    THE LAW NEEDS TO BAN THE SALE OF DEBT COMPLETELY

    Remember that it was the sale of Mortgage Backed Assets (DEBT) that created the economic crisis we have now.

    BANNING THE SALE OF ALL DEBT - will put these FDCPA violators out of business!  

    We also need to CLOSE DOWN ALL FDCPA VIOLATORS, fine the business and JAIL THE OWNERS.  In most cases the business is fined - which is nothing more than a slap on the wrist.  They are allowed to continue business as usualy or re-open under new business names and continue to violate the law.

    THEY ARE JUNK DEBT BUYERS and are probably contacting you in regards to debts that were discharged in YOUR Bankruptcy.  

    yes they do that even though IT IS NOT LEGAL TO DO SO.

    DO NOT IGNORE THEM AS THEY FILE BOGUS 1099-C income forms with the IRS.
    THAT IS NOT LEGAL EITHER!  They pay pennies for that old LEGALLY UNCOLLECTABLE DEBT, and then claim YOU MUST PAY THEM THE FULL AMOUNT.

    They call my house but never say what the debt is for, Is there a why to find out what they are calling for and the debt? I have never gottin anything in the mail from these people, How is that? Has anyone ever been sued from these people? Is there an address I can write them to find out what is debt is they are calling for?
    Any help would be appreciated thanks

    They call and leave messages to call back and say it's about a debt, All I want to know is  what the debt is about/for. I have never received anything in the mail from them.

    Does anyone know there address or email address?
    Just would like to know what it is this debt they are talking about, Should I email or write them and ask?

    I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.

    This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

    (b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) Provide a verification or copy of any judgment (if applicable);
    (4) Proof that you are licensed to collect debts in (insert name of your state).

    Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

    Because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
    you cannot add interest or fees except those allowed by the original contract or state law.

    You do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA.

    Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.

    Thank you Alfalfa, So I should just make a copy of that letter and send it, And they will tell me what the debt is if there is any?

    Like I said I never recicevd anything from these people just calls.

    Several months ago, I started receiving voice mails for a Brian from these folks.  I called them back and asked if they understood English.  They replied that they did.  So, I asked why they would leave a voice mail for somebody named Brian when I am clearly identified in my voice mail greeting.  I asked that they stop calling me because I am not Brian and I do not know a Brian.  

    Have received several calls from this number again, most recently today Thursday, 6 July 2009 at 0943.  Individual, sounded like a black female, asking for Brian.  I informed her that was not my name and to stop calling my number.

    Yep, they've been calling me about 3 times a day for the last week. Of course they never leave a message. They're just sh*t out of luck with me because I NEVER answer a call unless I know who's calling and its someone I want to talk to. I wish the cell companies would get on the band wagon and make it so we can block unwanted calls.

    These people have gone way beyond trying to collect a debt- because I told them I didn't agree with their findings they now call me twice daily between the hours of 8:00 am and 9:30 pm with no one there. They went too far when they spoke to a member in the family trying to verify all my information (social security number, etc.)for this bill without speaking to me first- are they allowed to do that?

    They keep calling my house for an old friend of mine. Told them I haven't heard from him in 3 years and to remove my number form their list on several occasions but they still call several times every day!! What makes it even worse is that they are illegally trying to collect an old debt that is past the statue of limitations. If you pay even 1 penny to them you will reactivate that debt. Be careful.
