It's funny how collection agencies do what they call "Tracing" in order to find a person (debtor).  This company Portfolio Recovery has called my number looking for my uncle who lives 200 miles away from me and we don't even have the same last name.  No were close....how and why would they call me and don't even know if we are related????  This to me is ignorant and downright WRONG.  They don't have anything better to do then to disturb someone else with another person's debt.  My uncle didn't give them my number nor did he give them permission to call me.  How can they do this??? Is there a law that forbids them to trace friends and family members????  I need them to stop calling my number looking for someone else who doesn't live at my address and I didn't give them permission to call my number.

Actually, the tracing lists relatives and associates. Any # you have ever called from to check balance on a card or anything like that could show up in the tracing efforts. Yes they can call your relatives and if your relative takes a message and doesn't tell them to take their number out, then they can call back and list the # as a good #. On the other hand if you have identified yourself as the debtor and you say don't call me anymore, that does nothing for you. You legally owe the debt and they can legally call you. If the debt is out of Statue of Limitations they can call you to collect the funds but they can't take you to court. They can even hit your Credit by doing a check of your assets on your credit report. When a creditor calls a relitive or associate they can give the name of the company in which they are calling from but can't give any info on the debt you owe only that it is personal business. When a collector calls your employer they can only tell that it is a personal business. New York City has different laws though. If an account is out of statue then the collector isn't allowed to leave a message period. If you are talking to the debtor that is out of statue you have to let them know that they are still legally liable to pay the debt but no legal action can be taken against them during the begining of the call. When you call a New York City account and it's in statue you have to leave the name of your agency the original agency and the current balance owed. I do have a medical degree and I would love to be working in that field but at the same time. Each day there is always that one person that you get to help work out arrangements so they can better their credit. There is always that one person who gets on the phone maybe just because they are bored and want to talk to someone and you get to let them get crap off their chest whether they pay or not. And although I may get cussed out 100 times in a day, I know that whatever you say to me isn't my problem. It's you feeling the guilt of not taking care of your debts that is causing you to be so hostile. Maybe it's because you wish you had my job. IDK what it really is but you don't know me and whatever you say, I'm not gonna take it personal. I love helping the people who really want help. If you get a call and you believe it isn't you. Verify the last 4 of your SS. If you aren't the person on the account they have to take your # out. If you are the person on the account and you dispute the account, they have to give you the opportunity to dispute. You only get 1 time though. Next time you get a call, just try to talk to them. If you are having a problem talking to them, ask to be sent to a different rep. If you have to call back in and complain to get a nicer rep then do it. But make sure when you do you are complaining for a good reason. Don't be complaining just because they called you.

Tired of the bs replies to Cpup
Legitimate collection companies do not use false names.  I received a call from a Paul.  I called the number back that I was given and the man that answered identified himself as Michael.  I told him I was looking for Paul and without putting me on hold said that he was Paul...

Legitimate collection companies do not try to collect on debts already paid through others.

I'm guessing... legitimate agencies don't troll forums for arguments, so what are you doing?  Do you really think your chat lingo is going to sway anyone here into believe you or your agency is professional?

    Legal replies to Actually
You actually do have the right to request calls to stop whether you are the debtor or not.  Once you've submitted a request in writing the agency can be fined for contacting you afterwards.  I'm a lawyer. I've also had a collection agency repeatedly calling my number even though the debt was paid through another company years ago.  I submitted a complaint to the fcc and the company was fined.  You should probably brush up on the actual laws as opposed to spouting pro collection agency bs.  I'm sure that most collectors are honest, hard working people.  However, most of the companies the collects work for are less than reputable.

http://www.fcc.gov/  know your rights... and don't let anyone bully you into something that you're not comfortable with.

Hey, they aren't a scam I can tell you that much however they have a rule that says if they call a place of employment they cannot ID themselves until the person they are looking for is on the phone. There is one golden rule they have to follow if you clearly tell them do not call the POE again they have to stop calling per FDCPA or you can sue them lots of luck

EX- COLLECTOR FOR THIS COMPANY replies to Not the guy they are looking for
They do this a lot just tell them wrong number and give and they are supposed to remove the number per the FDCPA. If they do not stop calling you report them to the BBB and then you could probably file a law suit for harassment, they get their numbers from a whole group of people they hire to skip trace numbers and relatives etc... Good luck

    EX- COLLECTOR replies to formeoly
There is a law called the Fair Debt Collections Practice Act that protects the consumer or debtor aka "FDCPA". They can unfortunately look up friends and family members but they are not allowed to "harass" you once you have told them wrong number and do not call again, they are only allowed to call once per day unless given permission to call back by whomever may answer the phone!!! I hope this helps you

These people keep calling onto my line at work.  It's not the general number for my work, the last 3 digits dial up my extension direct, and they ask for some guy whom I have never heard of.  I even went so far as to connect them to HR to see if he was previously employed, which he was not.  I got another call from them 2 days later, asking for the same person.  I told them that they were calling MY line, I'm obviously not this guy (I'm female), and 2 people here have confirmed that he does not and never has worked here, but they proceed to call at least 3 times a week, sometimes 2 times a day.  It is a waste of my time, and I can't even avoid the calls because they leave me voicemails, even after it says MY name in MY voice for the message.  How can I get them to stop?!?!

They should have taken the number out when they were told. Unless they believe they have been given erronious information. If you are still having a problem with this. Send a letter in to the home office. There should be an addy on the website www.portfoliorecovery.com On this letter explain the problem....add your telephone number on the letter because the easiest way for them to locate what acct you are speaking of is with the SS or telephone number. Just to cover your basis give the person they are calling for first and last name as well as the Extention you have been asked to call back and the telephone number. I hope this helps you.

And yes as was said before if you are the debtor you can put it in writing that you do not want to receive phone calls but they can still send you mail. If you think they are looking for another person just tell them you think there has been a mistake. Verify the addy, ss, dob whatever...Lots of times the person being looked for had the phone number before you. Or I actually have a collector call me looking for this one lady because she actively gives my phone number as her own. I just don't understand why people get so hateful. I have several places call me for this other person and they are always so greatful for me giving them the info I know and they take my number off of her accounts. And this those accounts have nothing to do with this company....just making a point.
