You seem to know the various states debt collection laws fairly well. Pretty odd.
I think I can offer some slightly better advice then yours, which seems to be do as they tell you or they will own your ass in court. My advice is always try to work out a settlement for legit debts with legit professional collection agencies - actually try to work things out with the orginal debtor before it goes to collections. You can always almost settle for a percentage of the debt and/or an extremely reducted interest rate - around 0.9-4% with long payment terms (if needed).
Just to give everyone a leg up in collection agency thinking. What happens is the original company is saddle with what turns out to be a bad debt - after trying to collect it on their own (tactics vary from company to company) they will sell it to a debt collection agency for a much smaller percentage then the original debt. Which in turn might get sold to another debt collection company and eventually might even get bought back by the original debtors. It's quite the screwy system. But this quite the screwy country. :) - BudCalls everyday.

- whoa ho houp until last week i hadn't received any calls from these people. they would call before and leave messages stating that by remaining on the line i am acknowledging that i am the person they are calling for... i listened out of curiosity... they started sending me these letters on blue paper that said that said they are notifing me of their intent to deposit MY post-dated check...this is interesting because i never gave them a post dated check let alone done business with their client, The Education Resource Institute, INC (TERI). I looked this "TERI" up and found that they have filed chapter 11 bankruptcy... now i have some school loans, but those are being paid for with other arrangements. ive never done business with TERI....
oh yeah, a couple of times they've sent letters stating they are going to submit their ACH payment to my acct as well...has yet to happen...

- axo replies to sahs| 2 repliesI had to change my number because they would call everyday. I never pick up. I can only assume it is because of my messed up student loan thanks to my school. I didn't know I had two student loans instead of one. I filed for bankruptcy and finished paying off my chapter 13, and now they are calling me non-stop. The IRS went after me to pay taxes on the one loan because bankruptcy took care of that, and I am now paying my government loan. So why are these people calling me? Should I worry?

This is my story:
I been fighting with these people back and fourth for almost a year now...I have a student loan with US Funds (Sallie Mae)...At the beginning we did made a verbal agreement over the phone to start a payment plan...The gentleman I had spoken with, was nice and we set up a payment plan…After I made 3 payments I did not see the money being credit to my student loan account...So I decided to stop payment, till I got a written contract from them...I also written to Sallie Mae on my situation and they written back stated that my account was transfer over to US Funds...I have written to US Funds couple of times and yet to hear from them...I also have written to Zwicker & Associates to send me the contract we agree on and also haven't heard from them...I got no phone calls and no letters…Then out of the blue, I get a letter from my employer stating that they will be withholding earnings from my paycheck …I then went to check my back account and that also had a lien on it...I guess they didn't want to put up a fight with me, so they decided to take this route instead...
I had read everyone posted and a lot of you went threw some nightmares with these folks and hope that everything will turn out alright for all of you…Well for me, I know this will hurt me for a very long time but overall, at least I can get my student loan paid off…I know Our Heavenly Father will help me get threw this, like all the other blessing he have given me…

Back in the 1990's I had a loan with Sallie Mae and US Funds that I was trying to pay off on, in spite of the fact that my college degree was pretty much useless and couldn't get me a good paying job anywhere. After a while, they called and said that my monthly payments weren't big enough and they were going to start garnishing my wages. Weird part is, after garnishment they were getting less money per month than What I was originally paying them (???) I thought, OK whatever. 3 years go by and then my employer goes out of business. I call them to make new arrangements since I didn't have any wages to garnish anymore. Their response was: "We haven't received any payment from you in a long while." So I ask: "What about the $4200 that you have been collecting for the past 3 years? They say: "We have no record of that." Ridiculous. Now I am being garnished again for the same loan and I'm pretty sure I will have to pay that $4200 all over again. I just wish they would send me a statement or payment record of some kind. Why would they refuse to do this? Oh well. The one thing I know for sure is: I am never going to college again. What a joke.

Unlike the normal pissant collection agencies, who love to throw around threats with no legal ground to stand on, this loan was from the federal government, so they can pretty much do whatever they want. Garnish my wages, intercept my tax returns, they even stole away my stimulus check, the only windfall that I have had in the past twenty years. Oh well. I only have one regret in life, and that was going to college. What a waste.

For example, if you have a home, take a home equity loan (I guess given the current market may not be a feasible option) or simply put a family member as a lien holder. This way you will protect yourself from these [***]. They are nasty......My uncle called them and made them an offer of almost 60% of the balance.....They threaten and now am going all the way...I want them to get a judgment because I have no assets and then I want to bend before me and take a 10c for a dollar....They only believe in scaring people and taking people to courts....Do NOT be afraid of them....Just protect whatever you have and you will be fine...When the evil [***] realize they cannot collect anything, then they will be reasonable.....They are NOT going to be nice. Their job is to be nasty....So do NOT be scared...Insult the [***] if you have to and change your number.....Rick

- unknown replies to axoyou have 2 different student loans out federal portion and a private portion your federal taxes went towards your federal loan and not towards the private portion which is going unpaid so yes you do need to call
