- Jen| 1 replyDoesn't the fair debt collection act say collectors may not call repeatedly, with the intent to intimidate or harass people? It seems pretty clear when you refuse to leave reasonable messages and state who is calling in a respectful manner, that you only intend to bully and harass. This should be criminal. They literally will call, occasionally leave a message, hang up on me every time I answer, and they do this before 7 am and after 9pm and call at least 5 times each day at least 5 days a week, including 6am on Sunday. It is Medical Revenue Service and I truly hope that the ftc will actually look at the clearly illegal and hostile actions used by them and put a stop to it.

- Resident47 replies to Kevin Treadeu(?) fanKevin Trudeau similarly counts on the ignorance of his customers. What you're describing is a Statute of Repose, which only Wisconsin has for certain. The vast majority of consumer debt remains legally collectable until the debtor dies or the claim is crushed by a court order, such as from bankruptcy or through a FDCPA suit, whichever comes first.
Each state has a Statute of Limitations on four kinds of debt, which sets a "shot clock" for litigation. Once past SoL and absent the above conditions, calls and dunning letters remain perfectly legal so long as they avoid terms like "court" and "lawsuit".
In keeping quiet when you answer and not the boyfriend, his collection pursuer is obeying privacy restrictions within FDCPA and likely your state law. - Resident47 replies to R4v3nYours is a very common mistaken assumption. Absent a court order to the contrary, under federal law a debt collector may pursue your account until one of you drops dead, and even your cremation won't stop one from hassling your surviving relatives.
The seven year FCRA time limit for reporting of accounts to the credit bureaus has NO bearing on the ability to collect for them. Each state has its own Statute of Limitations for different debt categories, the true legal ''shot clock''. That period ranges anywhere from three to fifteen years. Curiously, not one state has a seven year SoL on any form of debt, putting the lie to any confusion of SoL with bureau reporting.
If you are taking abuse and other bad behavior from this collector, don't bother with any "warning". Document everything with care, make a proper written dispute, and file a FDCPA suit when you're ready, within a year of the first violation.
http://www.ftc.gov/os/statutes/fdcpajump.shtm - Resident47 replies to JenThe FDCPA does restrict annoying call patterns, but those often make a weak case if they're all you have. Being shy around message recorders can be painted as a nod to privacy, mandated within the same law.
I can say the FCC is not happy when any autodialer abandons more than three percent of its calls, and I would agree those calls coming well outside the default hours give you much better ammo to fire back at your tormentor. Which is to say you should not wait for a rescuer but keep your own detailed records and hand this bunch a summons when ready. - jhDebt collector. They call our number looking for someone that does not live here, but they leave a message; "This is an important call for Roger Prater. If we have reached the wrong number for Roger Prather, please disconnect the call now. If you are Roger B, please continue to listen to this message. There will now be a 3 seconds pause. By continuing to listen to this message you acknowledge you are Roger Prater. You should not listen to this message so that other people can hear it as it contains personal and private information. There will now be a 3 second pause in this message to allow you to listen to this message in private. This is a call from medical revenue services. This communication is from a debt collector. This is an attempt to collect a debt. Any information obtained will be used for that purpose. Please contact us at one" ... more. Please listen to your voicemail for the remainder of this message.

- KatieRecieved a missed call. Called back out of curiosity. It was a medical bill collecting center. They were looking for a Beth. Told her that that's not me and she said she would remove my number from the call list. So I guess I'll see if they do. Anyways the lady on the other end was nice and apologized for the inconvenience
- Brooke Cavanaugh| 1 replyI do owe a small amount to a local hospital that they are trying to collect on. I've told them I'm paying all I can right now each month but I appreciate they have a job to do. The problem is now I am receiving multiple automated calls each day from this number and the calls are not even for me. They are releasing private information through automated voice calls to my phone. The message says something like..."This message is for _____ ______. If you are not _____ ______ please hang up." The person they are trying to reach is never me!

- Resident47 replies to Brooke CavanaughEvidently this agency is doing a poor job of managing its autodialer, possibly cueing your number but getting it mixed up with other accounts. This is something I've seen (if infrequently) from other collection agencies as a byproduct of trying to put the whole process on a virtual conveyor belt.
You have a right to a quieter phone whether or not the calls are meant for you. You can invoke the FDCPA to render some or all phone calls to any of your numbers as "inconvenient". Be certain to leave open a convenient channel, such as US Mail, since this outfit does have a claim someplace with your name on it. Given the hijinks reported in this thread, it would be a good idea to request validation if you haven't already burned up your statutory 30 days to do so. These demands must be made in writing and sent via USPS Certified with return card to make them stick.

http://www.ftc.gov/os/statutes/fdcpajump.shtm - belagracieMy elderly parents got a call from this number, asking them to please get a message to my husband. My husband has never listed their phone number as a contact, nor have I. My mom was asked by a woman named "Tracy" to call her back at this number.
He will not be calling them back. However, I WILL call them back to complain about their harassment of my elderly parents. - 866-631-4680I've already asked them to put me on their, ''DO NOT CALL LIST'' last week when they called. Today, I called them back from a different phone to find out exactly who they are. I was put on hold and then got connected to another extension and it rang so many times that it was dis-connected!! This company needs to be stopped!!!

- Nikused to get calls from them ALL THE TIME for about 6 months. it stopped for over a year. now suddenly today i got 2 calls from them within 3 hours (3 hours and 1 minute to be exact, the first at 140 pm, the second at 441 pm.)
im very lucky because my phone is water damaged and defective. when it goes to my voicemail it tells them the number is no longer in service. when i go to my contacts and call my voicemail it tells me the "number can not be completed as dialed"
so not only do i decide not to answer them ... i dont get voicemails from them either.
my advice: ignore ignore ignore. and if all else fails just play dumb.- Caller: VERY FRIGGIN ANNOYING!

- Mark| 1 replyI've been getting calls from this phone # at least once a week for last several MONTH'S. Every time, it's a computerized message saying the call is for somebody I've never heard of before these calls started.
So far, they've tried calling FIVE DIFFERENT PEOPLE at my phone #. I'm the ONLY one who has been at this phone # for the past 15 YEARS! Where are they finding their info that they keep calling MY # when trying to contact somebody who probably has NEVER, and definitely never in the past 15 years, been able to be contacted at my phone #???
The ONE time I answered call from this #, a person picked up, told me he needed to talk to a Mrs. Doris xxxxx concerning her credit card placed for collection. When I told him I've been the ONLY one with this phone # over past 15 years, he apologized and said he had no clue where they found my # as her phone #, and assured me they wouldn't call me again.
Since then, they continue calling, and seem to have at least 4 different people listed as having my phone #. I tell them to stop calling because the person they want has NEVER lived here, and each time they respond that they won't call back, only to call again the following week asking for or leaving a message for a different person.- Call type: Debt collector

- Celia| 1 replyThey have been calling my mother-in-law, leaving a message for me to call them. I do owe a medical bill but I have never used my mother-in-law's number as a contact. I have used my father-in-law's before but he never receives a call. I do not understand why they are calling my mother-in-law and not me, since my number would be on the records. It makes me hesitant to call them back, but I will just to get them off of my mother-in-law's butt about this.

- Resident47 replies to CeliaYour MIL is being pestered to create false shame, hoping you'll come out with a white flag and an open checkbook. Probably they are illegally pretending to skip trace, as though your own phone number was not already part of the account file. Looking at other comments from this year, this appears to be a house practice. It's fairly common across the debt industry.
You can stop the madness in your dispute letter, after which there should be no excuse to bother extended family. See prior discussion:

Maybe if they call you for all their loose end accounts in alphabetical order, eventually a match will be found. It's well past time you got off the phone and onto a paper trail.
To a ''not me'' case I always recommend putting the agency on notice, just as you would if you were the target and the debt claim was invalid. Send a ''cease-communication'' notice via USPS Certified with return card. This is the method promoted by the FTC and many consumer watchdogs, and the best way to set a legal landmine, as such a notice is ignored at their risk of a lawsuit from you. You may already be due some payback if you can prove you've endured abusive or misleading treatment in an effort to collect debt.
You can get the whole thing done in one one curt paragraph. Some variant of this will do: ''These are the affected phone numbers, I cannot help you with your problem, stop calling about this matter.'' In my ''shut-ups'' I also like to briefly review when I was called and what I was told by live reps and/or canned messages. In your case you might try a clause ordering the agency not to contact you about *any* account which clearly lacks your name. This is done in a calm ''inside voice'' without making threats or citing rules. I also print the relevant USPS tracking number someplace near the page footer. My little parts and accessories establish the background for an escalated dispute, particularly if I encountered resistance or frustration during past calls. - 803-705-4876Please do not call again

- vdw1912recieved a phone call from this company.they are called medical revenue services out of sebring florida lady was a night shift supervisor named angie 1-866-631-4680 extention 1051. after trying to get me to do a check by phone i refused and ask for more info concerning the bill. i asked her to send me an email with the companies address and info on bill. she refused. i then asked her to mail me a bill, she refused. real nasty attitude. i refused to set up payment arrangements because i cannot recall having any information about this company, and i certainly was not about to give her bank or debit card information without being certain of who she was. i asked to speak to a supervisor, she laughed and said she was the supervisor.
