We have a reporter for a national news outlet desiring to do the 1099C story.

Specifically, they would like to talk to consumers who have been contacted by a debt collector who has  inappropriately used these 1099-C forms?  Your willingness to talk "on the record" will go a long way to help expose the errors of these bogus claims.

We believe Portfolio Recovery Associates in Virginia to be one of the biggest abusers of the 1099C, we suspect they will play a large part in the story.  If PRA has issued you a 1099C on an old (or even current debt) we'd like to pass your contact information to the reporter.

Email us at admin@collectorsexposed.com and place 1099 C Report in the subject line. Let us know if you would be willing to go on record with your story.  If not, we want to hear your story anyway.

They are also asking for anyone who has sued to push back on a collector for using
    this 1099-C inappropriately?

Portfolio Recovery Associates likely bought records or a database thru Intellus or another company, and then got your cell phone #.

If you don't own them anything and they have an old # tyr using the Block # feature or auto reject as to cell phones.

You may want to report the abuse to the Illinois Attorney Generals Office, Federal Trade Commission, and a consumer watch dog site. Bear in mind this is additional aggreviation, but may be worth the effort.

Can't say it's fraud to begin with. People lie also. But the individual should call the company and present proof to shot these people up.

Problem is the stupid people making laws and not logically thinking of problems.

Companies have too many rights also and I'm sick of it.

they say they are looking for fallin lang or something and they say i owe him money. i think hes a debt collector but im 11 years old so i dont have a credit card or anything lol so just dont answer the number ever. and the reason why the company has you number is becuz the company just tried random numbers and if your number works, they will use it. but if they call, dont press reject or end, just let it ring until it stops.

They call even on Sunday when they are not allowed to. They are trying to collect a debt that is over 6 yrs old without any payments being made. In the state of Florida after 5 yrs with no payment ever made the debt is forgiven and not collectable, they cannot take it to court and get a judgment, but they can keep trying to collect it. Every state has a # of yrs that a debt is forgiven California is 4 yrs.. This is in Susie Ormond's book and confirmed by my attorney. Tip: never promise to send a payment or give them a check # and say you will send a payment because the debt yrs could start over even if you don't send it. They are not allowed to continue to harass you. Glad they are being sued. I long ago paid for anything I bought as they were charging me 650.00 a month interest which I pd for several yrs and now have doubled with interest what was actually owed, can you imagine that?? Done with them....

Portfolio Recovery Associates are scumbags. I'm still getting phone calls and mailings from those [***] about an old debt, in spite of the fact that the statute of limitations on that debt ran out FOUR YEARS AGO and was expunged from my credit report THREE YEARS AGO. They're not getting ONE RED CENT from me! F--- 'em! They have no legal right to collect an expired debt and they damn well know it.

As a follow-up to my earlier comment, further research found that Portfolio Recovery Associates is a collection agent for CROSS COUNTRY BANK -- a Delaware-based company that was SUED by the attorneys general of 13 states for fradulent practices foisted on the bank's credit card customers.

CCB was ordered by courts in New York and Pennsylvania to pay millions of dollars in restitution to customers it defrauded and settled with other states, paying out millions more.

It is a Cross Country Bank credit card debt that PRA is still trying to get me to pay. NO WAY am I going to pay a CENT to a crooked bank that repeatedly violates the law. F--- Cross Country Bank and F--- Portfolio Recovery Associates!!!

Portfolio Recovery are the ultimate scumbags. Their client is Cross-Country Bank -- which was SUED by the attorneys general of 13 states for unlawful harassment and intimidation of the bank's credit-card customers. They keep calling long after the statute of limitations to collect any Cross-Country Bank credit card debts have expired. Portfolio Recovery cannot legally collect once the statute of limitations has run out.

Given the fact that Cross-Country Bank has been sued repeatedly for unlawful practices -- it was forced to pay $13 million in restitution to its credit card customers in New York state -- not only should you refuse to answer any call from Portfolio Recovery, but you also should send a cease-and-desist letter to them, telling them in no uncertain terms that the statute of limitations has expired, that the company no longer has any right to collect and that it they persist, you will file a formal complaint against the company with your state attorney general's office for unlawful harassment.

To make clear to Portfolio Recovery that you really mean business, make sure to tell them that a copy of your cease-and-desist letter was sent to your state attorney general's office. If that doesn't shut them up, then go ahead and file a complaint.

Calling you before 8:00 a.m. or after 9:00 p.m. is ILLEGAL under the federal Fair Debt Collection Practices Act. By breaking the law, Portfolio Recovery has forfeited any legal right to collect.

Call the Federal Trade Commission at 1-202-326-2222 or on the web go to www.ftc.gov then they will stop. Be sure to have the tel # they called you from and the name of the person that called you, document every word they said to you. The Federal Trade Commission does not tolerate this abuse, even if you owe portfolio money.

***A company must be licensed in their state as well as the one they are trying to collect in if two different states are involved.

    Some Tips:
    *Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time, date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

I find it interesting that you waded through 8 pages of posts to reply to one from 2009, and then missed the one post that had lots of information in it.  Since all phone numbers are recycled, you received the number of someone who got rid of it because they were getting constant calls from these crooks.  Now, there is a way to stop the calls, but you will have to actually do something.

You need to send them a certified, return receipt "not me" letter (think of it as the best $6.47 you ever invested).  Also send it first class mail in case no one will sign for it.  Make a notation of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):  http://www.consumeradvocates.org/
    http://www.consumeradvocates.org/find-an-atto ... tates_value=All
Read up on your rights here and also make a complaint at this government site:  http://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.
