- lena replies to FrustratedThese people have harrassed me as well and i do not owe them anything. I am going to file a complaint iif i get 1 more call but like i told him i won't pay a loan that is not mine. Also every1 ....there is a statute of limitations on this. It is diifferent in every state..here it is 3 years. They are scammers and bullies n need to be taught a lesson.
- Nothing but the truth replies to Rebecca| 2 repliesThese folks called me a couple of days ago and again today. It went to voicemail but he identified himself as Tony Marquette saying that a complaint has been lodged against me, that no civil charges have been filed YET and that it was in my best interest to call them ASAP to settle this matter. He was speaking in a very threating tone. I was like "What the heck is this all about...dude you are talking to my answering machine?! There is no need to be nasty". Needless to say, I don't plan to call him back. I have no desire to get talked down to. Then I get another call today via voicemail from a woman (she did not ID herself) but it was the same number. This chick even repeated the last four digits of my SSN. She said that papers were being drawn up and sent to me and my employer so I needed to call them back. I was laid off about a year ago so good luck with that! Anyway, from reading the other post, this sounds like a payday loan collector. To be honest, I only borrowed maybe 3 times several years ago… maybe back in 02 but paid them back as scheduled. Isn’t there time limitations as to how long you can make attempts to collect on a debt? I don't owe anything so these fools need to stop ringing my phone!
- Nothing but the truth, here again replies to Nothing but the truth| 1 replyI forgot to mention that this Tony Marquette character was calling from Rosenthal, Levine & Associates, 877-252-0491. The caller ID showed "Collector 1".
- Make em' stop! replies to josieInform them verbally AND in a certified letter (so you will have evidence the letter was received) that you dispute this debt (valid or not) and as per the Fair Debt Collection Practices Act they can no longer contact you. If they continue they may be prosecuted for harrassment. If you don't want collectors calling you at your place of employment, you can instruct them not to call you at work. They must abide by this order or they may be in violation of state and/or Federal law. The certified letter should include your name, account information if available, and instructions about when, where, and how they may contact you. I did this to a creditor (yes it was a payday loan) a while back and instructed them that they could ONLY contact me via US Postal mail. The calls stopped.
Or simply stop answering the phone. Check caller ID, if you don't recognize the number, don't answer let it go to voice mail. They will eventually stop. Companies have to pay these callers to harass you. If their efforts don't bring results, they are wasting money.
For laws and rules on how often and when collectors can call you refer to the Federal Trade Commission's (FTC) interpretation of the Fair Debt Collection Practices Act (FDCPA), Section 806(5). - Hum... replies to FrustratedThat address is for a Deli restaurant in CLEVELAND, OH.

These Rosenthal folks are a mess! They can huff & puff all they want to... DON'T PAY THEM ANYTHING! - To pay or not to pay replies to standupforthosewhocannotYou do not have to pay debt that is considered too old by your state. Every state has laws governing the time in which a person or entity can file suit to collect a debt. Generally, a creditor or debt collector gives up his right to file suit to collect a debt after a period of six years from the time the debt was written off (or the date of last activity on your credit report), but various states allow anywhere from 2 to 15 years to collect delinquent debt (see statutes of limitation table below).
The purpose of these statutes of limitation is to bring some measure of fairness to the debtor so that he / she (1) will not have to worry about being sued for the rest of their lives; and (2) so that the debtor can properly defend himself with fresh evidence and witnesses, if any.
This doesn't mean that a creditor cannot file suit against you after the statute of limitations has expired; however, if a creditor or debt collector does file suit, you can ask the judge to dismiss the suit on the grounds that the statute of limitations has expired. In fact, if the statute of limitations is about to run on debt you owe, don't be surprised if you suddenly hear from a collection agency threatening to sue if you don't pay immediately.
If a debt collector contacts you regarding an old debt, do not admit that you owe the debt and do not agree to make any payments. Simply tell them that the "statute of limitations has run on this debt and do not contact me again". If they continue contacting you, send them a certified letter, return receipt requested, telling them not to contact you about the debt again. Remember -- DO NOT ADMIT THAT YOU OWE THE DEBT, DO NOT AGREE TO PAY THE DEBT, AND DO NOT AGREE TO SEND ANY MONEY TO THEM. If you do, then the statute of limitations might start running all over again, giving them the legal right to sue you. - danoMy sister received a call on may 26th from Rosenthal Levine and associates stating that charges were going to be filed against me for theft of services and I needed to call 8772520491. I called and they said I owed 1,200 dollars for a payday loan through flex checks in sept of 06, I never boroughed an amount more than 400 dollars from flex checks, and the place went out of business before that date, I Called the number and they said they would settle the account for 500 dollars, I just needed to give them my debit card number, im not going to give them any of my banking information, when I asked why I received no letters or documentation of this whatsoever. I sent them an email after they emailed me this sad looking arrangement to pay letter, I told them I would not give them any info about my bank account, and that I will be filing a complaint with the attorney general. I don't know what is going to happen, im waiting for a phone call from them, which im sure they'll call again. I do know that theft of services is a criminal charge and not a civil charge so why would they tell my sister that? My sister works for an attorney and I will be checking in to this matter. If I do owe money to Flex checks I want to take care of it, but I will not give anything to this Rosenthal Levine company, if any knows how I could resolve this please let me know

- KarmaI suspect Marval &Associates is changing their name , I suspect it is an attempt to hide. Marval &Assoc has been under investigation for two years now with the State Of NY due to various violations of discrimination, in all of the pre trial actions Marval & Assoc were a no show. At trial they again were a no show. I'm sure they feel they will hide their assets, change their name and nothing will ever come of things. They are so mistaken civil fines per violation (there are 9 total) is 900,000.00. Damages, pain and suffering, punitive damages, as well . Not only do they treat their debtors with no respect. They treat their employee's even worse. It's a matter of public record anyone can call and verify (718) 741-8400.

- How'd they get my numberJust a got home to a message left from this number the message says our number was left as a contact for one of my co workers who is also a Facebook friend. I think they search this person on Facebook and are calling all her facebook friends to embarass her into calling them back. Man the great age of the internet and Facebook. Only other thing I can think of is she gave them my number as her contact number but don't think so cause I have never before got a call for her. This company is clearly violating the FDCPA anyone that has business with this company needs to report them to the FTC and also inform them they are being reported. Glad I don't have this type of problem.

- JohnDon't send them any money. 877-252-0491 They are not even a legal collection company. After talking with them you can tell they are probably former convicts, seedy, lower level, kind of people.. I called them back and ask to speak to someone and the guy who sounded drunk said he was the the Director. I said you've got to be kidding me. I said if your really the director then I know this is a scam. What a bunch of loosers. I just really hope these kind of people don't have children. I've reported the # to the Attorney generals office and they are going to call them back.
