Tina:  They can do nothing to you.  Not a thing.  I don't know where you live but go to your state's web site and go to licensing, go to the search database and put in their name and city and search I am almost positive that they are not licensed to collect in your state.  They are horrid and you can see by my previous post that the "validation" letter they sent to me is something that they made up not what was asked for.  Send them an email and ask for validation of the debt from the original creditor, ask for validation that they have the right to collect the debt, and ask for a payment history from the original creditor.  Do not take there calls.

Tina,  it is not your husbands responsibility to fax anything or prove anything to these scammers.  They will not be serving anybody. It is a scare tactic to force panic and unwise decisions.  It is how these scammers work.  They threaten and scare people into paying but have nothing to back up their claim.   No one goes to jail for civil cases.  There is no debtors prison.  All these people have is their telephone,  lies and a big mouth.
If they call again,  which they will,   tell them that you demand verifiable written validation,  via us mail not fax or email,  of the original ALLEGED debt,  Original amount of the ALLEGED debt,   dates of the last and final payment made on the ALLEGED debt,  as well as a verifiable copy/proof of any signed contract that may exist with the original owner of the debt.  They have 5 days to provide this.  Do not accept fax or email as it is not acceptable proof or evidence.  If for any reason they refuse,  say they don't have to,  or that they have already sent it,  or that you have that information from the original owner of the debt,   we then they are violating the laws of the Fair Debt Protection Act  (FDCPA)  and you are not legally obligated to pay any debt with out validation.   Then inform them that you are disputing the debt and it is up to them to prove it through written validation.  If they cannot,  which they can't because they are crooks,  you have no legal obligation to pay anything to anyone.    DO NOT BACK DOWN FROM THEIR THREATS AND INTIMIDATION. STAND YOUR GROUND AND LET THEM KNOW IT.

Tina:  This is also useful information--I worked with a company out of New Jersey that took my payday loans and settled the debts.  After this process was completed I was still receiving calls from Debt Collectors who had seen some report with my information on it.  I emailed the company that worked with me and, I have it in print, only store front loans can sue out of state to collect, and she does work for an attorney.  I hope this helps everyone.

If you ask for details of the alleged action (name of case etc), the lady transfers the call to an intimidating man who asks YOU to provide him with information. He just rambles on and on. He avoids providing any information about the legal action because there is no real legal action against you. If someone is calling for you, he will ask YOU to send him a facsimile. Notice how they are not wanting to give YOU any information or writing.

ADVICE: Ask for a letter that states who THEY are and their claim. If you never get the letter, do not be surprised. These are scam artists (frauds).

I called (855) 393-3793 and encountered suspicious people (trying their best to seem legitimate) using fake names who cannot verify their claims against you. Total Frauds who should have been Arrested already.

Kyle, you are correct. It is THEIR responsibilty to verify who THEY are the debt. They must receive a tons of faxes all days long from people who believe what they hear over the phone.

ps: I actually encountered the "BIG MOUTH". He just kept rambling on and on and told ME to fax him a letter stating who I am etc. Amazing that people will send this clown letters.

Today  recieved another call 4/15/2015

     At first   They used The Name of WEST SIDE ASSOCIATES!  an after  calls an calls then the calls stoped at  it was a Ashley  from this Number 855/393/3793  usesing the Name now Swanson Walker an Assocaiates!   saying that we still owed a debt from a Check an Go  from 2003    she said, I paid some on it than stoped paying on it!
     I gave her my address  an email address  an told her I needed to see  who an what an where I took this Check an Go    an all they emailed me was   there address an That  I owed them 477.00 dallors!  Nothing had my sigiture on it or the date or even how much of the payments  I had made!   Totally a Scam!  
     They threatened me  with Judgement in my County!    This debt was 10 years ago!  I told her  I paid  a company much like her's   some years ago!  I told Ashley, I'll have my Banker go back on Microfish an look it up an find it.  
     Ashley, in her words   told me well if you pay this today or tomarrow an then you  find your recipt under your matress contact us an we'll refund your  money to you in full!   an you have 30 days to pay this debt or we'll take you to Court!

IceHouse:  Go to your state's website and check the statute of limitations, I am sure it is up on this as it was 10 years ago.  They can do nothing to you.  I am sick of their scare tactics.  Isn't it enough that people from outside our country want to do us in?  Do we have to have phone terrorists too?

These guys are thieves.  They yell.  They lie.  They threaten you hoping to get money.  Hang up.
