*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

Perhaps not all employees are not as nice or reasonable, but Roger Dalton, who I believe had an Indian accent was very helpful. He's an account manager but more of a tier 2 level so you must be transferred to him or his voicemail. He helped me payoff past walmart and amazon credit cards at a discount and with low monthly payment amounts. Also he didn't require upfront payment to set this up, only my account info for post dated payments. Also they mailed confirmation of the agreement I made and also another paid as agreed confirmation letter once complete a few months later. This was as recent as 2 months ago so I'm sure he's still there. I'm not a paid blogger or bot, I'm a teacher and local to the chicago area. 28 y.o Male. So believe me or not the choice is yours.

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?
The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

New York v. Encore Capital Group

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On January 9, 2015 New York Attorney General Schneiderman announced that his office has obtained a settlement from Encore Capital Group Inc, a major debt buyer, for bringing improper debt collection actions against thousands of New York consumers. His office alleged that for years, Encore sued New York consumers and obtained uncontested default judgments against consumers who failed to respond to the lawsuits, even though the underlying claims were untimely under New York law. Under the settlement, Encore will seek to vacate more than 4,500 improperly obtained judgments totaling nearly $18 million. Encore will also reform its debt collection practices and pay civil penalties and costs in the amount of $675,000.

States Attorneys General v. Midland Funding

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On January 9, 2013, the State of West Virginia obtained court approval for a settlement agreement and issued the final order of dismissal against Midland Funding, LLC. The terms of the settlement agreement consist of Midland Funding agreeing take the appropriate measures for the collection of consumer debts, validate consumer debt through the use of the judicial process and issuing a credit to the outstanding balance of the judgment for the full amount of any post-judgment interest imposed by the court to each consumer and/or affiliate who was a defendant in the action filed. The parties have agreed that this order is final and that the matters in controversy have been resolved.
This action is final.
On December 12, 2012, Midland Funding, LLC settled a lawsuit filed by Lori Swanson, Minnesota's Attorney General, against the company last year for filing unreliable “robo-signed” affidavits in collections lawsuits and sometimes targeting the wrong people for payment of old bills that it purchased from credit card companies. The lawsuit alleged that Midland filed thousands of collections lawsuits against individuals in Minnesota courts, often supported by unreliable “robo-signed” affidavits generated at Midland’s St. Cloud, Minnesota offices. Several Midland employees admitted in sworn testimony to signing up to 400 affidavits per day, either without reading them, without personal knowledge of their contents, and/or without verifying the accuracy of the information contained in them.
The Consent Judgment requires Midland to: provide individuals with validation of the debt; verify the identity and address of an individual claimed to owe money at the outset, before any collection effort is made, investigate the matter and, if it cannot substantiate the debt, close the account; take steps to correct any adverse credit reporting, and not later resell the debt; not file affidavits w/ the court unless the person has: a) read and understood them, b) confirmed the authenticity of any documents filed w/ the affidavit, c) only based the affidavit on the signer’s personal knowledge, and d) signed the affidavit in the presence of a notary who acknowledges the affiant’s signature in accordance with law; implement standards to ensure it does not sue people on debt that is beyond the applicable statute of limitations; implement procedures to ensure it does not sue people on debt that it does not own; may not pursue a default judgment without giving the person written notice that their response does not constitute a legal answer and waiting 30 days so the person can seek legal counsel or otherwise respond to the lawsuit; include added specificity about the facts supporting its claims in its lawsuits so that individuals can meaningfully respond to the suits against them; at least 10 days before it pursues a default judgment against an individual, send a copy of the judgment request to the individual.
Under the Consent Judgment, Midland will also resolve outstanding and future consumer complaints made to the Attorney General’s Office and pay $500,000 to the State of Minnesota.
Colorado Administrator v. Midland Credit Management, Inc.

On February 2, 2015 the Administrator of the Colorado Fair Debt Collection Practices Act and Midland Credit Management, Inc., entered into a stipulation and Final Agency Order to resolve issues raised in the Administrator's investigation of the company for violations regarding a consumer complaint. The Order requires that Midland pay $23,000 to the Administrator.

BEFORE dealing with them read this carefully and understand: "MCM services accounts after the originating creditor has charged-off the account." That means the original company you owed has abandoned trying to collect, and MCM has assumed that role. But they were not necessarily hired to do so! They very likely have the means to access charged off debts information and decided to try to collect. Not unlike extortion... As always, admit nothing and disclose nothing to people over the phone unless you know for sure for sure who you're dealing with. Phishing (formerly known as "social engineering") is the playground of criminals. Therefore before you pay them one dime, make them PROVE IN WRITING 1) what you owe, 2) who it is owed to, and 3) show proof they are authorized to collect. Don't be intimidated by legal threats. They won't leave messages and when I do answer, the caller (sounds like they have Indian accents) asks for someone named "Shayla". That's not my name, never has been my name, isn't remotely close to my name (just in case someone tries to say it might be a mispronunciation), it's not my nickname, and I don't even know anyone named Shayla. I have impeccable credit and have no outstanding bills. I keep telling the callers they have the wrong number and to remove me from their system, but the calls keep coming.
