I received a letter from this company Friday. They also, called this morning. It is for a bill of nearly 1000, to a doctor I have never heard of. He is in a orthopedic surgeons group. I have never been to an orthopedic doctor in my life. I guess I will reply back to the letter letting them know they have the wrong person.

I am an HR manager for a large firm in Knoxville. These folks call me at least twice a day wanting to "verify" employment on someone or leave a message. I have repeated told them that when they fax me a signed release from the employee I will release information to them but nothing until then. They won't fax anything and continue to call. I have reported them many times and finally told one gal from their not to call us back.....that lasted two days and then the ringing began. Reporting them does no good.

    Target acquired.
    Boom!
    Roasted...

Just another FDCPA case waiting to be filed.

Those messages that that this company leaves:
"This message is for "x". This is "y" calling give me a return call. The number here is 888.592.3359. Thank You."

    Is wholly violative of 1692e(a)
"(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action."

Pretty sure a voicemail is communication.
    Foti v. NCO Fin. Sys., Inc., No. 04-CV-707 (KMK), 2006 WL 779774, *9 (S.D.N.Y. Mar. 25, 2006).

And that the voicemail lacked the disclosure required under subsection 11 and can be construed as deceptive and misleading

communication applies to information conveyed directly or indirectly.” See Hosseinzadeh v. M.R.S. Assocs., Inc., 387 F.Supp.2d 1104 (C.D.Cal. 2005).

Regarding disclosure the Foti court again said:“just because a debt collector is permitted . . . to attempt to collect [a] debt does not entitle the collector to use any means, even if those means are the most economical or efficient.” Id. at *9 (citing Clomon v. Jackson , 988 F. 2d 1314, 1321 (2nd Cir.1993)).

regarding the so-called “mini-Miranda” requirements), finding that the mere identification of the collection agency by name (when that name did not reveal the nature of the agency’s business) in a subsequent communication was not enough to allow a “least sophisticated consumer” to determine that the pre-recorded message was in fact from a debt collector.

Seeing as NCO at least announced the company's name, they evaded the other liability they would have picked up under the TCPA 47. U.S.C. 227 and 47 C.F.R. 64.1200.

These guys break both, and are being sued accordingly.
To date (Sept 12, 2011) there are 5 federal cases naming them as defendants, and who knows how many state cases.

...Just helping clean up the industry, one entity at a time :D

Have called my google voice number at least twice in the past week and left a message...

Tempted to spin up another google voice number to find out what this is about. Never used the number for anything so guessing they might just be randomly calling the number or someone else had it 3-4 years ago.

A woman called from this number and stated that she wanted to speak to my teenager Daughter.   I told the lady,  I was her mother and she told me that she wanted my Daughter to call her at the number she called me on.   She also acted secretive as if she could only speak to my Daughter.   I gave the phone to my Daughter for her to call them, as I listened.   She called and they gave a past address to my Daughter which my daughter did not remember, so she said it wasn't her, and they claimed they would remove this number from their records.   I then, called them back and told them I was the mother and they asked for me to verify my info that they had and I did.    After investigating, they claimed that they found my account to be paid in full as of "2010".    I find this whole situation a little weird.

Tell them you only verify by fax. Don't tell them if the person works there or not. Then when they send a fax send it back and say you only verify with written approval from the employee. Make them work for the $ and they will finally stop. Someone told me this and I have been doing it. Worked for me :-) They do not want to take the time to complete and send fax paperwork.

At first this morning I received a call on my personal cell phone using the number 888-582-3359. I usually do not answer calls that I do not recognize. If whoever left a voicemail I would have called back with any number I do not know. But no voicemail was left, instead a minute or two later they called my place of business, which is inappropriate in itself, because it could jeopardize a person’s job. It was me that answered the phone, and they did ask for me, but I did not state who I was, I just asked if I could take a message. All the woman would say was they were from RRC, and I asked what that was and all she said it is in regards to a personal business matter and gave me the number and asked for me to return the call. The people need to say who they are, what they want, and be courteous. If they run a true business or work at a true business that’s how they should be. I work for a state agency that happens to be a law enforcement agency. If they keep it up I can go after them for harassment, and soliciting at a place of business/ state agency.
