    I received a call from them stating they are going to take my case to court.I am trying to read al I can on them and try to get them off my back. They need to quit calling my phone. They called my grandparents and my step-sister.

    I have received 3-4 calls the past several weeks from them. They keep asking for a variation of my maiden name--which I have never gone by. I also have excellant credit and checked all 3 credit reports to make sure everything was in order. The first time I called they asked me if I knew John, and Steve and Candy--these were all family names--so they really did have my info.
    Anyway, after another call tonight on my machine, I called them back. When the girl asked how to direct my call, I told her nowhere--that I will talk with her. I advised I was recording the call and told her to look up the bogus case number--which she did. After reading the name, I told her that person was not me, and never had been, and that her company better not call my number again. She said she would take my name and number off the list. (what? no fight? LOL!). Anyway, I asked her name (Miss Williams, yeah, right) and advised her that I have the recording so if they call my back, I will file with the FTC. She said no problem, it was off the list.
    That was too easy. I am waiting for the next battle!

    I got a call from these people a couple months back. They called for me under my maiden name which was the name on the card. I since haven gotten married. Been married for 12 years already when they called me. Anyways this guy on the phone is telling me that I have to pay this debt with was charged off in 04 and if I don't they will take me to court. I live in Fl now and the law down here is if the debt is 5 yrs or more old it's a dead debt and they can't get anything out of you. Now they are back to calling me again leaving messages that they are going to put out a summons on this debt that I'm suppose to owe yet,which has been charged off. It doesn't even show up on my credit report anymore so I know it is gone and they can't do anything about it. When I first talked to this guy I had him on speaker phone and my husband was listening and when he asked the guy a question the guy said am I on speaker and I said yes my husband wanted to hear what was being said since it would be house hold money going out to pay this debt he wanted to know where the money was going. After he found that out he told me to get back to him on what I could pay whatever suited me that the ball was in my court and that they would pretty much take whatever I could give them. Then he  got off the phone in a hurry. They are just trying to get money out of people. Isn't  the economy bad enough with people being laid off and can't keep up with their regular bills let a lone having people like this calling you and threatening you that you might have to pay out more money then you have. No wonder our country is so stressed b/c of people like them. I think they should be fined whatever the amount is that they are trying to get out of people. Once they have to pay some money out maybe they will leave the decent people out there just trying to make their way and raise their families alone. I know I'm really getting tired of these people. I haven't even bothered calling them back this time. It's a waste of my time. I have better things to do then put up with their bs. I hope they get theirs.

    Calling looking for someone by the name of Cheryl. I don't know of any Cheryl, and they act like they do not beleive me. I have asked them to stop calling, and they still call everyday. This is enough!!! I need to stop this harrassment, but don't know how.

    Thank you for the information regarding the harassing calls from the 866 number!!!  I filed my complaint with the FTC today.  You certainly had more information than I was able to get.  This is particularly agrivating because I have no unpaid debts!!!  I'm concerned regarding your statement that other relatives were contacted.  This type of call would especially frighten my 90 year old mother...

    Yeah, people, do not cave in with fear to their illegal extortion techniques.  I am a process server and without being served, their "summons" is worth less than the paper it's printed on.  Sure, they can serve you via publication (newspaper), but it's expensive and most won't do it.  If you have been threatened badly enough, contact attorneysforconsumers.com or fairdebtlawyers.com and sue the hell out of them...

    This company will tell you that they are NOT a collection agency: they are. They called my relatives about an alledged 9 year old credit card debt and said they had litigation papers against me. Do not let them threaten you in any way. File a complaint with the FTC, which you can do online, and with the NY Office of the Attorney General - 144 Exchange Boulevard, Rochester, N.Y. 14614 - 585-327-3240.  The address for Fredricks, Goldstein & Zoe is 44 Bristol St.  Canandaigua, NY  14424. Pheone #'s 866-949-9484, 888-234-4685, fax 716-580-6080. These people will not give you this info on the phone, they only want to harrass you on debts that the statute of limitations is up on, or a debt that you do not owe. They are bottom feeders. In filing a complaint myself, an employee from the NY State Attorney General informed me that there are numerous complaints against this company that they are investigating. So by all means, please file one. The more the merrier for us, and the deeper the trouble for that agency.  Do Not be intimidated by them! There is nothing they can do except be a nuisance. Tell them you have no knowledge of the alledged debt, and do not give them your SSN. Tell them do not contact me or my relatives again, and then file your complaint. They need to be shut down.

    Called today at my house and my fathers. They called from 866-949-9431, ext 177, lady named Patti Mason.  I wasn't home but they left a message, so I goggled them.  Thanks to all who posted something.  I won't waste my time calling back and have passed this info to the family.

    I just filed a complaint against the company with the New York Attorney General.   Sadly, my state has done away with our consumer protection division as of July 1 or I would have filed there as well.

    Randy Mason of Fredericks, Goldstein, & Zoe called and left a message on our answering machine.   He claimed my husband had 48 hours to contact them or they would issue a summons.  He left a case number #194983 and said it was for our county's civil court.

    I called the court myself and found there is no such case.   The numbers given are not even close to the standard for our state.

    I also received a call from my mother who lives in another state she was contacted by the same man and he was threatening her.

    Depending on YOUR STATE LAWS - you may not have to tell them you are taping at all.    If your state requires that you disclose to the caller you are taping and you do not tell them - you cannot use the tape in court as evidence.

    The original creditor sold it!  

    yes - even though it was discharged in BK, the original creditor sold the debt and this is why you are now receiving collection calls on it.  

    So basically the OC says screw you, you filed BK, so we'll let the collection agencies have it.  
    I guarantee this is not the last time you will hear about this debt -once this CA realizes they cannot collect the debt - they will resell it again to another one - this will happen over and over again!

    CONTACT YOUR SENATORS AND CONGRESSPEOPLE AND DEMAND THEY BAN THE SALE OF ALL DEBT!

    THE NY AG IS REALLY COMING DOWN ON THE COLLECTION AGENCIES AND ITS ABOUT TIME.  

    He just overturned 100,000 fraudulently obtained default judgements - because the CA/JDB/Attorneys used a process server company that only pretended to serve summons on the people being sued.  
    You cannot show up for something you knew nothing about!  

    If you fail to show for court - they get a default judgement - even though they have no debt validation and cannot prove a damn thing in court.  

    Which is another area that needs to be fixed.    

    The courts should be demanding validation of debt first - even if the person was a no show.  These bottomfeeders walk in expecting to be served a judgement on a silver platter without ever proving they have a legal right to collect the debt they are suing on.  THEY use falsified/perjurous statements in pleadings and have no documentation to back up these claims -

    Got a threatening call today 8/17/09 - on my answering machine so they recorded themselves! - for a person who I don't know.  I've been receiving calls to Tamika Cheese (?) since I took over this Time Warner phone number in February.  Most are very pleasant when I explain to them I'm not her, never have been, etc.  So today I called back and the person I spoke to wanted MY personal information. When I said they certainly didn't need my info, he started yelling at me, saying 'he was trying to help me'! and if I didn't change my attitude he would terminate the call - ha!  I told him if he called again, I'd get an attorney and I then terminated the call.  They also indicated a local County Court system so I called the Court and told them what happened - now they are looking into it.  

    I also called time warner who turned me onto this site - thanks to you both!!!!

    This very similar to the call I got -  but it was Samantha James , 1-866-949-9484 x 152 court # 131714.  But exactly same details - threatened to issue a summons.  Good luck - the person they're looking for isn't even me!!!  They claim they are the law firm of Fredericks, Goldstein and Zoe.

    They said they were looking for my ex, that she had given my number and was wanted in court.
    Mr Danuals from there told me he had a court order from where she lives, and they really wanted her boyfriend.

    It's called Accuriint in case you people don't know all collection agencies have access to this. They type in your social and it lists all your addresses you ever had, where you work, relatives and possible associates. It basically tells your whole life story. It's just like your credit report.

    Now for the people who don't update there info as far as addresses and new telephone numbers, it's your fault that these people call your relatives. If you kept your phone number up to date an accurate, then they wouldn't have to call family members to get to you.

    I'm not saying that them harassing you isn't wrong. I'm just sayin most of the things you are complaining about you could have prevented. Think about it.

    And as far as the employee who left that comment, he's right. I work at the unemployment office located in New York. They have fired at least 50 people in the last 3 months over comments and threats bein made over the phone. There company makes all employees take the FDCPA. If an employee breaks that law, the person harassed can file a law suit, but the company is not responsible. The employee is. This is why you need to be sure when dealing with any collection agency to ask who you are speaking with and what is there ID number and or ext#.

    As far as the debts that the company paid for you, should blame your original creditor for that. There should be a law where if the debt is out of the statute of limitations, it should not be able to be sold.

    These companies just don't stumble upon your info or look it up in the phone book. It is your personal info that is given to them from the original company which whom you're in debt with.

    If you get a call all you have do simply do is ask who is the debt with. Ask them to send you a letter. Once they send the letter, you can go from there. When companies sell you debt, they don't like for you to be able to track them. They only pass down the original creditor company name, account name, account number and SS#.
