I found out the hard way that these things don't just go away after they get this far. I ended up with a judgement against me, and today when i went to file my taxes i was told my H & R Block that my tax returns would be withheld.
DON'T believe everything you read.... I listened to all these ppl on these threads like BIGA who misleads the general public for some unknow reason.... BIGA you should be ashamed of yourself! Just because you don't want to pay your bills you shouldnt mislead ppl into doing the same.. if i had not come across your B.S post's i could have resolved this last month...If i worked out this debt myself i would have save so much money and still had my tax money- Caller: Johnson Smith Associates

A very nice guy who treated my like a human being for a change. If you need to deal with this collection agency i recomend you ask for Ben...(i forgot his last name) Really helped me and was straight forward with me.

I will say one thing! For a collection agency they were very Helpful and spoke wot me like a human instead of just someone who owed money. She told me that they were collecting on a debt that was owed to Chase bank. After calling Chase and gettig the run around for 1 hour, i was directed back to them! i was hoping to just deal with the bank directly... i HATE dealing with collection agencys.

The reason that the bank can not except payment, or even discuss the bill with you is because they do not own the "chain of title" to the debt, Once you default on the debt and you don't pay the bank the money that is owed, they "charge it off" and liquidate that debt to an investment firm, or collection agency, or even a law firm to pursue you for the money that is owed.
Once this happen you will have to deal with that company directly. Unfortunatly, it is the same as when two banks merge together.. Your account is transfered tot he new bank. It is the same with an account that has been deafaulted on. You now owe that company even thought the debt was not initially made with them. - Heather B| 1 replyI got a call from this company last week. I called and spoke with Scott Phillips. The car loan that i had taken out with M & T bank in 2014 had been sold and now they were the compnay that was suing me on it. (This was an suv that got repossed after i lost my job in Feb of 2015)
I have always paid my bills, and never had any problems until of course i lost my job. I have never had to deal with anything like this. I ended up calling the bank. I spoke with a rep who was very rude. He explained to me that since i had defualted, and didnt pay it back, they sold the debt, and no longer could discuss it with me. I was told that i would have to deal with the collection department with Johnson and Smith.
Yesterday i ended up calling back and speaking with the same person. Again he was polite. Explained to me the same thing that the bank told me. I was able to work out an agreement with them where i pay them monthly. But my main concern is that this account is still on my credit report and causing me some problems. I was assured that it would be updated as paid was ii paid it off. I wanted to be sure of this, so i called the bank, who of course was closed!
I just spoke with the bank this morning before this post, (since they are the ones reporting it to my credit) and they told me once its paid, then Johnson and Smith reports it to them, and they update it as paid.
This has taken me almost 3 days, and over 4 hours on the phone. So i wanted to share this info and what i found out to help anyone in the same situation. i hope i have been helpful!- Caller: Johnson and Smith

In very few instances do they come looking for the difference between what the vehicle sold for and the balance on the loan. But let us assume that is the case. They would have sent you letters telling you that you owed money.
Now the other thing is that you keep calling the bank for "advice", when you should be looking for advice from the federal and state agencies that actually can give you accurate advice on debt collection. Further, you have not indicated that this outfit has sent you the dunning letter as required by law. You have also not indicated that this outfit has validated the debt as required by law. Talk about not listening to someone, well you just proved that you are nothing but a liar.

You need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. The address is a UPS store, but another criminal debt collector by the name of Receivable Management Corporation aka RMC is listed at that address with a “suite” number
They are not registered under that name with the Massachusetts Dept. of State or registered as a debt collection agency, which legally preclude them from doing business.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

I did get a letter in the mail....... the BANK verifed the debt themselves....On top of a debt validation letter that i received in the mail from Johnson Smith And Associates......And i have been IN THERE OFFICE at 400 West Cummings Park...... the one that you SAY DOESNT EXIST!!!!
Johnson Smith & Associates is a company that was fair and helped me get my debt resolved.
ITS YOU who is the fraud! going on here with all this fake information trying to posion these peoples minds.
