- Kat| 1 replyThis 877-204-2710 called my home today, at 9:58AM. Caller ID said “Toll Free Call”. According to complaintwire.org this is Bournview Recovery Group (BRG) Fraudulent Collection Agency, seems to be running a scam attempting to collect fraudulent debts. According to the BBB they have an F rating, since 60 complaints were filed against business and Failure to respond to 50 complaints filed against business. According to complaintsboard.com, they are very rude and threaten legal actions if you refuse to play their game. They buy personal information and then use it to make false claims, assuming the person called with believe what they are saying. It is called the PayDay loan scam with other companies and you can Google that for more info. The BBB has this address B R G Collections, LLC, PO Box 1927, Roswell, GA 30077-1927, 706-716-3057, BUT the one they tell you is a P.O. Box in New York. Their website bournviewrecoverygroup.com has 5999 South Park Ave - Suite 209 Hamburg, New York. One person called the Hamburg Police (716) 649-4501, the leasing agent for their address and the UPS store to confirm this. They also called the FTC (877-382-4357) and filed a report - something I encourage others to do as well. Lastly, since they have purchased info, a fraud alert has been reported on all credit reports (800-680-7289) and the New York Attorney Generals office (716) 853-8400 who informed me that they are "already aware" of this company and investigating them. Another person call back the number and received a "number is disconnected" message, so they are blockers and spoof-dialers. DO NOT answer when they call, and if you do accidently answer, DO NOT give them any information. Another lady is even warning people oin her FaceBook. I am sure they have a block of numbers they call from.

You need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (think of it as the best $6.59 you ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. A search for a business registration under Bournview brings up no results in either Bizapedia or the New York Dept. of State. This would preclude them from legally conducting business.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
