- Kelly Clover| 6 repliesI recently received both phone calls and letters from Rauch-Milliken trying to get me to pay a bill I do not owe. They claimed to be representing Ziplocal and attempted to extort $427.86. I say "extort" because of their constant threats to seize assets thru a lawsuit. The amount in dispute with the original creditor was only $59. The original bill was disputed because Ziplocal billed me in excess of what was agreed to. The fact is I do not owe either amount. Either Ziplocal or Rauch-Milliken is extremely dishonest. How else do you explain $59 becoming $427.86 once referral to a collection agency for the disputed bill is made?

- B-Edwards replies to Kelly CloverHere is a link to some good general info that might be of help. However you have a specific problem. Here's one question I have right off. Was the matter of the $59 that was in dispute settled? Do you have a release or judgement to that effect? If so, that makes your position much stronger and may give you more choices. Searching this site and on the web tells me that Rauch-Milliken has collected complaints about being a debt scammer. You are right to be suspicious.

It appears that you have a business that you are advertising or were advertising through them. Rauch Milliken is a commercial debt collector and as such does not need to abide by the FDCPA. As to the extra charges, you should be reading your contract with Ziplocal. Something you should have done before signing. There may be a clause in there that puts the collection fees on you. As a business owner you should be carefully reading every contract you sign before you sign it. If you don't understand contracts you will have lots of trouble ahead of you. I would suggest you consult with an attorney who can go over the contract with you and give you advice. You should find one that is willing to work with you and establish a business relationship with him/her.
- Kelly Clover replies to BigA| 3 repliesVery unlikely that I will consult with an attorney beyond what I've done. No one can afford their $300-$1500 per hour fees. I ran into some problems trying to get help from "free" consumer debt issue attorneys because this is considered to be a commercial debt issue. They were only willing to provide free representation for non-commercial debt issues.
- BigA replies to Kelly Clover| 2 repliesYes because those debts are covered under the FDCPA and when they sue the debt collector, he has to pay their fees. As I said, this is commercial debt and as such there are no protections under the law. It is assumed that the business owner should be savvy enough to enter into contracts. I haven't heard of too many lawyers charging $1500 and hour. Most are in the $300 to 500 range, but will negotiate if necessary. Some will take cases on a flat rate basis as well. If they sue you it will cost you much more. I don't know how aggressive this outfit gets. So I gave you my advice, you can take it or not. I'm done here.

Would be nice if B-to-B collection had to honor some FDCPA variant, but people in business are supposedly big boys and girls who can handle their money. Still, no one gets to choose their collector, and the commercial sharks can be very hard to distinguish from their bullying counterparts in the junk debt trade. - BigA replies to Resident47Yes, I guess you are right, but I personally feel that debt collectors should always foot the bill for their crimes against humanity.

- Chesterfield| 1 replyI have been getting calls from these people for two months now, and recently I have started receiving snail mail from them. I want to show people the process Rauch-Milliken (RM) uses: The first few phone calls, e-mails, and snail mails are pretty generic as far as debt collectors go. It is the standard "please call us and work something out, it would be awful if we had to do anything to you" type of calls. At about the two week mark, RM starts the story telling. I got an e-mail that was marked up to look like someone at RM accidentally hit the "Reply All" button. The e-mail had "RE: Suit Requirement For [my real name, not my business name] Met" and it gave some BS about how "Kelly" should contact me one more time and give me two days to pay before turning me over to the unnamed law firm "in my area." I ignored that e-mail. One week later, and five days after I missed the payment deadline, I got an e-mail that was supposed to like like it was forwarded to the wrong person. The subject was "FW: Pending Legal Action Against [my real name, not my business name]." The e-mail purported to be from the "Legal Department" of RM to some low level employee at RM. The "Legal Department" manager said things like, "Kelly, thank you for all of the time you put into this case." "You need to submit your work to an attorney." "Give him two days to pay before you do." Again, I ignored that e-mail. For the next month, I got calls from the "Legal Department." I also got weekly bills from RM that were disguised as legitimate bills. These bills were clearly designed to deceive my accountant into paying them while thinking they were for current service. Finally, last week, I got a letter offering to resolve this issue for $0.50 on the dollar. Nope, not doing it.
Actions I have taken: Pre-trial research requires a Private Investigator's license in most States. I have reported RM to the licensing board of LA and my home state. Some of these e-mail explain the judicial process, which is a form of practicing law. I have filed complaints with LA and my home state. Making threats to obtain economic enrichment is extortion. I have filed complaints with the FTC. Recently, the FCC has gained jurisdiction over abusive phone calls. I have filed a complaint with the FCC. The RM web site is written to deceive people. I have filed an abuse complaint with Godaddy.com, the host of RM. I have also filed complaints with the LA Attorney General and my home state. Get the point? You do it also...- Caller: Rauch-Milliken

We cancelled with YP bc of them not honoring our contract. We have e-mails & voicemails showing our attempts with YP to honor the price set and contract set-up. Bogus and this gentleman needs to be sued.
