They called at least 12 times over the last two days asking for random people (no last name) - i think they are just hoping to hit a valid name so that they can harass them. This is definitely not a legit call.

Yes indeed! They call me saying that I have a lawsuit against me from some check. I never had or dealt with a check on my payroll check. He says he is a attorney telling me about the prosecutions if I don't pay. So me being an Investigator and a big head in Law I confirmed to him if he is a attorney by law you can't call anyone threatening with a prosecution and if there is a lawsuit agains me from a party then I would have been needed to be served with some docs and a court date. Its highly illegal for an attorney to call with a threat demanding money.

But if anyone wants to file a Lawsuit against these people feel free to gather as much info about them where I have enough info but a little more wont hurt. I'll support any case that anyone set out against these telemarketing criminals.

FDCPA - Fair Debt Collection Practices Act

Are you finding yourself lately, in a sticky situation created by a third party debt collector?
If the answer is yes, you are not alone and you could use some help from this site to put a halt to the mayhem created in your life by these notorious debt collectors.

If you know your rights against the third party debt collectors, it would help you get over the angst you do not deserve to undergo. The Fair Debt Collection Practices Act or the FDCPA is created to help you against the illegal tactics of the third party debt collectors or the debtors themselves, even if you owe them the debt.

The Fair Debt Collection Practices Act offers protection from illegal and unethical tactics of the debt collectors. A clear understanding of debt collection laws under the FDCPA will entail you to the power to fight the third party debt collectors. Stopping the debt collector harassment starts with your knowing your rights as ordained by the FDCPA, or the Fair Debt Collection Practices Act. The Fair Debt Collection Practices Act is also known as the Fair Debt Act or FDCPA. The Fair Debt Act or FDCPA is a federal law and it protects consumers from the debt collector abuse. Much depends on how one is going to use it. Many states have their own laws on par with those by the FDCPA and they lay the ground rules for debt collection for creditors out to collect their debts. Next time a debt collector calls, let your rights under FDCPA deal with them.

    What is Debt Collection Harassment?

    Posted: 10/15/2011 12:36:16 AM

The Fair Debt Collection Practices Act (FDCPA) has a set of rules that determine what can be termed as harassment by the debt collector. Harassment can be either written or verbal. Calling you repeatedly at home or work place is a form of harassment. Harassing in any form is considered a severe violation of the FDCPA.

According to the FDCPA the following are considered violations of the Act by the debt collector:

      Harassing by calling repeatedly
      Threatening to use violence
      Using obscene or abusive language
      Calling at work place
Calling after you request him not to call
      Calling but not giving name
Sending notices that look like court notices
Publishing a list of consumers who have not paid
Trying to extract payment over phone
Giving false identity of being an attorney

A debt collector can call you if there is a genuine debt to recover. But debt collectors are often over- enthusiastic and may end up placing too many calls or end up using tough language. This is considered to be harassment. The FDCPA punishes harassment by debt collectors. The Act gives out specific guidelines on what is considered unlawful behavior. These guidelines protect consumer rights.

If debt collectors obey the rules of the book the emotional stress faced by the debtors can be avoided. In the absence of this understanding there is a possibility of the consumer falling into the emotional trap.

You can avoid the harassment by following these simple rules:

      Stay calm during the call
      Do not enter into argument
      Do not use foul language
Do not give away your bank details
      Ask for debt validation
Send a cease and desist letter
      Dispute the debt

If the debt collector has harassed you and violated your rights, you can sue him. You may engage an FDCPA attorney who will take care of the legal aspects.

    A Debt Collector CANNOT:

Telephone you an unreasonable number of times
Telephone you at an unusual time/ unusual place
Disclose information of your debts to third parties
Use profane or other abusive language
Contact you after written notification that you do not want to be contacted any further
Claim to be affiliated with any governmental organization
Misrepresent the character, amount or legal status of a debt
Threaten of to take any action that cannot be taken legally
Accuse you having committed a crime
Threaten or communicate false credit information
Attempt to collect, until he honors your request to validate
Use deceptive methods to collect debts
      Call you before 8:00 a.m. or after 9:00 p.m.
Call you, but not announce who he/she is
      . . . and more

    You can:

Reduce or completely zero out your interest payments
Avoid or reduce late payment fees
Combine several loans into a single payment plan
Get a single, low monthly payment to clear all your creditors
Get errors in your credit reports rectified
Get invalid or time-lapsed entries in your credit reports removed
      Get peace of mind
      . . . and more

Read up on your rights...turn the tables on these scum collectors!!!

I work at a payday loan place and believe those posts saying people got arrested are bogus, If that was the case  there would be no need for collectors, there are protection laws for borrowers, it would take thousands to prove you intended to fraud, in Good Faith make an arrangement and pay the debt...the company doesnt deserve to not get paid but they are usually paid low wages as collectors and get high commisions when they collect a debt. If you are truely harrased add your number to the national DNC list and then call the FCC with a formal complaint. Bottom line they are just barking there is no bite.. however they can garnish wages. If there is mis spellings sorry at work rushing :)

    Payday Loans
A payday loan is a small, unsecured, high interest, short-term cash loan. In most cases, consumers write a post-dated, personal check for the advance amount, plus a fee. The lender holds the check for the loan period and then deposits it, or the customer returns with cash to reclaim the check.

    Changes Effective January 1, 2010
•You may only borrow a total of $700 or 30% of your gross monthly income, whichever is less.
•Your information will be registered in a state-wide database, ensuring that all payday lenders have your most up-to-date loan information.
•You may only take 8 payday loans per 12-month period.
•If you are unable to repay your loan before your loan is due, you may request an installment plan with no additional fees.
•If you currently have an installment plan you may not receive another loan.
•Lenders may not harass or intimidate you when collecting a loan. If you are harassed, contact DFI and file a complaint.

If someone got arrested it would 't have been for a payday loan however people do also go there to cash checks.  If you write a bad check for more than a certain amount and you didn't have the money to cover it you commItted a crime a will be rightfully arrested.  The problem is some people think they will be given time to pay the check back but you won't   It wasn't a loan it was fraud.
