    I wonder if our state really enforces this law at all, tho I did read where Sen. Schumer fined some recently.  Notice it's usually lunch or dinner time they call.  I thank God I have caller I.D.
    I do not pick up.  They call at least 5x a week.

    Unfortunately, that's what deadbeats do. My neighbor was one of those deadbeats. Gave out our unlisted phone numbers and cell phone, then had the nerve to unplug her own phone because of the calls- so I got them! Deadbeats are deadbeats- when they make a living scamming, they make everyone they touch miserable.

    On the other hand, in this economy, there are very good reasons why someone is behind on payments and I hope to be able to work with them and see if we can't get the harassment down to nil.

    Social Security benefits can be garnished to repay Federal debts, but never below $750 per month. A garnishment can take 15%, or the amount over $750, whichever is less.

    You’re right that Social Security benefits are generally protected against garnishments. Social Security, along with just about every other government benefit, is “exempt” from collection. That means nobody can get at it to pay a debt.

    Nobody, that is, except Uncle Sam himself, by his G-men at the U.S. Treasury. Since 1996, the Debt Collection Improvement Act has authorized the Treasury Department to collect money owed to the Federal government by garnishing Federal benefits and pay. Within the past few months, garnishments of Social Security benefits have actually begun.

    Only “non-tax” Federal debts can be collected this way. Such debts can result from (among other things) unpaid student loans, defaulted HUD, FmHA, or FHA mortgages, and overpaid Federal benefits, including Food Stamps.

    You should get lots of advance notice before any garnishment occurs. The agency you owe the money to is supposed to notify you 180 days before your garnishment begins. The agency's notice should tell you how you can dispute the debt, or have it verified.

    In addition, Treasury says it will tell you two more times before any money is withheld. Then you should get another notice each time your Social Security check is actually garnished, telling you what agency is being repaid, and how much left there is to repay.

    The most that can be garnished from Social Security benefits is 15%, and your benefits should never be garnished below $750 per month. If, for example, your monthly benefit is $800, 15% won’t be taken—just enough to reduce your check down to the $750 floor.

    Also, only your net monthly benefit gets garnished, after deductions for things like Medicare.

    Supplemental Security Income (SSI) will never be garnished. (Except to repay SSI overpayments, which can be recovered by a 10% reduction of benefits.)

    If you owe the money, about the only thing you can do to stop a garnishment is to pay what you owe, or make a payment arrangement.

    When Federal agencies garnish your pay, it’s called an administrative garnishment. That’s the only garnishment that can happen without first taking you to court.  Regular creditors, unconnected to the Federal government, have to sue and get a court judgment before they can try to garnish your wages.

    Regular creditors however, will never be able to garnish your Social Security check.  For non-Federal debts, Social Security remains off-limits.

    Section 207 of the Social Security Act (42 U.S.C. 407) protects Social Security benefits from assignment, levy, or garnishment. However, the law provides five exceptions:

       * Section 459 of the Act (42 U.S.C. 659) allows Social Security benefits to be garnished to enforce child support and/or alimony obligations;
       * Section 6334 (c) of the Internal Revenue Code (26 U.S.C. 6334 (c)) allows benefits to be levied to collect unpaid Federal taxes;
       * Section 3402 (P) of the Internal Revenue Code allows beneficiaries to elect to have a percentage of their benefits withheld and paid to the Internal Revenue Service to satisfy their Federal income tax liability for the current year;
       * The Debt Collection Act of 1996 (Public Law 104-134) allows benefits to be withheld and paid to another Federal agency to pay a non-tax debt the beneficiary owes to that agency: and
       * The Tax Payer Relief Act of 1997 (Public Law 105-34) authorizes the Internal Revenue Service to collect overdue federal tax debts of beneficiaries by levying up to 15 percent of each monthly payment until the debt is paid.

         The Social Security Administration's responsibility for protecting benefits against legal process and assignment usually ends when the beneficiary is paid. However, once paid, benefits continue to be protected under section 207 of the Act as long as they are identifiable as Social Security benefits using normal banking practices. For example, only social security benefits are deposited into a particular bank account.

         If a creditor tries to garnish your social security check, inform them that unless one of the five exceptions apply, your benefits can not be garnished. You also may want to provide this same information to your financial institution and seek legal assistance if you believe it is needed.

    No need to answer, I'll do it for you.  It is because bill collectors like "DCS" are unscrupulous vermin who prey on the misfortune of others.  Sure, there are a few scumbags who set out to defraud but most consumers want to discharge their obligations properly.  However things don't always work out.  Unforeseen disaster does happen.

    If bill collectors really wanted to "help", as they would have you believe, then they would not resort to lies, threats, intimidation, coercion, harassment, and other illegal behavior.  The only thing they want to "help" is themselves, to your money.  Try setting up a reasonable payment plan with minimal interest that the consumer can afford and then you will be helping.

    So, is it any wonder that outfits like "DCS" are looked upon as pond scum?
