- Jennifer replies to ecI wish I would've read this earlier. I have actually dealt with check smart several times. I have always paid my debt and often used their money orders. until now. Through no Fault of my own I became unemployed. I had only owed 500 dollars. My bank account had actually over drafted, so I thought they had gotten paid and that I would just owe the bank. I started a search for a new job but when your in the hospitality business and it's not tourist season it is very hard. I did not know that they had not been paid till I started getting these horrendous calls from them. Calling me nasty and threatening my friends who had nothing to do with it( I really don't know how they got a coupla the numbers I know I didn't use them) I explained that I was unemployed and had just applyed for unemployment the day before because the market looked so bleak. I got very little for the first check so I struck a deal with the phone company to pay a part every month just to keep the phone on. Now I wish I hadn't! when I try to explain that I needed to pay for the phone first to keep in touch with employers they hang up on me even though I'm offering to pay a small amount up front! I finally just sent them a small money order. But I know they'll keep it up till I pay the full amount. I have never denied I owe them and was just re-reading my contract and discovered I have not only 60 days to repay but I have a right to get credit Counseling Companies involved, that they should have provided me with! I know I "broke the contract" but things happen. If they really wanted any money maybe they should chill out a min. I will be filing with the FTC because I have been nothing but honest with them from the begining and dod not deserve such treatment.
- Get EvenCall from 213-537-1439 leaving message to call 866-354-0567 and to ask for A15193 account. Called the number they said they wanted to speak with Artena Thompson. I explained to them there wasn't anyone here with that name. Then they wanted me to give them my Social Security Number (DON'T EVER GIVE YOUR SOCIAL SECURITY NUMBER TO A COMPANY YOU DON'T KNOW). All they kept doing was trying to get my personal information, becasue they had no idea what number the A15193 went to except a made up name. Maybe Homeland Security should get involved with this group and put and end to it.

They are violating the Fair Debt Collection Practices Act. If you need a copy of this letter, contact Clark Howard's website under "drop dead letter". It is my understanding they will continue to call you. I will be recording the telephone conversations (inform them you are doing this. I will pursue legal action against these folks and hope you consider the same. Take care all. Don't let them bully you!

- GGot a call this morning from them, it's CheckSmart calling me because I was down as a reference for someone. Well I know who it is and I wouldn't legally bind myself to the situation in any way whatsoever. Is it spam? I don't know, but I was never notified to receive this call by the person mentioned so it could be a loan reference or a job reference.. I just let it go to voicemail and ignore.

- AnnoyedByU| 1 replyAbout 3 months ago I purchased a phone from my brother-in-law. The number that I have taken over is my sister's telephone number. Unfortunately she had taken out a loan with Buckeye Title Loans. When I first got the phone I would simply take a message for her and let her know that they called. I stopped speaking to my sister and still havent spoken with her, but they continue to call. I finally told them that the number was no longer hers and to stop calling. They would still call 5-6 times a day and I was putting up with it and continued to tell them she was not at that number any longer and not to call. I did this because I understood that it was her number (its mine, now that I bought the phone I'm gonna have to deal with any of her calls and tell the people who call that she is no longer at the number)and it was on their file, but jeez! They make notes in their system, they should know not to call the number anymore.
Finally, one morning they began calling at 6am and when I woke up at 9am I saw that I had missed 5 calls. I called them back and told them that my sister is no longer at that number and to stop calling. A guy got on the phone with a nasty attitude and said "Where's the car? Where is it? Where's the money?" I said excuse me. This is not the person you're looking for she is no longer at this number. He said "Mmmm-hmmm" very sarcastic. And I told him that he is now harassing me because we have told him so many times to stop calling and that she is no longer at the number. He told me to go after my sister for harassment because she put the number on the file. I told him that she isn't the one calling me constantly and so he is harassing me. I told him that I would file harassment on him. He proceded to tell me that I'm obviously not smart enough to know the laws. So I yelled a few obscenities into my phone and told him that I would see him on that day with the police! I hung up the phone and an hour later my phone rang again. I answered it very annoyed and ready to go at it but instead I got a recorded message from a Mr. Sable or something like that saying "We have made several attempts to resolve this issue. We are giving you one final chance to resolve this issue. If you do not contact us to resolve this issue we will take action." They called again several hours later and I did not answer. I checked my voicemail and got the same message. I have not received a call since I spoke with the last person, but I am going to take action against them! I'm not even the one they're looking for and they're harassing me saying things that should never come out of any representatives mouth of any company.
I do have the ability to record these phone calls and if they call again I will record the phone call and send it to the Attorney General. I have the voicemails they have left and will be sending those as well. I have already contacted the FTC. I have gone to the Better Business Bureau (which honestly doesn't do much especially if they are accredited. You just pay to have the bad stuff removed) I have been in Customer Service for years and deal with the AG and BBB daily. - Silent Bob| 1 replySo, I'm in the same boat as many of you....my number has gotten on their "list" because someone supposedly used my number as an "alternate number" (of course some days they say that I was used as a "reference" it depends on who you talk to). Well at this point they are calling at various hours of the day and night, on various days of the week/weekend.
I most frequently deal with an [***] named "Tommy" he claims that he is a manager, but I don't believe him.
What is remarkable is that every time I speak to them I tell them to remove my name from their list, but they just laugh and tell me that I need to deliver a message to the person they are looking for. They try to pass the buck saying that my "problem" is with the person who used my number....(yes, I have a problem with *them* as well, but these guys don't understand their legal responsibilities here).
Here is what I recommend to anyone getting calls from these folks.
1) Tell them to stop calling you. It won't help, but doing so helps the legality of your case.
2) As long as you can get your "routine" rep on the phone, feel free to be as abusive as you like. When I'm having a bad day, if they have called in the last day or two, I'll call and get "Tommy". I can yell, cuss, say any nasty thing that I like. He can hang up if he wants, but I can call back and get him again....it really is quite fun.
3) Be sure to make calls to their 800# from a pay phone whenever you see one. 800#s have to pay additional pay phone recovery fees every time they receive a call from a pay phone...it makes me feel better to know that I'm costing them money.
*** Okay...lets start with the *real* ways of making a difference.
4) File a complaint with the FCC. These guys are breaking the LAW here...the Telephone Consumer Protection Act. When you tell someone to stop calling your number, they are obligated to do so. These guys think they are above the law...they are not. Here is the website to file a complaint with the FTC:

5) File a complaint with the various state agencies that they work with...They are based in Ohio, file complaints with

6) File complaints against the company with the various industry organizations that they are a part of. These people work in a shady industry. They are probably concerned about additional bad press. It is certainly bad press when one of the industry member companies repeatedly violates the law...here are some of the main industry groups:

7) If you happen to be an attorney, happen to know someone who is in law school, or just want to have an entertaining day in court, file a lawsuit against them in your local small claims court. It can be an easy way to make $500 (the base civil punishment defined by the Telephone Consumer Protection Act).
All you really need to do to win your case is:
a) record a phone conversation where you are telling them to stop calling your number (make sure you state the date on the recording, and make sure to capture the entire conversation so that you have the name of the company)....it is easier to plan this recording if you call back the 800/866 number on your caller ID...that way you can be prepared.
b) have a phone record which shows that they called you again AFTER you instructed them not to do so.
c) fill out the appropriate paperwork in your local small claims court
d) Go to court, collect $500....easy money.- Caller: Check Smart
