It's not really how the industry works. The sales and charity call centers work from simple leads, but the debt collector typically begins with account assets. They may not amount to more than spreadsheet entries, but it's a more dense pile of data.
"Simply call them back" is what they would like, but people cannot count on being taken seriously when verbally claiming "wrong number". Hence the reason I've promoted paper notices and Certified Mail for so long. - Resident47 replies to Ken(VA)Interesting ... The dialer would need to dump a call within four seconds to avoid sending Caller ID. I've been consistent in regarding "ring and run" calls as "annoying and/or harassing" in my FDCPA complaints. I would have far less trouble painting them so if I had two phones jangling simultaneously and repeatedly. You would need to conduct audio/video surveillance of the two phones in the same shot to demonstrate the events. Carrier phone records alone would never convey the sheer annoyance factor or the potential siege mentality.

Third party debt collectors do not have the authority to collect a debt that is not assigned to them...meaning you do not have a contract with said debt collector there for you do not owe said debt collector any money ...here is what u do ... first call : do not verify any of your information especially last 4 digits of social do not give them your number call private and so not give them any bank info or addresses ...ssnd them a a cease and desist letter so they can only contact you via mail next send debt validation letter certified....wait for return letter with your debt info....they cannot collect from you unroll they verify your debt completely....if they verify your debt ....send a requests for chain of assignment...what this is is a bill of sale between the original debtor and third party debt collector stating that this debt collector is authorised and ownes this debt....if the debt has been sold several times they must send the entire chain of assignment to you listing every single collector your debt has been sold to if they miss any page or skip a debtor you tell them they have not verified they own this debt and there for u do not plan on paying ...they won't take you to court because this is a small claims debt collection agency ...its not worth the paperwork!!! And you tell them you do not have a contract with them so are not obligated to pay .....know your rights!!! Most of these agancys do not have propped paperwork to back up what they say !!! Good luck

This is true in the contexts of debt holders who sell the same accounts to multiple buyers and Indian thugs who invent debts based on loan applications. But of course, these minority cases are not the fuel of your argument.

Once more from the top .... You cannot assume that just because you've never heard of Penn Credit or whatever debt collector or buyer that you cannot be obligated.
* When you accepted the credit card or vehicle loan or magazine sub or hospital service, or whatever form of credit, you agreed to ALL the terms of a contract of adhesion.
* That contract gave the creditor the power to collect overdue funds any way it liked, including assignment to third parties not of your choosing.
* That third party may be a real lawyer ready to file a real lawsuit and win.
* The account is not your property and the creditor may sell it to anyone it wants.
* Your account has a contract clause which says that it survives all changes in ownership.
* Upon purchase, junk debt buyers obtain the right to enforce ALL the terms of applicable creditor contracts.
* The JDB may in turn assign the collection job to yet another third party, who again may be a real lawyer ready to file a real lawsuit and win.
THAT CONTRACT IS HOW a third party collector gains authority by assignment. THAT CONTRACT IS WHY a JDB has standing to sue even though it wasn't around to watch the debt lapse into default. If you want to fight your collectors, they can make plenty of mistakes for you to exploit, but usually improper account assignment is not one of them.

Not this again. A full "cease and desist" shuts down all forms of contact, including paper mail. This paints the collector into a corner and may force the creditor to sue to collect. Still think it's "PROBLEM SOLVED!!" now?
You can notify the collector of which phone numbers and addresses (and hours and days) are inconvenient, and for that you will in fact need to "verify your information", contrary to your caution.

First off, do you want a cease-comm or do you want validation? You can't have both. Either you halt collection activity or you allow it. Next, we don't want the crowd getting the impression that they can demand "papers" any old time. There is a specific and fleeting thirty day period set by the FDCPA, the controlling law which you neglect to mention. I'd also add that debt validation may not come as a "return letter" only.

You are out of your mind if you think anyone is getting that much paper trail without an active court case and a few subpoenas. Please show us the line in the FDCPA which forces debt collectors to do what you want.
Adding to your lack of authority to advise, you think an "original debtor" exists. Debtors owe money, creditors seek it. Therefore, (and not "there for") the phrase is "original creditor".

Think so? I can start a lawsuit claiming several grand in damages in my state for a mere $45. How to make it pay off? JDB buys accounts for 03% of face value, lards on legal compound interest, tacks on any other possible fees, sues hundreds of people at once for the total value, and splits the booty with the local attorney, whose work is greatly reduced by lookalike complaints and nearly automated processing. They win by default 97% of the time, and pick off another two percent of defendants who listened to reckless, ignorant advice like yours. PROBLEM WORSENED!

I've seen the same discrepancy from other agencies, calls rolling in on weekends and at hours when allegedly nobody is at the office. When accepting those calls or placing my own at strange hours, I've sometimes experienced transfers to a call center after noticeable delay. At a guess, the collection agency has farmed out the job to yet another call center, not necessarily one which is itself a full time debt collector. Therefore any violation heat will be directed solely at the client. The "BPO" was just following orders and is not likely a "debt collector" as the FDCPA defines one.
The insurance industry uses the same approach. You place a call for a claim at the wrong hour and you'll get one of the second stringers, whose powers are limited and can't do much beyond collect a story and pass along the case to a superior. - PandaThis # calls twice a day everyday.
