and what was going on, I knew no better and frankly had the S*&t scared out of me just at the mention of warrant. So, I made payment arrangements, made my 3 payments and as of June 20th am finished with them. I'm not a fan of CAs and I think there are some really slimey ones out there, but I do have to say that the lady that worked with me, Ms. Gracen, was very professional, understanding and kind. She would call me the day before each of my payments were due to make sure I remembered and that I had the funds available. As a matter of fact, one week I mistakenly told her the money would be in on the 12th and I meant the 19th (I was a week off on my pay schedule)and she moved the draft to the 19th no problem whatsoever. For dealing with a CA, I'd have to say, this one wasn't nearly as bad as some stories I've heard. Just my 2cents.

I just thought that I'd share a GOOD experience I had in case other people actually wanted to pay off their debt, rather than just gripe about it on a website..curious if everyone here is so "perfect and debt free" how do you know so much about these collection agencies and how they work? Must have had some experience with them in my opinion.
As for "being had", I paid less than what the collection agency was asking. Yes I know I would have paid ALOT less had I just taken care of it originally, but there were extenuating circumstances. I'm happy to have this blemish off of my credit in a positive standing rather than negative. - Rhianna replies to myexperienceI am not sure what Credit Reporting Agency you deal with, but the blemish as you refer to it will remain intact. It will show as a "write off" from the original creditor, but the fact that you paid the obligation as agreed thru another creditor (i.e. the collection agency) will be reflected on your credit. I think this is where a lot of people get confused when they agree to pay off something thru a debt collection agency.

I worked at this company and everything they do there is illegal. They purchase all of this debt and pay the collectors 20% per payment. They tell us to represent ourselves under false aliases and threaten check fraud by reciting the laws that govern the state that the debtor tive in. We used to refer to ourselves as "investigators" and pending warrants on every debtors answering machine, and threated to issue a summons by a local sheriff through the magistrate court. They are CLEARLY breaking the law. If they call you DO NOT PAY THEM...GET A RECORDER AND SUE THEM FOR WHAT THEY ARE WORTH!!!!

So these geniuses call his phone and proceed to threaten him with a lawsuit about a bounced check that was mine. I called the number and an operator came on the phone - I told them someone just called about my information and just violated my rights by proceeding to give my information out to a person other than me and I wanted to talk to whomever did that. He transferred me so fast, I didn't even realize it.
I guess the real collector comes on and I ask if he is a debt collector - nope he says - he is a lawyer and they are trying to avoid a lawsuit. First of all I says - what is this about and he tells me it's about a bounced check. Then I tell him, well that makes you a debt collector, you just violated my rights under the FDCPA, he's arguing with me and getting louder while I am telling him this. He then has the nerve to say - Oh you are one of those. Damn right I'm one of those I tell him, one of those who aren't dumb enough to fall for your tricks.
So I tell him to cease and desist - do not call me again and send correspondence to me in writing. He's still yelling at me while I'm telling him this and I hung up on him
