- RVThe call came to my cell phone during business hours. On my lunch break I returned the call. They must have caller ID because it would go straight to voice-mail. When I call from my cell phone it will go to the automated service line. I'm glad I found this site.

- MeganI have recieved calls from the 866 number above and also some from 716 something. I spoke to a Ms. Mohler (sp?) and she was incredibly rude. She said we owe'd a debt of $540 for an unpaid payday loan, which I don't deny, I completely forgot abou it. BUT! She refuses to give me any information about the account. Like the original balance. She also said that they had mailed me several letters, but I never recieved a single one. She also told me that if I didn't have payment in full by tonight that I was going to be sued and my wages would be garnished. Funny thing is, they can't garnish my wages, unless I give permission, being that I work on and Indian Reservation. I told her that, and she got livid and told me there were many other ways we would be "punished," what kind of "lawyers" would use that word for collection? She said that my drivers license would be suspended. When I told her I didn't have a drivers license she became enraged and said to call her when I had the money to pay her and not before then and then she hung up on me.
So my question is, has anyone actually learned anything about these people and are they bogus or legit?

§ 806. Harassment or abuse [15 USC 1692d]
A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(1) The use or threat of use of violence or other criminal means to harm the physical person, reputation, or property of any person.

§ 807. False or misleading representations [15 USC 1962e]
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.
(2) The false representation of --
(A) the character, amount, or legal status of any debt; or
(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.
(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.
(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to --
(A) lose any claim or defense to payment of the debt; or
(B) become subject to any practice prohibited by this title.
(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.
(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.
(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.
(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.
(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.
(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.
(13) The false representation or implication that documents are legal process.
(14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization.
(15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.
(16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 603(f) of this Act.

I find this strange as the phone number he is calling is not linked to anything I own nor is it linked to anybody I do business with. - PamI had a call from them today - left a voicemail on my office phone, saying I needed to call them back immediately. I did - but not before I used a *67 to hide my # from their caller ID. When they asked for my # I gave them my cell, and of course they couldn't find it. I then had to give my last name. They were calling to set up a county court date. They say I owe $480 for a PDL taken out 3/21/2005 from Quick Payday. I'm not disputing that, I did default on a couple of payday loans around that time. They told me that if I don't pay it by the 29th (2 days from now) "the attorney" will "fax documents" to the county court to file on me. I've never heard of being able to file on someone from out of state via fax machine. LOL. I've contacted Bud Hibbs but I dont' plan on paying these people a red cent without some legitimate documentation.

- SoWhAT replies to AlfalfaPlease do not use this letter. It is a letter that is quite often used by folks that do not know what they are doing. You can't dispute something that you don't know what you are disputing. Go to my post and see what needs to be said, you do not have to go into a big rigamaroll when asking for verification of a debt and you certainly don't ask for verification of something you haven't even gotten. If anyone were to send this letter they would be laughed at because these collection agencies/attornies know this letter back and forth and it shows them that the person sending the letter knows not of what they are doing.
Also, DO NOT send a cease and desist. This tells them that you will not communicate in anyway with them which leaves them open to file suit. They need to be notified that it is inconvenient to talk on the phone but they can contact you through the US mail only. A cease and desist may come back to bite your behind.

- JoeI run a business downstairs and work very late. So it REALLY ticked me off when I was awakened first thing in the morning by a phone call from "Signarale law Offices." I ignored the call, then heard my phone downstairs ring not five seconds later.
When I checked the messages I was instructed to call the 866-878-5796 number and ask for "Mrs. Pope, ext 371." The strange part is that they were looking for somebody who not only doesn't live here, but somebody I've never met nor ever heard of.
Since I read a number of complaints about this collection agency before I made my return call, I was pretty belligerent when I called, and left a message.
They returned my call shortly thereafter. I told them I told them I didn't appreciate them calling my office, I told them I was prepared to complain to the NY attorney general's office ... I was pissed.
When the guy who returned my call said, "You get more flies with honey," I said, "You too - I've been reading pages and pages and pages of complaints about your rent-a-lawyer coillection agency on the Internet." He said he saved all his phone calls and had my belligerent message recorded should I complain, so I pointed out that I have his collection call to my work number on file as well.
He finally agreed to delete my phone numbers from his system. So, in my experience, if these collection clowns are calling you and you honestly don't know who they';re looking for, "attack mode" seems to work pretty well!- Caller: Signarale Law Offices

- heatheri received a call from a girl telling me to call 1-866-876-7234 xt 353 regarding a case number. i know i do have lots of outstanding debts, and i am retaining an attorney on 3/24, she said to call or have my attorney call in the next 48 hours. should i wait until ive officially retained my attorney or should i call them and tell them that im doing so. the debt i believe is legit.
