I went through this myself a few years back. Someone that I didn't know used my phone number for a loan or some such thing and I started getting calls when they defaulted. When I finally spoke to someone at the collection agency, I told them that I felt that they were harassing me and I was going to file federal charges unless they removed my number from their systems. They were all about helping me when I mentioned the fed. Try it, you may get some relief. :)

they called me today about a credit card my husband opened in 2002 with his ex-fiance.  He paid it off and has the receipt and they are saying we owe $2,100.00.  They are foreign and try to fake an american accent and names.  (which is stupid and insulting).  Said they spoke with his spouse (gave a name of person who was not me and not his ex) in 2012 and she said they had just had a baby and were broke.  I didn't have any kids in 2012.  Had one in 2014.  So not sure who the heck he spoke too.  When I told him that it was not me he got mad.  I think this is a company trying to scam people into paying bills they have already paid.  They wait a long time then contact you hoping you forgot.

I think when they say they aren't phony they mean that it is an actually company. Which that much is true, regardless of how shady.

If you don't owe any debt feel free to mess with these clowns. Put on your own fake Indian accent and enjoy a little banter while they get frustrated and mad! Then at the end of the call, demand they send you written proof of a valid debt and that any further communications on their part must be done via mail. They are no longer legally allowed to contact you regarding any matter via phone after that. If they do, keep a record of all call times and dates. The courts are being very friendly these days to abusive debt collectors.

If you do owe the debt and aren't going to pay, under no circumstances do you answer the phone and talk to these jack wagons. Simply acknowledging the debt restarts the clock and chances as are if they are the ones calling you then you are most likely past the statute of limitations (know them in your state) and if that is the case they can do nothing to you other than what they have already done.

If you do plan on paying, still don't talk to them and contact the original creditor first, almost every major CC company will recall the debt and erase all the BS fees and late charges that these shameless collection agencies tack on. Plus then they don't get to make any profit on you.

FCRA is the Fair Credit Reporting Act and has nothing to with calling hours for debt collectors.  FDCPA is the Fair Debt Collections Practices Act and governs 3rd Party debt collectors.  According to the FDCPA a collector can between the hours of 8am-9pm local time of the debtor.  Any day of the week, do your homework.

Can elaborate upon how merely talking to a creditor can create recent activity reported on a credit report?

    Jezebel
I was concerned by the DLA mentioned in Da Man's post. Especially that it can be created by just talking to a collection agency. It turns out he is partially right, it can just even be the date the CA receives the file. But, the DLA is not important to ones credit file. Certain dates from the original creditor hold greater import as stated in the post in this link:
