    maybe some of us were let go during the down turn in the economy and maybe we were barely making before we lost our jobs.  maybe we did cut out all extra expenses like starbucks and cable and the washing machine at your apt and you eat dinner at your parents and you friends house every night so that way you don't have to buy food for your own apt.  maybe when you did find a job you had to take a $500 a month pay cut so yeah you still can't pay your bills and you are currently looking for a part time job to work on the weekends all day so you can have some more money to pay bills and so you can watch you life go out the window and know that you will never find anyone to marry because you are working ALL the time to try to get out of debt!!! bad things happen to good people all the time so DO NOT sit there and lecture us about paying our bills on time having a roof over our heads, electricity, water and a car to find a job to eventually pay bills are a bit more of a priority at times than paying some bills. not all of us were blessed enough to keep our jobs so do not preach to us.

    Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

    Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

    This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

    David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

    [The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

    Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

    So what can you do if you receive "wrong number" calls from debt collectors?

    1. Sign up for the Do-Not-Call registry.
    2. Save the calls captured by your voice mail or answering machine.
    3. Contact a consumer lawyer.

    Repeated Harrassment Calls
    Transcription of the call: "This is a highly important call regarding Trisha Heft. April Hart calling from the office First Source. It's very important I hear back from you. We will be in the office until 7 p.m. your time. Contact number is 888-580-7675 and when calling in refer to reference number 14774627."

    These calls have come at ridiculous hours in the past. This one was during the day. I tried googling the name "First Source" and the city from which the call came. The closest match was First Source Solutions Ltd. in Amherst, NY. I called the number and a voice at the beginning of the call said that I would be charged some number of cents per minute. I think it said four cents.

    Please help me figure out who to call to report this annoying harrassment. I don't know the person they are calling for!

    I get these msgs on my home and cell phone. I don't answer. I would suggest you do the same thing.  Either that if there will be no noise at your home for awhile pick up the and leave it somewhere OR continually let the answering machine answer it. they usually hang up when that happens.
     HOWEVER, you are in the loop and until they get what they think they are going after they will con't to call.

    Who is this company? I have been divorced for 9 yrs. Mark Alan Theatt lives with Joanne Versace and has since I put my/our 3 kids on a plane and left New York! He does not pay child support. He is a deadbeat and I don't pay his bills!

    This number here 716-564-4905 is driving me crazy.....They call and call yes, I owe Captiol One money but times were hard...They don't care what I had to say they need the balance ASAP.I was willing to give them something but NO they needed what they wanted ..What do you do with debt collector's that are breaking law when calling people DAY AND NIGHT? FETAL ATTRACTION that's what this company all about.....SOMEONE CALL 911 OR HELP ME!!!!!!!!!!! That's how they make you feel everyday when they call you. Can someone please tell me the law on Debt Collector's calling to collected? Thank you!

    Under the FDCPA (Fair Debt Collection Practices Act) they are allowed to call from 8AM-9PM (local time).

    If they are calling you before or after those times, they are breaking the law.
