- Grieving motherI was devastated when my daughter passed away, then I began getting calls. I know I am not responsible for any of her debt, she was an independent, grown woman living in her own home. I continue to get calls 1 year later. Thankfully I do not pick up on my land line so I haven't dealt with them personally. I have a list of names and extension numbers. George, Nicole, Christine, Crystal and Chris.....give it up...and yes I am still grieving. Your condolences for your loss line is insulting!!!

- Sister-in-lawMy brother-in-law died almost a year ago. Today my mother got a call from 866-654-5605 x2216 asking for the person in charge of his estate. My mother gave them no information. You'd think that Philips and Cohen could at least Google my brother-in-law's name and read the obituary to find the next of kin. His estate was settled in probate six months ago. They had ample time to file a claim on behalf of their client.

First, these people are fishing and buying information off public websites and trying find money that is not valid. First off there is no estate for mother. Always wanting to give their condolences. Consulted an attorney. Attorney confirmed if legit then will give name of client when calling and/or send a letter naming the client. These is a direct violation and conserved harassment. The Department of Justice has a website. Check it out. Whatever company this is, they need not stalk, harass, cheat, lie those who have lost their loved ones. Wonder what it would be like for those who are calling on behalf of this company if the tables were turned. The grieving process is hard enough without evil company's like these preying on grieving families. They will have to answer to the almighty.

This company is in the business of collecting debts from people who have died -- or any living relatives they can find. They work for some of the largest credit card companies. The instant they are notified that an account holder has died, the credit card company will pass the account to unscrupulous bottom feeders like Phillips & Cohen Associates.
With some narrow exceptions the estate is legally responsible for any debts that the deceased owed, but only to the extent of whatever assets the person had at the time they died. The proper role of a law firm in resolving a debt owed by an estate would be to inform the administrator of the estate about the debt and to determine if assets exist to resolve the debt. In writing, Phillips & Cohen maintains the pretense that they are reasonable people simply performing this difficult task.
BUT before you ever get a letter from the company you will already have received a high pressure call from one or their associates using all the same tactics as the worst unscrupulous debt collectors - the associate called me one business day after the credit card company knew my wife had died, this associate had a balance that was more than twice what the credit card company had told me, then she lied that the debt was past due (in fact the "due date" on the bill was still almost a month away and a check for the full balance was already in the mail within an hour after I had talked with the credit card company).
This sort of high pressure attack is intended to upset and confuse a bereaved widow or widower, trying to get them to pay off the "debt" immediately rather than waiting to find out if there even is any estate and if that estate actually has assets to pay all its debts.
This tactic is unscrupulous, at best, and is intended to bypass the probate process and let Phillips & Cohen rake in a tidy profit by preying on people who have just suffered a most difficult loss.
The company is well known for their harassing tactics as well as for being very careless about who they come after -- if they can't find a legitimate next-of-kin, they will look for any relative, or anyone with the same name as a relative, or anyone who might be a relative. These trash have an "A+" rating from the Delaware Better Business Bureau simply because they apologize promptly whenever someone files a complaint with the BBB.- Caller: Phillips & Cohen

- Teri AdamsThese bottom feeders phoned me this morning about my dad's "estate". Dad died a year and half ago form Alzheimer's. He was in no shape to make any new debts in the three years before he died. After he was hospitalized his wallet was given to Mom. Mom paid the bills for years starting after Dad got back form Vietnam. After that Dad never had much to do with the bills, getting new credit cards, etc so I knew this phone call from a sweet sounding, sympathetic Ms. Mickey was a scam. I took her info (phone 688-654-5605 ext 2200) , googled the company she said she represented, Phillips and Cohen, and came across this blog, thank goodness. I phoned Ms. Mackey back and asked her several questions which she would not answer until I "verified" my dad's DOB etc. I told her to give me the info and I would verify the info, but she said she couldn't do that. I told her I phoned the courthouse and that Dad's estate had been probated out. She told me that Dad had an open credit card that had been paid on in August and I told her that was simply impossible. I told her that was "WEIRD" (real loud) and that no such card existed and no such payment had been made. That is when she said that was why she wanted me to verify Dad's info so they could make sure she had the correct person. She again asked me to verify and I refused and told her to not call my house again.

- Teri AdamsPhillip and Cohen phoned my house phone today to offere condolences for the passing of my father, who died over a year and half ago. The lady who phoned, Ms. Elza Mackey, informed me that dad had a credit card with an outstanding balance. I took her name, phone number 866-654-5605, ext 2200. I then called her back after I researched the company she said she represented. She asked me to verify my Dad's DOB. I refused. I told her that Dad's estate had been probated out in the courthouse over six months ago, that there were no credit cards the family was unaware of (Dad had Alzheimer's, and in the four years preceding his death could not have applied for a card without the family knowing- he was incapable of writing or typing). Ms. Mackey then asked me to verify my Dad's DOB again and other info so she could be sure she had the correct person. I told her I would not do that, but if she could tell me what she had on file then I would verify that. She told me she could not do that. She said the credit card in question had a payment made in August and I told her that was impossible and very "weird". She again asked me to verify dad's personal information. I refused and told her to never contact me again. She then informed that they would have to pursue other avenues to collect the debt and I told her , "Go right ahead, but do not ever contact me again." I am concerned because my mother had her home phone disconnected six months ago. If she had not done this Phillips and Cohen could have contacted her and my elderly mother might have fallen for the scam. I shudder to think how many of our grieving elderly are being taken advantage of by the unscrupulousness of Phillips and Cohen.

- BigA replies to BonnieYou need to send them a certified, return receipt debt validation, cease and desist calling, or "not me" letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I simply stated my case in a written cease and desist letter sent certified mail, and within five business days of recievibg my demand letter they stopped calling me. Your "legit" PCA specializes in probate collection of junk debt and has a long record of misleading and abusive conduct. Like their vulture debt peers, they wheedle and/or coerce payments from unobligated survivors, who need not "prove [their] innocence" like guilty criminals. Unsurprisingly, PCA gets sued for FDCPA violations a few times a month. Its rather secretive debt purchaser, PCA Acquisitions LLC d/b/a Portfolio Asset Group, routinely hires other lawbreakers to collect moldy card accounts. I sued and collected from one of them for making dozens of illegal contacts and sending deceptive dunning letters.
Your CMRR cease-comm response was what I'd have advised, and you can choose to be happy with waiting a week for compliance. Since updating an autodialer is not that complex a job, I would not have shown the same patience for calls continuing past a day. Indeed, it is not unusual for sly agencies to suddenly pile on the phone calls the same afternoon they receive a letter which somehow bans future calls.
