Jessica Sanders called from an anonymous number (which we never answer) stating she had legal documents for my husband scheduled to be delivered on Monday 5/21.  She called back within seconds stating that my name was listed as an emergency contact and if I can call 855-816-8637 to schedule a delivery time for the legal documents from Johnson Smith and Associates. She even gave a case number.  Has anyone else had this kind of call?

I have just received the same type of message. They even called my husband. This sounds like a scam.

Same thing happened to me... received a call on my cellphone, “No Caller ID”. “Ann” with Johnson Smith and Associates saying they had legal papers to serve me and wanted to know if I or someone over 18 would be at my home to accept them, as she wouldn’t want a default judgment placed against me if they were unable to serve me.  When I asked what this was about she told me she couldn’t tell me and that most people already knew what was going on in reference to her call.  I told her I had no idea.  She gave me the number to their “legal department“ and told me she would place a 2 day hold on going forward with the service.  I called the number she gave me,
855-816-8637, and told them someone by the name of “Ann” told me to call them about a case against me.  They said they had an “Ann” in the building downstairs and then forwarded my call to “Andrew” who after verifying my name and the last 4 of my social that HE provided (don’t anyone say it, I know), told me I had defaulted on a credit card with Bank 1 that I (supposedly) had opened in 2002 and suddenly stopped paying on in 2006 or 8 (I can’t remember when he said I supposedly quit paying on it).  He said this card was issued through a “federally insured bank” and therefore I had to pay it or their client would proceed with civil action. When I told him I didn’t know anything about this card, he got all up in the phone telling me there was no way I didn’t know about it because no one pays faithfully on a credit card for several years that they didn’t know about!!!  It definitely didn’t go well after this.  He did nothing but talk over me and anything I had to say.  The phone call ended very badly with both of us calling each other ugly names before I hung up on him.

You will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested).  Also send it first class mail in case no one will sign for it.  Make a notation of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):  http://www.consumeradvocates.org/

Everything else you need to know follows including at least two agencies where you should report their criminal activities.

Website says they are in Massachusetts:  http://jsmithassociates.com/index.htm
Website was created in March of 2017 according to Whois.
The BBB has no page on them under that name
The address is a UPS store, but another criminal debt collector by the name of Receivable Management Corporation aka RMC is listed at that address with a “suite” number
They are not registered under that name with the Massachusetts Dept. of State or registered as a debt collection agency, which legally preclude them from doing business.

    Other complaints:
    https://www.avvo.com/legal-answers/contacted- ... 31-2391468.html

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.

I just received the same call and message on my unlisted home phone. Before googling this phone number they listed in their message, I googled their name Johnson, Smith & Associates and a whole bunch of sites said these people are crooks/scammers;  they are not a legal company, give a false address, and they also give several different phone numbers to call besides this one, etc. They said someone will be here at my home sometime this week for me to sign for their papers. I'm 71 and wondering, has anyone had someone actually come to their house? Since I'm older I don't want to have strangers coming here and I don't owe anyone any money. Also, I don't want to stay inside all week! I appreciate your answers..

Three days before yours, a couple of dense posts arrived which indicate both right and wrong ways to collect a debt. Ambush phone calls with demands to "pay up or get served" are not part of the "right" plan. Nikki didn't know any more than you of how debt collectors should behave. Maybe some homework will dispel the fear.
