    Call Chase and tell them you do not want them to call you anymore.
    Write down the time and date that you call them. Each call you receive from Chase trace it using your telephone companies trace code. After five successful traces, contact the police and obtain an attorney. Sue them in Federal court since the calls are coming in across state borders. You can sue Chase for more than you owe them. I am advising you from my own experience. The call you made to Chase is recorded by Chase and can be supoened if you need to go that far with it.

    It is even dumber not to leave a message!!  I returned the call and kept hanging up because I couldn't talk to a person and they left know info. on what card it was for.  After I made 4 calls, I made a payment, but thought "Oh know, I just gave all of my banking information to a machine"  I called my bank and told them that I just gave my information out to who knows who (because it gave me no option to talk to anyone).  My bank account was changed and screwed me up on all my auto pays.  When, or if, I get chase paid off.  I will not deal with them again.  They also sent a letter saying they were lowering the limit and the day I received it, it had been lowered even more.  This time no notice or anything.  Whoever is doing your collecting should have better training!!!  They suck at their job.  If they don't leave a detailed message with the last 4 digits of the card how are we suppose to know what the damn call is about!

    do what I did,I lost over 75,000 on financial stocks,bac,amex,citi etc.I have all there cc cards,I maxed every card out for 55,000,.."thats my bail out",they aint get'n a penny from me,let them call all they want,I have nothing more they can take away...

    A "Cease and Desist" letter like this is a remedy provided under the Fair Debt Collections Practices Act, Section 805. Unfortunately, the problem with sending out the letter is that it may leave the debt collector no option except to obtain a judgment against you, which will show up on your credit report and may subject your income or bank account to garnishment.

    Certainly, when you are on the verge of going crazy from the volume of calls, it can be appropriate to send out the C & D letter. But you may be able to stall the creditor by asking them to identify themselves, give proof that the debt is real, prove how (if this is an assignee or purchaser of bad debt) they have the authorization to contact you, etc.

    Of course, in the end, you will have to settle the debt somehow, or accept a trashed credit rating. Unfair collection practices, high rates and fees aside...you did take the money and should expect to pay it back. The creditor is not responsible for your financial hardship that hinders your ability to pay back what you voluntarily accepted!

    These people make a living trying to collect bad debt.  Yes, how do you get blood out of an onion, is my thought.  Most of the american people have or on the verge of bankrupcy.  These unscrupulous collectors let alone bankers who rob people blindly with their fine print and increasinly rediculous finance charges on top of compounding interest rates, membership fees/annual dues ect..  high way robbery and mostly the folks that are calling you generally are not even calling you from the united states so, they really don't give a crap and they are not regulated by our laws....they aren't even illegal immigrants or anything they are outsourced callers.  Yes, if the calls are being recorded refuse to speak to them if the calls are being recorded.  Let them know that you intend of repaying what you owe if they can prove you owe them and then hang up if they are recording, ask for their name and id number and an address.  Start a phone log.  Heck, you could always file a personal bankrupcy if it is all that bad, since threats of ruining your credit are happening already.  Why not start of with a clean slate, sure your credit will be hard to re-establish, but you can and will do this.  It's just as hard to clean up a record that has been jacked up blemished with their reporting....get a free copy of all  3 reports...garnish your wages...okay whatever, they will need to take you to court first, better yet prove you owe them jack.  If you even owe them.  It's so stupid, I was a day late on a payment.  They charged me late fee I knew i paid off my merchandise purchase.  Went out of town , what wound up happening....late fee on late fee....they said I owed them more money they I had ever even borrowed on credit from them, in late fees and interest on late fees alone.  Talk about a bunch of crap.  I asked the lady to tell me what it was that I owed and why for what purchase, because of 1 day late, a snowball effect.  **ck you, yes, the american people need a forgiveness clause a brand new start for us all.....and new phone numbers and laws in place..something....our own government gets it's bailout...we are the people...we really need to wake up and regulate...really regulate....they work for us..we are not their loan slaves...no way. start living below your means america..

    I have been trying to refinance to pay this card off and I have repeatedly told them this and they continue to call 15 times a day, had to shut the ringer off on my cell because I am at work and it goes off constantly.  I will be ending my service with them when this is over.  OMG what a pain in the rear!

    They call me about 10 times a day. They even call me on SUNDAYS. They start about 8:15am and continue until about 9pm. I do not answer my cell phone for numbers I do not know. If it's important, I feel they need to leave me a message.

    they called me for the last week atleast 8 times a day.. which is horrible. i called the numbr back and the poor guy that finally got on the phone sounded like he wanted to cry after i gave it to him. i told him people have answering machines for a reason and not to ever call back or i would sue them for harrasment, cause that's all they are doing by calling that many times.. there was a report on my local news the other night about creditors harrassing people and it's not allowed. the poor guy they were harrassing was going to kill himself over it.. the creditor told him they would track him down no matter where we would go and get him.. good luck to all and don't take there b.s

    Olen, I would have to agree with you. In that letter the conditions would trigger a motion on the creditor's part to seek a legal remedy. Unfortunately all one can do is wait until you get the first summons and then get a bankruptcy filing within 30 days of service to appear for a debt. That would cost the creditor some legal fees and halt their action. Now they can always come to court and protest the bankruptcy, which RARELY happens, especially if the collection agency is outside of your State.
    I have not answered calls, but have made token payments until last month. I have been advised to get past the 90 to 100 day mark since last using the cards. After 4 months of not paying I will address the collection agency letters by asking them to provide me proof of the debt with copies of the charges and also a copy of the contract they have with my creditor. The ball now goes into their court.

    PLEASE NOTE: If you send them a Cease and Desist letter they WILL STOP CALLING. I have done this myself and know that it WORKS! Here is a sample letter:

    Received several calls from them, in which they claimed to be Chase.  I called back today and I did something stupid . . .they asked for a  16-digit account code, and when I couldn't think of it, they asked me for my social, name, address, and phone number (which they already have obviously), but I gave them all of the information, because Chase does ask those questions to verify account information.  They told me I was late in payment and asked if I was calling to process my balance over the phone. I asked if it would be possible to do online, which they said it was not.  They then asked why I was late in paying my bill (which I supposedly owe $170, no an astronomical fee), and said that if I don't pay them within 5-7 business days, they will call back.  After hanging up, I googled the number, and found this site, and now I am very worried that I gave them my social, name, and address (but no account information).  Does anyone know the actual 'company' these people are from?  And regardless, is there anything I can do to tell them not to use my information?  I know it was dumb of me not to check online first, so please, only helpful comments!
