    That's not a form letter, it's a very specific one taken wholesale from some other place, the upper half discussing someone else's problem with a different collection agency. The lower half is certainly boilerplate lifted from one of many ill-conceived "porcupine mode" dispute letters which in fact hinder invocation of a person's rights.

    You don't want "postal mail and/or email". You want real ink and paper. You want the accountability of physical records. Explain "the debt and to whom it is owed"? Maybe no one owes it. Maybe you don't want to admit anyone could. Spare me the linguistic puffery and idle threats of the fourteen places you'll complain. The State Bar too? They (should) regulate attorneys. Are you writing to a lawyer?

    Debt collectors are unmoved by your fist-waving. They know who regulates them and by what authority. They understand money and whether they can get yours or lose theirs to you. They need not read anything much more than "I dispute, please validate, no phone calls" in a timely manner to enforce many of your FDCPA rights. Let them find out how dangerous you are later, after they've broken a few laws and you draft a civil complaint.

    If the debt is not yours, they cannot, by federal law, give you ANY information about the person the debt is owed by (or claimed to be owed).

    Who Is Considered a Creditor under the FDCPA?

    The FDCPA defines a creditor as the person or entity that extended you the credit in the first place (original lender). Since the FDCPA is designed to protect debtors against third party debt collectors, it does not apply to an original creditor or its employees.

    However, there is an exception to this rule. When collecting its own debts, a creditor will not be exempt from the FDCPA if it uses a different name that implies a third party is attempting to collect the debt.

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    That's fine. Although it's not a reason for me to stop posting the info I do have. I've never claimed to know more than Res and never will. There is no harm in posting information that is worded differently or includes (or excludes) information in his/her posts. There is no harm in repetition either. Sometimes that is exactly what people need so they can protect themselves. I'm also thinking of those who may read the thread (and other threads) at some point in the future.

    It's no skin off my nose if my help isn't wanted. I can leave just as quietly as I came. I'd rather not but I don't stay where I'm not welcome.

    I don't have a problem with others attaching useful or related items to my submissions. I don't view those as direct "replies" if it's obvious I am not being addressed.

    I would point out that early in February Admin had cautioned against repeatedly posting detailed boilerplate, even if for a benign purpose, as over time such practice can fool search engines into thinking they've detected spam. Admin raised the same concern a few years ago when frequent user Lamet was found putting up "circus posters", as Lone Stranger quipped, of borrowed content and links in too many threads.

    Boy are we being defensive.  I was simply pointing out that you were replying to a person who who is very well informed on the law.  Since you are new here, I simply figured that you didn't know who he was.  I am not sure where you got the idea I didn't want you to post here.  I see nothing in my reply to you that says that, nor was that post in any way disrespectful..

    Thank you Res. You are right, it wasn't intended as a direct response. None of my "informational" posts are. I've simply been trying to insert important info where it looked like it was needed, trying to cover as many bases as possible without posting tl:dr.

    Thanks for the info. I hadn't needed to use the site in a very long time so I had no idea what had occurred. I will keep that in mind from now on. Thanks again. :o)

    Triple-B cannot "close down" anything. It has no law enforcement power. It's mainly a glorified chamber of commerce, one known to accept payola for higher grades.

    I think this is who keeps calling and when I answer, they hang up. Never say a word so likely if we argue and say we never received a call, they can dispute that. I have no idea who they are honestly. I have also been questioned regarding whether I know someone that I truly do not know. Then when someone asked for a guy and I said obviously no, I am not that person since I am a female and you are looking for a guy. They rambled on rudely about how they would have no idea.
