    What we need to realize here is the plain obvious and i will refrain from biased opinion and stick with fact:Said consumer signed an agreement to "borrow" money" and either one of several things happened: The funds were used with no intention of repaying,thus committing criminal fraud which in this country constitutes a tort,the debt was not repaid due to unforeseen circumstances or carelessly forgotten. Regardless,the responsibility still is there to make immediate restitution or to contact the creditor and work out an amicable repayment plan and not ignore the matter to make the creditor think that there is criminal intent.The third part bill collection agency collects on what is called primary,secondary,Terese(3 agency's that it's been to or quads (has seen 4 agency's).That being said the more delinquent the more difficult the debtor will be to come to reason.I am in total agreement that an agency should follow the law much in the same way that all laws should be followed,so that isn't the issue here.The issue is for you to understand that if a debtor that has circumstances has issues that they should immediately contact the lender and work out arrangements and then stick to them,not just give lip service and [***] over the collector that tried to help them.Secondly,not make generalizations that all collectors don't follow the laws.Again that is like saying that one color of human being commits more crimes without validated statistics.Please assume that all collectors do follow law,especially now with law enforcement being tighter than ever and lawsuits being rampant.Be against the person that doesn't pay,that makes no effort whatsoever to remunerate their lender.After all if debts dont get paid,who do you think it affects in the long run? You and I every time we go to the store.So lets end this bicker and convince those who owe to pay up and i can guarantee that the bill collector will have a smile on his face when his/her phone rings and a voice on the other end says:I'd like to make arrangements to pay on my account.Please be vigilant on the people that owe and if someone told you that if toy came up with 50.00 you'd get 500,wouldn't you find a way to do that.I digress from this thread and hope you have seen the obvious and i am sorry if i dont readily accept that everyone doesn't see black and white common sense that way it is in this reality.It's been real and on to better things like trying to do things to help those who suffer.

    dr jaun...in one of my previous post i said the person should always pay the necessitie bills first..rent,,food lights etc..and if you do have some money left over even if you can pay 20.00 a month do it...you wrote back and called me a loser for suggesting that,,if that's all they have what do you expect them to do..what i meant by this is at least pay something until you get back on your feet them later you can increase your payments...now wouldn't that show the debtor being honest.
    the only reason you said a 20.00 a month payment is ridiculous is because you would only make 3.00 commission and in today's world that might buy you a cup of coffee and a buttered roll and maybe enough left over for a newspaper.
    if you say your a law abiding debt collector that obeys the fdcpa law,good then why do you work for a company that has a F rating with the BBB that continuously violates the fdcpa..quit your job and work for reputable collection agency

    I am a single father with 3 minor children and one in college.  My wife passed away as a result of complications while giving birth to our youngest child.  She was diabetic.  The costs of the uninsured portion of her last stay were pretty high.

    I have had the same position for years.  I am an engineer for a large Minnesota based industry. I am a very responsible person and earn a good income.

    I received a call from these people and they demanded payment in full.  I couldn't pay the entire amount of $6,200.00 at one time and asked to be allowed to make payments of $200.00 per month.  They did offer to take $4800.00, which I could not pay.

    So I thought I'd get a quick education and surf the web.  I followed your advise and declined to pay anything until they proved to me I owed the debt.  I was sent a poor copy of the credit card agreement  and the last six months of the statements.  I was contacted again thereafter and informed that as I didn't accept their offer that they were going to pursue the entire amount.  No yelling or screaming-very matter of fact.

    Sure enough, I received a Summons to appear.  I thought I would try and appeal to the judge and ask the court to force them to take a more reasonable stance.  

    This guy Oppenheimer showed up.  We spoke for a few minutes and he wouldn't take what I offered.  He said he would rather just garnish me.  He was very sure of himself.  He is also very intimidating-I mean this guy is HUGE.  I was a little nervous but I still thought that the judge would see I just couldn't afford to pay more than $200.00 a month or so and maintain any reasonable lifestyle for my family.

    He gave the documents to the judge and went into his legal mumbo-jumbo.  I finally had an opportunity to speak and explain why the court should allow me to make payments.  The judge cut me off after about thirty seconds and said they have the right to decline any payment arrangement, get the judgment and garnish me.  I said it would only be fair for me to pay them what they paid for the original debt.  She said that wasn't relevant at all. She must have been in a very bad mood that day because when I told her I couldn't afford to get garnished she said that was the law and I could either pay the amount they wanted per month or she was going to give them the judgement.  I said I couldn't afford $500.00 per month.  She went ahead and gave them the judgement.  

    This all happened about a month ago.  I just received a notice from them about starting the garnishment.  I went to HR to see just how much they could get.  Apparently, they can take about $700.00 per month and there isn't anything I can do about it.  Great!  Now I am at my wits end wondering how I can afford to assist my son through college and due to my income, he doesn't qualify for any aid.

    All I can say is that I hope these bottom feeders rot in Hell for what they are putting my family through.  They have ZERO compassion, endless arrogance and look to line their pockets with dirty money through my misfortune.  I have too much equity in my home to file bankruptcy and have been told by two lawyers that I have to endure this.  

    Any ideas to help me out?  Please, I am desperate.

    yes jaun has a valid point and that point is for people who are still working and making good monies they should be paying there bills..I'm writing about people who lost there jobs because of the banks that screwed up the economy and you know the banks I'm talking about the ones that your trying to collect for.
    let me ask you a question...you lost your job or your pay was cut say 25% now what do you do,your making a lot less monies so would you pay a sleazy debt collection company that has a F rating or would you pay your rent,utilities and food for yourself and your family.
    get a job with security you would make more monies then a low life sleazy debt collector..
    one more thing if i did owe monies i would never pay a sleazy company,i would make you validate the debt in full and i know you cant do that and THE LAW SAYS IF YOU CANT VALIDATE THEN THE DEBT IS INVALID....IDIOT...

    So you are still evading the bill and looking to not pay what you borrowed.That is called fraud and in this country,that is illegal and suit worthy.You continue to rail against debt collectors,as if it is their fault that you get calls because you owe money.Isn't that the same as disliking the mailman because he delivers the bills that you made? With all due respect,you obviously don't have an ounce of morality in you if this is really how you conduct business and wouldn't be surprised if your FICO score was on the lower end.You are extremely irresponsible in your though processes to blatantly wrong an entity that loaned you funds.Is it totally out of the question to say,repay what you borrowed?,even if you suffered a set back that you would do what is appropriate and call the creditor and work out an arrangement,hmmm,there's a thought! Let me say that debt collectors are just like anyone else that works for a living and they do expect to get paid by negotiating an arrangement to have the obligation satisfied.No one likes being behind on their bills but it happens and debt collectors have to put up with a boat load of sheer hell.Listening to lie after lie after lie,dealing with the same calls on a daily basis striving to get the indebted to answer the phone.Debt collectors aren't any different than anyone else and if you want to use sleazy,then why don't you stop being sleazy and preach doing what is right and just and return what was borrowed? Go into  Walmart  and steal and you go to jail,borrow from a credit card and don't repay  then you get sued.For heaven's sake have some common decency,here,when you use money that was given to you to use,repay it back and stop making excuses and being angry that a debt collector had the nerve to call you to get it paid.If you were decent to the debt collector that called you,and be cooperative,didn't lie and do as you say then i would suggest you wouldn't be on here crying. I am calling it what it is and i hope you are a grown adult to understand what i am saying,which is the truth.

    Some people get way into debt just trying to go to college for four years.  When they graduate they are hired for starvation wages and taken advantage of.  Screw debt collectors.  I'm sure Mr. Daddy Warbucks B of A won't be applying for food stamps soon.  But I probably will.  One thing however, I pay my taxes to the US and that is more than Bank of America does.

    he says he tried to work out a payment agreement with your company of 200.00 a month and your company wouldn't do it so he was taking to court and the judge got on his case and rules right away with your company even though he says he has a poor copy of the credit card agreement,that is bull [***] you must get a valid validation and if you don't you cannot be sued,his other mistake is that they started garnishing his salary in less then a month,,they cannot garnish your salary until 45 days after your company won the judgment...see a shill post,by the way does this guy sit next to you

    PEOPLE...the fdcpa says they must validate the debt according to the fdic rules 12CFR.23 AND 227.25 on your request they must validate in full that is seeing the contract with your signature and if these IDIOTS bought the bill they must disclose the price that they paid for the debt also payments and charges made and how they accrued the interest,,third party collections cannot validate the debt in full,so that means IF THEY CANT VALIDATE THE DEBT IS INVALID...

    my scores is 792 to 798,my house is paid off i get two ssn checks and a pension check every month and I'm always on time with my payments,i also do short sales with the banks and i make a nice profit from it and all the monies i make from short sales gets deposited into my two granddaughters bank account and there already have six figures saved,i bet they have more money then you.

    also ask these low life's if there licensed to collect monies in your state and if there not licensed its against the law for them to collect if they say there license then ask for the license number and tell them your going to check it out..
    also don't forget to check the statute of limitations on your debt if its time barred you do not have to pay it anymore and they cannot sue you or log on to your credit report the SOL is a killer for these low life collection agencies.
    MOST IMPORTANT IF THEY CANT VALIDATE THEN THE DEBT IS INVALID..ALWAYS ASK FOR FULL VALIDATION WHEN YOU OPENED AND CLOSED THE ACCOUNT AND ALL PAYMENTS AND CHARGES THAT WAS MADE AGAINST THE ACCOUNT AND YOU WANT TO SEE THE CONTRACT WITH YOUR SIGNATURE ON IT,,.

    I am a staid Englishman and see that you are incorrectly faulting those that seek repayment of a past due debt.It is agreed in contractual language by virtue of one's signature that they will repay the sum borrowed without further ado.Knowing that the world we live in is imperfect,it is expected that the financially strapped debtor will call his creditor when he know he will no longer be able to  repay to work out mutually acceptable terms to facilitate restitution.The reason why the account gets into the hands of a collector is because this action never took place.The debt was forgotten and not dealt with.Bill collectors work just like everyone else and it is well within their duty to enforce payment in full.Most collectors are open to the idea of settlement of an account,so that does benefit the debtor.All a debtor has to do is acknowledge that the funds were borrowed and call either the creditor or the collection agency straight away and make arrangements.The problem with debtors is that they seldom answer their tellys and in general avoid contact with the collector and creditor.This is a very bad practice as it insinuates that the debt was opened without the intent to repay.In short the debtor needs to not hide,not change phone numbers and run but to do what is right and make arrangements.The creditor/collector can deal with that much better than the avoidance.To use a Yiddish term:Chutzpah,meaning the nerve.Simply put,when you borrow you repay or if unable due to whatever circumstance,then call ASAP and make that arrangement and follow through with that and not blame everyone else for what happened but to just deal with it as an adult.That is expected,what is just and fair and just plain being responsible.What ever has happened to the morals of this world? In the 50's60's and 70's bankruptcy was taboo much as divorce was and is.Please be a person of reason and not denigrate this very serious problem.Money borrowed has to be repaid.I wish you the best and will hope you will see the wisdom behind the words.

    John Fortier...very nice post well educated..i agree with you i said on previous posts you should pay your bills if your working..i don't know if your in the USA of London but as you know we went through a economic crisis and its still going on.my point is to the debtors that you must pay your priority bills first before you make a payment with the collector lots of people lost there jobs or took a huge pay cut,I'm sure when they borrowed the monies there intentions was to pay it back i even suggested to pay at least 20.00 a month and hopefully if they go back to work then they can pay more monies,but according to dr jaun that is not acceptable he believes he should be paid first before you pay your rent and buy food for your children..also sir these third party collectors don't follow the law they lie to the debtors saying they will be arrested or there going to freeze there social security checks and the law says that they cannot do that..there is a web site BUDHIBBS.COM he is a consumer advocate for over 25 years closing down these sleazy companies like this one and this company has an F rating with the BBB so they should act like an adult and practice there business within the law.remember these collectors are collecting for the banks,the same banks who put us in this economic crisis.

    I am a resident of  London and Sir,we never make assumptions about one's nature and pile all beings into the same hopper.I agree with you on the point that in one's work that laws should be followed just as Madoff should have followed but Sir it is just wrong to say sleazy collectors just as it is wrong to say all Muslims are terrorists.We are not worthy do judge and only the Lord is to judge us.All bill collectors are not sleazy,many of them,like you and I go to work to support themselves,and if they do it in an unethical manor than it is he or she that will have to deal with their wrongs.So please refrain from saying all bill collectors are sleazy just as much as all debtors are scum.Fair is fair. I do agree that rules are rules and that the law of the land needs to be adhered to so that lawless doesn't prevail.You are a good man and would love to meet you face to face and discuss the finer things in life.By all means,a bill collector should demonstrate a high level of integrity and professionalism and try their best to help the financially strapped find a way to pay.     John...I'm sorry i should of been more specific..when i write about sleazy debt collectors i don't mean all debt collectors,,so i apologize to all the reputable debt collectors who work for reputable collection companies.unfortunately there is only a few of them in the USA most of them do not  act professionally.

    i got involved with the 800 notes because my neighbor who is in her 80s they called her and told her she owed x-amount of dollars and if she doesn't pay they will freeze her social security check and take her house away,,the lady had a mild heart attack.so after awhile we found out a debt collection company FFG called her and they dialed the wrong number so i called them and told them, what happened,there response was WHO GIVES A [***] IF THE OLD LADY DIES AND HUNG UP ON ME..
    these are the low life sleazy debt collectors I'm talking about
    John i just might take you up on your offer for lunch I'm thinking about buying real estate in London,i have to do my homework first and if it looks good ill be there.

    Alot of these guys have already paid your debt to the original creditor. They bought your debt just like a car dealership now trying to re-coop there money plus a margin of profit. Depending on the type of debt the percentage they pay is different. The more likely to recover a higher percentage is paid. If you intend to pay but are not able to now or you really feel you are being wrongly accused simply tell them you are not paying and to proceed to court. 99.9% of the time you will not be served court papers. If you do go and plead your case to a judge and let it play out. The collectors are only trying to do there job with as little cost as possible. I have dealt with some that were good and I paid, others, I waited 7 years and said they lost entirely. Just like Police there are some that do it while being a ass, some do it with reason patients. Neither is right or wrong as long as the objective is reached.

    This Mike guy is a real winner. I filed bankruptcy 8 years ago and he is trying to collect a debt that was written off and account closed. In the 8 years I have never heard a word or recieved any kind of document from this company.. He called my place of employment yesterday and almost got me fired!!  He told my boss that I owed money, he was a collectore and that he was going to sue me for the balance and to be prepared that a sherrif would show up at my place of employment and either serve me or arrest me..... Oh and when I questioned if the debt was mine he gave me a PO box that I never had and a city that I never lived in !!!!!  and then he told me that he had a handwriting professional analyze my signature and it indeed was mine!!!  then he said that I would have to pay for that too !!  I told him that I wanted copies of what he had and he said "nope"... all for $137.00 debt...

    I had the opportunity to talk to a debt collector named Syd Cohen and in the time we spoke,I was super pleased that my debt was being handled by him.He was very empathetic with me,didn't judge me and even said that,he himself was struggling financially which made me feel that i wasn't alone in this problem.We set up a payment plan and I have to say that he is one of the nicest people that I have spoken to about my bills.Too bad that there aren't more like him.Who ever is in charge there,please do all you can to keep him happy as he is a wonderful representation of your outfit.Thanks again Syd and look forward to working with you.
