- anonymous replies to abj45| 3 repliesthat link to the letter you posted is crap...a debt collector IS allowed, by the statutes of the FDCPA to call a neighbor, one time per neighbor for the purposes of location information....they are allowed to ask your neighbor for your address, phone number and place of employment, they are not, however allowed to disclose why they are calling or make any reference to the debt they are collecting or that they are collecting a debt at all. its crap like this that keeps you all in the category of "least informed consumer", you are all being mislead
- anonymous replies to DONO| 4 repliesa payday loan is not reported to any credit agencies, even the payday loan place will tell you that, that's why they dont take your credit into effect when you get the loan, and the debt collector would not have access to your payment history, it is not their job to provide that to you, if you hadnt defaulted with the payday loan company in the first place, that information would have been readily available to you from the original creditor...do you yourself know "every" aspect of the FDCPA? We used to have to pay settlements on a monthly basis to customers who were violated with answering machine messages. They saved the messages and got an attorney. The average pay off was $2500.00.
The company made so much by not following the rules that they factored this into the equation. Save the messages, and when they call if you happen to call them back, tell them it is illegal to disclose information to relatives and co workers.
The sad part is Pay Day loans could be taken out by anyone that has your social security number and drivers licence, many times they approve the loan without even talking to the customer. These companies make their money over and over again by charging "re finance fees" that are outrageous. They are not hurting. - FrustratedI received a call stating that they were looking for my daughter. My daughter hasn't lived with us for almost 5 years. They said she was being sued for breach of contract. She owed them $500 and it had to be paid within 2 weeks or they were filing a lawsuit. He said his name was Curtis Johnson and gave a file number. I forwarded the information to my daughter. She called them and said that she would pay them. My daughter has asked for some type of document either by fax or mail and has not received it. They wanted her to get a pre-paid credit card to pay them. She told them that she wanted to send a cashiers check. They gave her an address in New York. They have been calling her on her cell phone at least 10 times a day. Now they are calling her at work. A friend of mine received a similar call yesterday which sent up red flags. I checked it out on the internet when I discovered this site. She will not be sending them one cent.

- LordBurrisI too got a call from them. They make it sound as if they are lawyers to scare you into calling them. it is Illegal for them to claim that they will put a judgment against you. They HAVE to take it to court first by law! And then if the judge puts a judgment against you THEN they can garnish your wages but 99.9% of the time it never goes to court because they lose money, its a scare tactic people, don't believe them. If at all possible pay the original creditor and get it all on paper. This company paid pennys on the dollar to get your account, maybe %10 of the total owed so anything you pay them straight out is a profit. THEY CANNOT GARNISH YOUR WAGES WITHOUT COURT ORDER FIRST!

They cannot just issue a garnishment and get money. If it was that easy all of them would just do that and not waste time trying to get the debt from you. You cannot claim to have a judgment or make a claim of judgment until it goes to court first per federal law. You cant claim to garnish wages until after a judgment has been filed by a court per federal law. If you are asked not to call a person at work by federal law you cannot call them at those places. By law you are only allowed to call no more than 3 times to the same number before 9 in a single day... you think im stupid but I have a lot of research into your crappy disgusting practices. You cannot make false claims that go against federal law and in %99 of all collection agencies, they do use illegal practices to try and intimidate the consumer into forking over the money without any questions asked. People do your research, dont blindly follow a crook at his own game, pay your bills yes but dont take their [***], because simply put you do not have to. These people have these jobs because they are too sleazy to get real jobs, no one will hire them. They get 10 minutes of "training" then put on the phone with a script. This Cambridge and Huxley company are owned by no good thieves and convicts who could careless what you say or do, they want money and that's all they care about and will say anything to get it. If they threaten you with court tell them you will see them in court. I doubt they will ever take it that far and document everything, every time, every bit of email voice mail and paper mail to bring to court if they do and once federal law is broke they lose, and it happens every time.
