The amount of money it cost me to retain an attorney to appear with me was more than it would have cost me to settle my debt. May take them some time to get you in court, but your day will come. - mikeHave been receiving harassing calls every day from Kingman Cole and Associates. I received a call last night from Russ Peterson who claims to be an attorney in the State of New York. He became extremely discourteous in that he called my husband a *ussy, he called me a [***] claiming that he was going to sue my husband. My husband is disabled and has been out of work for over a year. This Russ Peterson is a foul-mouthed, rude, obnoxious individual and if he is in fact an attorney in New York, then I feel sorry for the New York State Bar having to certify this creep. I told them that I would see them in court, however, they would not give me an address to contact them. After I hung up on the individual, he continued to call back from (716) 689-4369. He continued to call today, so I had my number changed. If this continues I will contact the State Attorney General.

- Mike replies to BearOk this saga gets better and better by every day. I recieved a phone call from John Preston from Kingman Cole, who long story short told me that MAZE is no longer in business and they are holding my debt now. The "John Preston" that I talked to said that he was in the "Litigation" department. Today when I called there were 2 John Prestons. And the one that I spoke to was in the "Payment Department" then later on in the phone call was in the "Investigations Department" One who is an attorney and one who was not. John H Preston is the attorney, and John Larry Preston was not the attorney.
The person who answered the phone said his name was Mr. Johnson. I asked for his first name and he actually stumbled trying to think of one. The best one he would think of was John Johnston. I dang near peed myself.
Oh yeah, and for anyone who actually believes ANYONE who posts on here saying that MAZE sucessfully sued them needs a smack on the head. These people are not for real. They are wanna be collection agents.

- HaveDebt| 2 repliesI am severly in debt due to a divorce from my ex-wife. I rec'vd a call from Joe Ciccero who advised me about the debt that I had and was very pleasant with me during the duration of my collection call. Mr. Ciccero advised me that he was not willing to take my payment without me first getting my documentation faxed or emailed to me. I chose email. I received the email in timely fashion and as well the portion of my CBR that stated that this was a vaild debt with the bank. This account was still in statute and it was something that she obviously took out without my knowledge. Mr. Ciccero advised me that I owed $1455 and eventually settled for $850. He was not trying to extort money from me. The debt has been paid and my credit report should be updated in April 2008 for this, of course, I will do my follow up to ensure that this agency does its checks and balance. Mr. Ciccero had a great rapport.

Kingman & Cole are an upstanding agency who has a tough job to do....just as I have an obligation to landscape my clients properties, I also have an obligation to pay back what I owe...I am leaving this post on this site because there is a cloud of negativity over what these people do for a living. My bottom line is that it is easy to slander bill collectors for what they do but if, just as in my case, you avoid or prolong fulfilling an obligation that you have to a bank isn't it there obligation to contact you until you take care of what you owe??? I think that the reason why these people have a bad name is because of people like myself who are trying to find blame in what is really our responsibility and our problem
- You should sue him replies to lazypandabearHire yourself a lawyer, and go after this SOB! This guy has broken so many laws under the FTC rules of collections you can take him to the cleaners. First of all he can sue on past debts, but only in the State you are in. He has to file the lawsuit in the State you reside, not the State he is in. That cost money and lots of it. Second, you have rights read the Federal Trade Commission’s handbook (FTC google it) on under the fair collections act there are steps and boundaries that collectors have to follow to collect a debt. I think if we understand our rights we can better respond to these con artists and take legal action when there is cause for it. The FTC rules are there so people like these cannot harasses you for the rest of your life.
First to do when they call:
1. DO NOT SEND MONEY
2. Ask for a physical address: They ask why? Say, its to send them a “certified letter” for “proff” the original debt with your signature on it. There are other criteria they have to meet, it can’t be just any old piece of paper with numbers on it. (google sample letters to send them)
3. Record their phone calls with them if all possible. This can come in handy if you are filing a legal complaint or filing a lawsuit against them. - KNOW THE LAWHere's the do's and dont's from the FTC Website:

- Shelia--ArkansasGot a call from James Jones @ 11:30 am asking for Shelia. I was @ wk & my friend gave me the message to call 1-866-345-4590 ext 125, case #129053, Kingsmen Ass in NY. I was so busy @ wk that I never called. I found out James called again @ 7:30 pm, asking for me, I was still @ work. James said I never called & he was going to get the police involved unless I called him. My friend picked me up & relayed all this crap to me & wanted me to call Jaames. When I got home, I called him & he said I owed about $9,000 on an old credit card. I told him that that was settled 9 years ago when I filed bankrupt. He then said a few things & I told him that I would check him out & call him Wed. My friend told me that James, on his 7:30pm phone call that if he didnt give him my new cell #, that he was slowing the proceeds of his investigation down & that he could be held in comtempt & James would call the police out. I will tell him a few things Wed, IF I get him on the phone again. He may have moved by then or got a new phone number. Ha, Ha,, gotcha..

- cindyCalled them to see if I could get official address (even though they are listed) but no one would speak to me unless I had a specific extension number. I have left a couple of messages regarding the info, but no return calls. I'll send cease and desists to all the addresses listed.
I guess my question is if they are so friendly and reputable why are they so hesitant to give out an address? My charged off credit problems are over 10 years old, so I can't imagine that it could be valid.

I clearly gave my name, my phone number, and asked for the mailing address.

Last time I checked there was Free Speech in this country, but not on this blog...I see that mine have been deleted, sorry that I can admit responsibility or irresponsibility for my debts, all you people on this site are trying to find away out of yours. Admit one thing, you are professionals. Professional Debtors. Here's a piece of advise, and it comes cheap, if you are trying to entrap debt collectors for doing their job when they call you so that you don't have to pay your bills then I suggest you get a second job (like I have), save up your pennies, it'll take 15000 pennies, and go file Chapter 7 or 13. Congratulations you just abolished your debt responsibly, especially if it's your first time doing it because you'll never forget your first time.

It is funny how much you want to appear to be righted from your past wrong that you must speak out against everything said against this company, including many legitimate cases of harassment and invasion of privacy. I, for one, have no debt, but keep receiving calls from these people several times a day. They are looking for someone else who was known many years ago, not anyone at my house. Even after speaking with them several times, they will not:
1. Stop calling my house
2. Provide a physical address to reply (they either hang up or forward to their "attorney's" voicemail
3. Act in a professional manner
If you call and ask for a specific person, they refuse to connect you, thus you speak to someone different every time. I have referred this case of harassment to my attorney and local police. If they were legitimate, they would respect the laws of privacy and follow the law (that they pretend to so diligently enforce).
They come across as a group of thugs constantly pretending to be someone that they are not. Follow much of the advice here. If you have debt, contact your attorney and work it out through them with the collections agency. The First Amendment of the Constitution forbids Congress from "abridging the freedom of speech". The Constitution, however, says nothing about forbidding the owner of a website from deleting any damned thing he wants to delete from his website. So to suggest that you have a constitutional right to not have your posts deleted online is silly and just plain wrong.
One more thing -
If the 800Notes webmaster was, as you put it, "diseminating [sic] the posts that have been placed on this site," then that means he would be spreading or replicating the posts, rather than deleting them. (Grab a dictionary and look up the definition of disseminating.)
The moral of the story: Don't invoke rights that you don't have and don't use words that you don't know.
Here endeth the lesson. - Lou Fernandez| 6 repliesI received computer call from Kingman Cole today. Called them back and was told I owed on a Bank of America debt. I've never had a BOA account. Gave the last 4 digits of my social to confirm if they had the right person and they said it matched. I said no way, so they threatened to sue me and issue a warrant for my arrest if I didn't show up to court. I called BOA and conferenced in Kingman Cole. BOA confirmed I didn't owe them anything. New person at KC that BOA and I were talking to confirmed the SS # they were collecting on was different and that they wouldn't call again. He said he would "speak to" the individaul that had harrassed me earlier who he identified as Mr. Haley. We'll see . . . I get this type of call all the time on accounts I've never had. I usually I just have to provide the last 4 digits of my social and they go away realizing they have the wrong person. I have a common hispanic name so it happens frequently. This time, however, they went too far.
