    Any one ever thought about just answering the phone, getting their checkbook, and paying thier bills like responsible adults?

    If you're going to dispute the debt, stay on the phone. We can't help you in any way if you won't be sensible. If you already paid it, send your documents. If you don't have documents, you need to get them or dispute it.
    If you say it's fraud, be prepared to file a police report. You cannot claim fraud without one. That's legally condoning the actions of another against you and considered taking personal responsibility of the debt.
    If you think you aren't charged interest once the account defaults, it's pretty likely that you're about stupid. You signed a contract and it's only you to blame if you didn't read it and ask someone to explain it. If you want to dispute it and they were payments posted to the account, you're stupid. If you want a settlement on your account and think that $50 a month for the next 4 years is acceptable, you're stupid.
    We will never take you for your word that something was already paid without documents. We aren't stupid. The general public lies and shoots us sob stories every single day.
    Personal Business Matter. Anyone here like privacy? Do you want your neighbors, family, friends, and coworkers to know you don't pay your bills? I think it must be humiliating. It's called 3rd party disclosure and it's against the law. We can't and won't ever say anything to anyone but your spouse or attourney.
    7 years and we can't report on your cbr as a tradeline but we pull your credit as often as twice a year. Showing as an inquiry with the collections industry code (the letter Y) and dropping your credit score as much as 5 points every single time. Same as anyone else who inquires.
    7 years and we can't sue you. We can call you for the rest of your natural life and when you die, we can call your attourney and your spouse and your children to try to get a power of attourney document in attempt to get your family or attourney to pay your account with what is left of your estate.
    It's already on your credit so you don't care? Did you know that the cbr shows the original balance and the current balance? Any time you apply for credit that company will inquire on your credit and see this. If the balance is going up, you're not paying it.
    We know when you try to buy a car, finance a home, get a cell phone. We know when you pay on other collection accounts. We know when you apply for jobs that require a security clearance. Meaning they check your credit to see if you are a deadbeat.
    We know when you pay your Abercrombie, Banana Republic, Gap, Express and Lane Bryant accounts. It's all on your cbr. Yes we even know if our lady debtors are overweight.
    Your car note. Your bank account. Your employer assuming you have not yet lost your job. Your maiden name, your multiple subsequent spouses and failed marraiges. Your public records. Yes, every time you have been sued and every bankruptcy you filed. The name of the attourney and whether or not you paid.
    We know all of these things.
    Above all, we know the laws. We were trained and tested. Stop trying to be a smarty pants. If your reason for not paying us is legit in any way, we can help you.

    Let's sum it all up.
    Don't lie to us about your finances.
    Tell the people in your life that they shouldn't be so nosey.
    Try not to make a fool of yourself.

    To "The Collector", you're an idiot going on and on about people should answer their phones, get out their checkbooks, pay their bills etc...  Don't bother people who have nothing to do with the debtor! It is not my problem if you think that the person who had made a debt against you has some sort of relation to me.  You seem to believe that you have it all pieced together afetr all you said, "We know when you pay your Abercrombie, Banana Republic, Gap, Express and Lane Bryant accounts. To blog some stupid s$%# like your 2/25 message to prove somehow that you are the know all end all of collection agencies.  Get a grip.  Really do your howework and quit bothering people who have NO realtion to the consumer your dumb a$$es decided to extend credit to in the 1st place.

    Received call yesterday and today, two different people, no company name or reason for calling given.

    Look, I've read the boards, and as much as I hate to admit it, "The Collector" has a point. If it realy is fraud, file a police report. You can also ask them to mail you a copy of the collection summary. It should entail who is collecting and on who's behalf. What ever you do, DO NOT give them your address. If they have your phone number, they have your address. If they dont have your address, tell them to bugger off!

    I have done this and it works. It was not this company, but another that was trying to collect from me. I told them to mail any documents to my residence and I will look through them. To my surprise, they did, and it was a bogus medical bill from a hospital I never recieved treatment from.
    I sent them a letter telling them I have never been treated by that hospital for any medical issues and that if they can provide me with proof that I received treatment there, I wanted a copy of the medical bill. I recieved a reply letter saying they had sent the collection letter to the wrong person. Oddly enough, they had my first, middle and last name, with correct address and phone number.

    Wrong person my ass!! They are scams, as Im sure you're all aware of. Ask for proof of collection, a copy of the original bill, etc. If they can not provide it, F-em.

    WHAT EVER YOU DO THOUGH, DO NOT GIVE THEM ANY PERSONAL INFORMATION. ALL THE CONTACT INFO THEY NEED SHOULD BE CONTAINED WITHIN THE ORIGINAL BILL THEY SHOULD ALREADY HAVE.

    PRA (among other things) is also reported to be sending out bogus 1099-C's on old debts which are beyond the Statue Of Limitations and NEVER validated:

    According to the WV General's Office,  "In the case of a debt that has been disputed and cannot be proven a 1099c is not a valid option for a CA to file. By filing the 1099c they are saying that yes this is that persons debt and we can prove it is. However if they cannot validate they cannot file the 1099c". ...they suggested the recipient of the 1099-C file a complaint with our State's AG office or file a civil suit or both.

    My mail box has been flooded with consumer complaints from all across America stating they have received IRS Form 1099-Cs from Portfolio Recovery Associates (PRA) on debts they purchased.  Many claim these debts date back into the mid 1990s and are no longer on their credit reports; most are past State statutes for taking legal actions and the majority appear to be far beyond the seven year statute for credit bureau reporting.

    Portfolio Recovery Associates, of Norfolk, VA is a purchaser/seller/collector/ of junk debts purchased in portfolios for pennies on the dollar. Upon purchase, these debts are inflated to where they attempt to collect on them from consumers at very high profit margins.

    Think about it. PRA cannot legally collect the alleged debt, because the debt is barred by the statute of limitations. Their philosophy seems to be that if the consumer won’t pay PRA, then the consumer should pay someone-and that someone is the IRS-so PRA can reap the benefit of a tax deduction? The question seems to be whether *Creative accounting allows that PRA can deduct the amount of the debt as shown on the 1099-C, and not the pennies on the dollar that they actually paid for the worthless debt.

    There is so much wrong with this post, it would take pages to refute item by item.  Suffice it to say that the 7 years an item remains on your credit report has nothing to do with the time-limit for suing you.  That is set by the individual states and in most places is between 3 and 6 years.  After that, collectors can't touch you.  AND THEY CAN'T HARRASS YOU EITHER - as a previous poster has noted: "Statue of limitations to collect on a debt works in conjunction with the Federal "Fair Debt Collection Practices Act" Under 16 USC 1601, et seq... which means that pursuant to state and federal regulation, debt collectors CANNOT continue to attempt to collect on any debt past the statute of limitations --- NOT JUST THAT THEY CAN'T GET A JUDGMENT anymore. If you get a call from a collection agency on what's called a "Time Barred Debt" you can report them to the Federal Trade Commission, the Attorney General and the District Attorney. There are reasons why the government has imposed limitations to debt collection. Portfolio Recovery Associates is a scavenger debt collector and not above the law.  Turn them in."

    Most of the rest of this post is empty threats and lies by a collector, so don't be intimidated and don't believe any of it.  They don't have access to anywhere near the information he claims they do and the debtor actually has more rights under the law than the collectors - most debtors are simply not aware of it.  

    Finally, the debtor has to prove NOTHING. It's up to the collector to prove, via documentation, that the debt is legitimate and collectable - if they can't back up their claims in writing - and since they're collecting on time-barred debts or going after the wrong person 99% of the time, they never can - the alleged debtor can tell them to get lost and not waste a single moment worrying about them or their bogus claims.  Believe me, it feels good.

    Don't you think if PRA was sending out anything bogus or doing anything illegal we would be stopped by the FDCPA or the government? Cmon let's get real.. All the fuss you guys have made over this is silly!!!! If you owe the bill pay it.. If it's out of stat you can get a settlement.... Or you can choose not to pay but guess what we are still going to call ... If you really know the law and you really don't want to pay your debt I'm sure you can find a way around it.... But if you make it... pay it... and go on about your life... you call yourself warning people but really you are just making a fool of yourself bc we are still going to collect...     Received message on my answering machine this afternoon.  Caller ID number 1-800-772-1413 (Portfolio Recovery), but, of course the number left by the caller on the machine was different: 1-866-909-0529 ext. 57059.  Funny enough, I set up a repayment plan earlier this month for the debt.  Therefore, my question is, what the heck are they still calling me for?  They've already taken this month's payment out of my account.  We have an arrangement - so STOP calling me!

    You know, if all of these comments from the "collector" were ligit then the language would be toned down to a professional level and words would be spoken as if they were talking to a judge.  But instead there is cusing in everyother word and obvious that all of this is bogus.

    Who cares if they are cusing.  People in america are not polite, but as a professional you should uphold the most respect for others, even if they are not poliet to you.  I recieve called about three times a day for someone that had the number before me and my number still has not been taken off your calling list.  Maybe myself and all the other people in america would be a little nicer if more respect was given to people and maybe if you held yourself more professional, you wouldnt be assumed as a scam.

    You would think the collectors would get a life and realize that everyone hates them and everyone is going to be rude to them because they are the lowest of the low.  We claim we have no job in order to get you off the phone and we ignore your calls because they only reason you have our name is because you bought it from some other company that wont take the time to collect on the debt themselves.  Unless you arnt ligit then you are just low life scum that shouldn't even have a job.  I guess ignorance is bliss, at least for some people.
