    The FDCPA does not apply any "Blue Laws" and does not ban collector contact on any day of the year. State laws tend to parallel. You'd have to read your own to clarify your supposition.

    You will need a different strategy since (1) the DNCR does not apply and (2) your report to the DNCR site will therefore be a dud. You should have received a dunning letter by now summarizing the claim and hinting at your right to dispute, which you should do in writing. Penn Credit then must either put up -- with debt validation -- or shut up.

    800Notes is not a messaging service. 800Notes does not send alerts to your callers when you post here, a bulletin board style of website with public access. You must direct your demands to the sources of your unwanted calls.

    Yes, that must be why the CFPB and FTC are busy all year busting the worst debt collectors and other bad actors. I guess you missed all their memos ... and press releases, and blog entries, and reports to Congress. But if you want vindication for your belief, just give it a month and watch the new oligarchy tear apart the CFPB and begin to systematically dissolve your rights.

    As to the "fishing ploy", debt collectors get sued rather easily for discussing debt with the wrong person. It is common industry practice for agents to keep a tight lip until they are satisfied that the alleged debtor is speaking. That said, you've no obligation to submit to questioning and nothing prevents you and Penn from doing business by mail.

    Your callers do not maintain this site or this web page. Your callers do not receive your publicly posted remarks as private messages. You cannot expect compliance with your orders until you deliver them directly to your callers. It is unwise to publish a phone number you meant to protect in an open forum where any data harvester and scammer can find it. For that reason, I've asked Admin to redact.

    Penn Credit is known for aggressive and false skip tracing. You may be right that no one in your home is the intended target. But they will make the manhunt your problem through repeated disturbance until you fix it. It's unfair but the state of the trade.

    You could lay out for a hardware call blocker or VOIP service, but that does not prevent nuisance callers from trying to pelt you. A notice to shut up via Certified Mail is a cheaper and longer lasting alternative with the added bonus of a higher legal barrier against Penn calling a dead end. Let them try again and they could be liable to you for a tidy sum. But first you need assurance that you're not the alleged debtor, in which case chopping off all means of contact may hurry you toward a collection lawsuit.

    I did acknowledge the "aged post" and was trying to advise the current readership only. The part of the law at issue has not changed in the past six years, and it remains useful to alleged debtors, not to mention misunderstood and ignored by some collectors.

    Yes, I was aware of the date stamp. Bladewalker knew (then) of no FDCPA winners, for my part a concern I've never seen raised. Much as there is always risk to calculate I advocate litigation often, but never paused to point to everyone who took a victory lap, which as I now reflect is common practice for state lotteries. Not really a fair comparison, but some people might need to see a pattern of success before drafting that first complaint.

    Normally I don't answer when these people call, but curiosity got the better of me today!!! The person they asked for does live here. All they said was they were trying to collect a debt in a certain dollar amount. NEVER gave the name of the company they represented, so push button 3!!!!!!!!!!! Will go back to saying; "Joe's pool hall, "how can I help you?" just to annoy them!!!!!!!!!!!! THEY HANG UP!!!!!!!!!!!!

    Caller ID showed an incoming call from 000-000-0000/Unknown at 8:45pm tonight. Didn't answer, but they left a recorded message, saying it was a business alert for "xxx xxxx" (someone I actually know, but not a relative, nor have they ever lived here), and left 800-900-1380 as the callback number. Um, no.
