    when they call they want to speak to a tabula which does not live here and never has.   it is a message, a recorded message, saying if this is tabula hold on, if not press 3 or to hold and go get this person press 2, I have no way of telling actually who I am or tell them to quit calling me,  They call every day sometimes twice a day and when I press 3, it always sorry I bother you. but they keep calling.

    Thanks for this message.  I didn't read all the posts but these morons called me and said they had important information for someone who was not me.  Part of their message was if you are not answering the call you are acknowledging that you are __________.  And if you press 2 you will be off our lists which was not true.  Then they called looking for my Mom who sadly passed away last year.  It's people like you that help to bring these roaches to light.

    Such intelligent employee, with your text writing. while I will give you credit that you have a frustrating job I will also give you  a few clues.
    1. Not giving a full debt notice is illegal.
    2. Calling cell phoones inseveral states is illegal.
    3. Also in at least the state of Maryland if anybody gives you verbal notice to stop calling because you are taking it as harassment, they can go to the police and file a report of harassment on you personally and your company opening up an opportunity to sue you and the copmapny for harassment.
    So despite what your company says, watch and educate yourself.

    This is a scam - they said we owed money to an auto insurance co that we used to do business with.  It was only $31 and I almost fell for it and gave them my credit card.  Instead I called my insurance dealer and he told me it's a scam!!

    I constantly get a message from this number saying "This is a message for, if you are press 1, if you are not press 2." I called them back to find out who the hell they were looking for & ends up they are looking for someone else who has the same name as I do with another inital.  I asked them for the name on the account and they gave me her name & her husband's name.  I asked what the debt was for, they said $50 for Traveler's Insurance.  I told them I never even had that Insurance.  The lady told me she would take my number off their list.  They didn't call for like 3 days & are back to calling EVERY SINGLE DAY.  It's driving me nuts. How do you get them to stop??

    I previously posted this information on yahoo to share with you what I have learned from fighting bill collectors in court.

    If a junk debt buyer calls you, tell them you will not discuss any finances on the phone. Do not admit owing anything and do not make arrangements to pay them. You have no proof that they own the debt or are licensed to collect debt in your state. Tell them to send any correspondence thru the mail. Within 30 days of receiving their letter, send them a letter by certified mail to validate the "alleged debt" and to stop all phone calls. Under FDCPA, the JDB can not attempt to collect the debt until they send you a validation letter. They violate the FDCPA if they telephone you after they have received a letter telling them NO PHONE CALLS.

    If you are sued, answer the complaint. I can not tell you what to say. Credit cards are about 50 years old. If you google "Ultra Vires and Bank Fraud", you will find 4-5 pages of court cases where banks have been told they can lend money, but not credit. Modern day judges may ignore these cases, but I want to let you know they are on the books. When you received a credit card offer, did the bank tell you about previous court cases stating banks can not lend credit ? Did they tell you how your account was funded ? Banks do not lend you their money according to the Federal Reserve publication, "Modern Money Mechanics". Did the bank explain how fractional reserve banking allows them to enrich themselves with 9 other accounts like your account as assets on their books ? Did anyone tell you that your signature is the same as cash to the bank ? You funded your account with your signature .A contract is null and void if one party fails to make full disclosure of all the details.

    Serve the plaintiff with discovery - request for admissions, interrogatories, and a request for the production of documents. Request all the following:
    1) Copy of your credit card application with your signature
    2) Copy of the original credit card agreement
    3) Copy of all charges starting at zero to final balance with explanation of how debt was calculated.
    4) Copy of the bank charter. Did the charter state the bank can lend credit ? To go beyond the scope of the charter is "ultra vires" - A contract is unlawful at its signing. Void!
    5) Proof the JDB purchased debt. Ask how much JDB actually paid to obtain debt. Usually 4 % - not 100 %. Ask for copy of the contract between original creditor and JDB.
    6) Proof that JDB is licensed to collect debt is your state.
    7) If you believe you owe the debt, there is no contract between you and the JDB unless you have agreed to pay them. Demand a copy of the contract between you and the JDB. Get them to admit you do not owe them the "alleged debt".
    8) Any notarized statements saying you owe XXX dollars is hearsay. You can challenge whether the robosigner really has any personal knowledge of your account with original creditor.

    JDB sue folks because 98% of debtors do not answer the lawsuit. They expect to get a default judgment handed to them a silver platter. If they get a judgment, they can ask the court to garnish wages.
    Make them work to get the judgment. The plaintiff has 28 days to answer discovery. If they fail to meet the deadline, anything not denied or responded to is admitted into evidence as true. Most JDB can not answer your discovery within the deadline because the original creditor has the records. Believe it or not, often the original creditor can not answer discovery within 28 days.
    I have been sued 6 times in the last 18 months. Each time the plaintiff asked the court to dismiss the case against me without prejudice. In my state, the SOL is 6 years for credit cards.
    I am now 62 years old and retired. If someone did get a judgment against me for credit card debts, my pension and social security is exempt from bill collectors by federal law.

    As the old joke goes, you're not paranoid when they really ARE out to get you!

    I receive a call from 888-545-4170 almost every night of the week between 6 pm and 6:30pm... sometimes later but seldom earlier.  I have this information saved on my cell phone.  The two times I answered the phone when this number called my cell phone, I listened to a recording telling me I was to wait for someone to come and speak to me.  I hung up both times.  I no longer answer the calls.

    starting in april or may, i've been getting weird calls from this oddo place , R.m.s. colection agency. what is that? i call back and they say '' hello thank u 4 calling Rms can i have ur claim # plz? '' SERIOUSLY?!?!?!?!???!!! then i say something like i cant give u my # and then theyre like ok then weill keep calling u. i ask WHAT THE HECK is rms and they say '' a colection agency we are trying to collect a debt. '' OMG gosh.
        someone tel me what is r.m.s and why do they call me. and... they leave a message on voivemail like this: This is particia from rms. this is a message for ( no name inserted ) . by continuing to listen to this message, u agnolege that u r. if u rnot, then plz disconnect this call now, as this message contain personal AND PRIVATE information there will now b a 3 second pause in this message to allow u 2 listen to this message in private. ( blablah pause ) hi this is particia from r/ms plz call me back at (888) 545-4170. to discuss this important bisness matter '' YEAH yea then it goes on for a million years. i've explained to these ppl that i am an eleven year old girl and i dont need these  grizzly calls. then they tell me im 2 young to deal with this and ask for my mom. then they ask for my cell phone #. and im like, ' i will not give u random ppl my cell #! r u DUMB? '' then the ladys all like '' i dont liek ur attitude. u r a kid, u should have better manner while speking to adults. '' yea ya ya whatever. these ppl dont no how I feel about these calls. its interrupting my whole summer. these ppl think they can call random ppl asking for a debt. what is a debt, even? in the message, they say something about Mr. Or mrs. that made me crack up, since this is a kid here. who do these ppl think they r??????? im so mad. i wish i were old enough to suu them. then i'd be rich. then i could buy a helicopter, fly to rms heddcorters, then yell at 'em till i lose my voice. then if they call, i cant talk to them!
    once they  called asking for caroline or ned. whos that, i dont even no a caroline or a ned. SERIOUSLY  PPL. GET A LIFE! U CANT EVEN UNDERSTAND THESE PPL! I WISH RMS COULD CRY THEMSELVES A RIVER, BUILD A BRIDGE AND GET OVER IT! nuff said.

    I also have been receiving messages on my answering machine from RMS, to call Patricia at 855-222-5483, very annoying! I reported it to the attorney General. I am on the 'do not call' list but I have recieved more calls after I signed up, then I got before I signed up! What's up with that? Someone in their office selling our numbers? Geezum...so relentless
