If you owed a debt, would you want us to call all your friends to find you and let everyone one of them know we are trying to collect a debt? Get real, folks- I know you are curious but we are bound by the law not to reveal we are a collection agency. Just help us find the debtor and then we can offer them ways to get out of debt before the gov't goes in and just garnishes your wages and takes all your tax returns.

I know that deaths are hard, but cleaning up their affairs is just what has to be done by family. So the sooner you can provide the info, the sooner we can clear the debt and no more calls have to be made.

- VermonterI got a call yesterday and didn't answer it because I didn't recognize the number. They left a message stating they needed to discuss a defaulted college loan and to call their number. That got me freaking out because I've never had a college loan and immediately worried someone had taken out a loan in my name. After contacting all three agencies for immediate credit reports that came back clean, I was a little calmer. Turns out they want me to give them my neighbor's cell phone because his number's been disconnected. So I did go over, but to tell him about the Fair Debt Collections Act and to help him out a little, it's not even his student loan, it's his sibling's.

- curious| 1 replyquick ?, i called the company to offer to make payments on my loan because great lakes told me they had my loan and blah blah and i want to finish my degree. so i call about 8 months ago, they guy was an ass when I CONTACTED THEM and told me i couldnt make payments i had to pay in full. ok well i am a single mom of 2 with a crappy part time job, paying a loan in FULL is NOT an option. so i wait till this tax return and figure i will pay it off with that and go back to school, no biggie. i call they say i owe this amount and i say ok. but NOW he offers to let me make payments and says its important for me to go back to school. lmao. uhm ok. then i find out there is an offset on my tax return to pay this loan, so i contact DCS yet again and talk to the same guy, it sends me straight to him when i call, and he says "oh i did not know that, well here is whats going to happen. they will take your entire return and in about 2 to 6 months they will take out what you owe, which by then will be much more than what it is now due to interest and such, and then mail you a check with whats left if anything." i say ok i will call you back. 8 days after filing i RECEIVE MY FEDERAL RETURN WITH THE AMOUNT OF THE LOAN TAKEN OUT. so i call him again and let him know my refund has been given to me, and the amount of the loan has been taken out. then he says, "well it has not been applied to the account yet so in my eyes you still owe (said amt)." WTF. so 1. he is either trying to scam me for more money OR he is a dumbass who has no clue what he is talking about. 2. if it was going to take 2 to 6 months for the loan amt to be taken out of my refund, how did i get my refund in 8 days with the amt of the loan taken out? 3. why does the irs and treasury dept say the money has been sent to the collector and yet he says i still owe the same amount and nothing has been applied? its all bull and i am tired of fighting to get back in school. i have 2 other loans in deferment and am doing my best to better myself for my family and this company is taking me for a run around. i am to the point of contacting a lawyer.

- Tipsforwhentheycallyou...I have learned a lot via my experiences with DCS. They violate the law all the time, most of the time in smalls ways. Bring it up to them, and they tend to back down. I did, and now they have.
I actually find it quite funny, the tactics they use to try to intimidate. My favorite, is the double team. What they will do is have two agents on one account, and one will be the nicer more gentle one and the other is the hard-pressed manager looking to make a deal. The effect is to make you dislike the manager so much, you are more willing to speak with the original collector that was nicer.
This actually happened to me last night. I have a debt attorney who is going to be handling things from now on, but for anyone in my same spot, this is what I said. We have the legal right for contact information from DCS, so when they call, ask for that contact info and explain that you will no longer be corresponding over the phone unless it is via attorney, and that you or your attorney if you have one, will be sending you an agreement (Write the terms out), and send it certified mail.
The "Financial Agreement" they want you to fill out over the phone is crap. Pure crap. There is no need for it because you set the agreement up via your letter. do NOT GIVE ANY INFORMATION OUT TO THEM.
Get a receipt and keep a copy for your records. (And , just so ya know, they are ONLY supposed to contact your lawyer after he is added on your file). Ask for their mailing information, make the collector give it to you. You have a legal right. (If they are the "manager" they will talk really fast and try to talk over you. Just stay calm, this is a tactic. Ask them to repeat themselves and write down everything.
What DCS doesn't want people to know is that....

collection agency must accept as little as $10 per month for at least six months. As long
as you make the payments, you are eligible for Title IV Student Aid, and you can
continue the payments unless your circumstances change"
All collectors are required to say that this call is being recorded and any information will be used against you....most don't til the end, which is illegal. Most will do the tactic of not recording in the beginning so their bases are covered, then they will switch the recording on when they want to use something against you. (You can tell sometimes they are recording by a slight echo or a static sound happening for a second).
Good luck everyone! I realize these collectors are real people, I mean I assume they have no choice other then to be human, but at the end of the day, they will use any tactic they can to get as much money out of you as possible.- Caller: DCS

- T8 replies to curiousJust for the record DCS Inc. does not take anyone's taxes, the IRS does. As long as the loan remains in a default status it is subject to an offset. Yes the balance is applied towards principal and interest on what you owe. Sometimes you find out before DCS systems are updated with the information. Oh well. Life goes on. Being decertified from the IRS offset list is one of the benefits of rehab. I see people make it through the government program which used to be 12 months (since reduced to 9) where 9 consecutive monthly payments are made, every day. It is legitimate, DCS Is legitimate, and anyone who may beg to differ doesn't know what they're talking about, didn't read the fine print when they signed their loan, and and/or wasn't listening when they signed up to make payments in the first place. You can't make 9 payments, 2 months separation here, 1 month separation here, 3 months separation here - they have to be consecutive. How many do overs do we all wish we had? How many thing do we wish worked like that? Default on your car loan? Bye bye car. Default or your mortgage, hmmm....there's a problem. Default on your student loan, all is not lost and it's fixable. You get through 9 or 10 consecutive monthly payments, return your rehab paperwork, your loan goes back to a new lender with the client, it's as if it never happened. The default status is then removed, it is considered a loan in good standing, any derogatory marks that may have been on the major credit reporting bureaus are removed, you can qualify for additional financial aid if you so desire, if you had any deferments or forbearances that were available to you before the loan every defaulted, you can now request those. You can hire a lawyer, just peachy keen. You'll just end up spending more money having reinforced to your what you should have been doing all along, and you'll be that much poorer and the lawyer, well....he/she will likely be smiling. I never realized before just exactly how hard these things are to get rid of. They will follow you around and haunt you for the rest of your life until you face the music and take care of them. Student loans are not dis chargeable in bankruptcy. The only ways I've heard of to get out from under a student loan is to 1) die 2) become permanently disabled so that you'll never be able to work gainfully again in your life, 3) perform some type of humanitarian work for so many years and in some cases the student loan balance will be completely forgiven.

That shows that you work in the dark blinded by your timid job description, clueless about what statute & clause (the one you refer to as law by your name) that you are breaking.
