    I think avoiding people is wrong but when you try to work things out and come to a agreement on a amount that it should be accepted the first time.  When people are saying they are calling and there is no one there by that name it is never okay for the company to give the person that answers a hard time.  i am still enrolled in college and I am being asked to pay $4000 for a semester that I wasn't even in attendance for.  They wanted my personal information and I will not be submitting my checking account number or any of that to have them take more money then what is owed.. I will mail a payment just as I pay other bills.

    They are creepy and annoying.
    They've called several times over the past few months-- anytime between 6am and 11pm Eastern Time. They breathe really heavily 3-6 times, don't respond to anything you say, and then hang up.
    The first time they called at almost 11pm and my wife answered- she was home alone while I was in training (Fort Drum), and the creepy breathing really scared her.
    The number doesn't show up on our caller ID, but does show up in our Verizon phone log.

    I was a debt collector at Wells Fargo. If you don't want a debt collector to call your cell phone, tell them that it is your cell phone and they are not allowed to call it. Make sure to express that about your work number.

    Williams & Fudge is attempting to collect a debt of $193 that I know for a fact isn't mine. I graduated with my BA nearly 20 years ago before I married for the first time. My parents and I paid for my schooling out of our own pockets. My parents covered tuition and allowed me to live rent free. I just had to cover my books and supplies. No loans or grants. My first husband unfortunately passed away and I remarried 8 years ago.
    Last week, I received a call from a woman named Denise looking for my first married name. When I asked her what this is in regards to, she wouldn't tell me who she worked for and would simply state it was about a file she was just assigned. After she refused to give me more info, I hung up on her. On Wednesday, I received a letter from Williams & Fudge addressed to my first married name saying I owe an online university $193. I immediately sent out a validation letter CMRRR disputing the debt. Once Williams & Fudge receives that letter, they cannot call me until they send me proof of the debt. I can sue THEM if they do. I never attended an online school and even if I did, any debt incurred under that name is too old for significant action to be taken.
    Friday morning, I received another call. I knew they hadn't received my letter yet, so this was legally "okay." I stated to Mary that I would be recording the call. She seemed very hesitant, but agreed and started her script. I allowed her to finish, then I politely informed her that I had already sent a validation request via certified mail and any further contact after this call before they validate would be violation. She was quiet for a minute, then claimed her supervisor had informed her that I am violating the law by recording the phone call. I quickly told her that Florida only requires I tell you I am recording and that all further calls will be recorded  and any calls before my debt is validated will be used as evidence in a FDCPA lawsuit. Then I hung up.
    There are many laws that protect you from debt collectors. Even if the debt is yours, collection agencies must follow the law in collecting them. Yes, you can record phone calls. You just sometimes have to inform them you are recording. Request proof in writing using certified mail, return receipt requested. Dispute items on your credit report if they are incorrect. If they confirm them, send a method of validation letter. You can actually sue the credit reporting agencies AND the collection agency if they continually report incorrect information. Again, you can do all this even if the debt is yours.

    Florida is a 2 party state, and by informing her that you were recording her and by her continuing at that point, you were covered, as long as you telling her was on the tape.

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
