They are also powerless if the statue of limitations - between 3 and 6 years - has expired. Collectors are just bullies looking for victims gullible enough to take their empty threats seriously. Ignore them.

Statute of Limitations...ck it out!! - I hear ya! replies to SandyThey are calling me too. Check into it deeper. The statue of limitations allows for debts over 3 years with nothing done - I think it's 3 years - to be not legit anymore. They are only threatening you. If they were you would get paperwork from your local Sheriff or someone like that. Even when that happens and it WON'T from this "pretend" company, you still have days to take care of stuff. Usually 90. I don't think you have anything to worry about. They just want to make money on an account that they probably paid a dollar for. Seriously! No sweat!
- Scam Artists!!!I hope that I have a lot of room to write. Someone calling himself " Kevin Kaufman" called my mother in law two weeks ago about an old credit card of mine. It defaulted in 2004, by the way. He told her that she was on the account, Kingman & Cole had bought the debt and that he was about to freeze her credit lines. She basically told him off then he called my home number. My number is unlisted, by the way. My husband answered and "Kevin" started in about a card of mine from HSBC that had been isuued to me in 1999 to an address in Oklahoma. I haven't lived in Oklahome since 1990, so that immediately waved a red flag. He went on to say that if they didn't get the money that day I would be sued, my husband's wages would be garnished, etc. Well, we know the federal and state laws which this imbecile didn't. As soon as my husband started grilling him he folded like a cheap suit. We thought that was the end of it. Surprise, surprise, today I get a message from "Chad Olsen a corporate lawyer for HSBC". He gave a US docket number and said a case had been filed against me in my county's "circuit" court. Our circuit court is in Nevada. The phone number he left and extension number were the same as "Kevin Kaufman". He then called my mother in law claiming to be an attorney in my home state. She laughed it off and hung up. Again he called me and my husband answered. He told "Chad" the facts: they had five days from the first call to contact us in writing and didn't. They claimed two weeks ago to have just gotten the debt but started running my credit report a month beore the first call. The credit card defaulted over four years ago and was uncollectable. "Chad" told my husband that he was so "knowledgable of the law that you think you don't have to pay your debts". My husband said, fine, send me proof that you own this debt. "Chad" wanted our e-mail address and my husband said no it has to be the U.S. mail. The conversation ended then a woman called who didn't identify herself. I answered this time. She said that the law in my state was five years to which I replied no, it's three years on open credit. I then told her not to call me again, they were scam artists and they weren't getting a penny. She replied, "I'm gonna call every day until your debt is paid". I hung up. She called back and left a message saying that they would "see you in court". Folks, I've been through the real deal with lawsuits with credit debt. They have to hire a law firm in your jurisdiction who then has to send you a letter. Both times I have sent a validation of debt letter to the attornies and the matter was closed. The two debts were removed from my credit report because they couldn't validate the debt. Both times it was a credit card debt which had been bought and was outside the 3 year statute of limitations. One fact you all need to realize is that Kingman & Cole are not attorneys!!! They claim to have bought MAZE but guess what name showed up on my credit report when they starting running it? Not our friends Kingman & Cole but Marshall & Ziolkowski Enterprises. Don't give these creeps the time of day, please. Don't let them upset you, they are powerless.

[***] LAckey - Just want 2B left aloneReceived a call from this company 3-4 time's and as far as i'm concerned they don't know what they are talking about because all my bills are current. The only thing I can think of "as related to fraud" is that my father remarried someone with kids, whose name was the same as mine, and has been proven that he' used my social security many times;' i've had numerous things' i've had to correct on MY credit that was used by this other person. NO I don't have anything to do with my father or HIM or anyone else in that family.... I wish I could change my soc. sec. number thou because of that. So it' is possible that regardless FRAUD can be an issue!

- LTillThis place called me today and left a long voice mail similar to what others are reporting. I've never had a legal problem or late payment so they will get no call back from me. Don't they have to mail you something??
- JohnThey called my house about my Ex Wife and that there was a warrent for her arrest. I took the number down and told them that I would forward the info to her. When she got it she did some digging and found out that this was a scam. BEWARE!

- Ms. Not-So-Stressed-Out-AnymoreI got a call from Kingman Cole and Associates today and they had me so worried and stressed out. My boyfriend suggested I look them up on the internet and I am SO glad I found this site. Everything they said to me has been posted by other people on here. They told me they were a Law Firm and I was being charged with fraud for an old $500 credit card bill. That I was going to get a court summons tomorrow if I didn't make them out a check for 4000 dollars today. But that since they were nice and consider me a 'Hardships Case', they would settle for $2000. Because if we went to court the fees would go up to over 7000 dollars.
After I read all the suggestions from the posts here, I called Kingman Cole and Associates back and asked for the 'validation of the debt' and a physical address. He got ugly then. Started raising his voice to me and ranting about Google. Why would he mention Google if he was legit? He told
me that he wasn't REQUIRED to give me their NYS Bar Number, a Physical Address, a Business ID Number or the Validation of the Debt, but since he was a 'nice guy' he gave me this address; 1416 Hon Rd. Suites #1, #2, #3, and #4. Amherst, N.Y. 14228. Huh. Fishy.
Once I mentioned a lawyer and the BBB, he just laughed at me. Basically telling me to bring it on. That I was only making matters worse for myself. Blah, blah, blah...

- SICK AND TIREDWell, I did a lot of research. I'm not going to let it all out right this moment due to an upcoming court case that is going to not only shut these guys down but have a few people end up in jail...Let's just say that the business rivals in that area "Williamsville" must not like these guys too much....It seems that Rich Ziolkowski, Keith Marshall, and another individual named Jason Buzak whom I'm told by a friend at a local bank there in the area are all owners of this possible empire. They have several offices in the area, all open in different names. However, people are starting to get arrested and instead of facing their own charges of extortion and racketeering on top of federal drug indictments, have started telling a lot of things. The most interesting thing my investigators came up with is that all of these companies involved with Keith Rich and this Jason guy "who keeps in mind tries very hard to keep his name off of things" maybe because he don't want his family to have to deal with all the BS...Anyways, all the open drug cases and other things are bringing a lot of thing to light....The one guy appeared to check himself into a rehab and during his detox started spilling the beans about a lot of fraudulent activities. Saying they falsely ran credit card payments, made up debts, and even said that the one office named Moreno and Woods, which is another company backed by these guys, is even stealing identity of people and making it seem they have debt and running credit cards in their name...Anyway, I can guarantee there are federal criminal charges pending against a lot of people in this organization....Did I mention that there are several people facing federal charges in regards to recent drug bust in the Buffalo Lockport area which it just so happens some of these people work for these guys or have made themselves partners ...Like I said, not gonna say too much at this moment, but I do have eyes on these guys and once it is safe, I will post more on them....The investigator assured me there is a lot, so stay posted.
- AnonymI rcvd a call from these guys today. First I was talked to by a woman who informed me of a debt from years ago that has since been AMENDED and taken care of with all three reporting agencies. When I told her that, she said she'd transfer me to someone. The guy that answered went immediately into harassment mode - siting my "outstanding debt" and threatening a lawsuit/arrest if I didn't pay my debt today. "Mr. Webster" was the only name given to me. I tried to explain again about how the debt had been handled and was no longer legitimate and as I was telling him, I was pulling the paperwork (from the credit bureaus) to review the information just to make sure that *I* had the right information - I did - but it didn't matter. He called me a liar and went right back into his verbal abuse and harassments. He was so threatening and refused to listen to what I had to say. He used vulgar, insulting language and proclaimed to be an attorney, that I'd lose my family if I was sent to jail - etc. His tone of voice and the things he said made me fear for my safety so I hung up. I called someone to come stay w/ me and during the time it took for him to get here - they called again and again and again. I decided to call them back and demand their company name, posing as a possible 'wrong numbe' caller - it took me nearly 10 minutes to pry it out of the guy on the other end of the phone - I finally did and hung up. These guys are dirty, rotten, scammers! They refused to offer me the name of a supervisor, an address, an employee ID number, a first name, or any further identifying information. When the phone was answered by someone else, the phone conversations were recorded - and were announced as such. Suddenly "Mr. Webster" refused to talk and demanded that he either speak to me or my attny. I have since filed grievances with the FTC, the local law enforcement, the phone company, the BBB, my attorney's office, the attorney general of my local state as well as New York, and various other agencies.
This was NOT a legitimate debt in my case - if it were, the investigation done by the three agencies would have come back as "updated" (as in the case of my school loans), not that they were "deleted". For those few of you who have flamed us as 'losers who don't pay their debts' you can GTH! For the record, I have always paid ALL of MY legitimate debts.- Caller: Kingman & Cole

I've been collecting for bank of america for 17 yrs & still find it amazing that whenever debtors are told they need to pay back the money, their immediate response is they are being scammed. Who's scamming who? If they spent 1/2 as much time working towards paying back what they owe as they spend trying to get out of paying bills, they would be rich. I can't believe people actually believe the stories on these type boards. I've read everything from debtors who cry harassment because they received a phone call, to ones who claim "scam" because they see the name of an agency they dealt with mentioned here, to the best one...the lady who said she was being scammed because she called & asked for a certain collector & was put on hold. She claims it was the same person who then picked up the phone & id'd as the collector she'd asked for. Are you people kidding me! You consider this being scammed & harassed???
Here is what I've learned about debtors in my years of experience.
1. It is never their fault. Even if they havent paid a bill in years, it's because of last weeks car repair or their 2 week lay off that they still can't pay. 6 months from now it will be a death in the family or the price of gas.
2. They would never borrow from friends or family yet creditors are expected to fork it over & get screamed at when payment is due. Geez, could it be that their F&F WON"T loan to them because they know they're deadbeats????
3. The ones whose vmail message ends with "have a blessed day" will never pay. They are the ones with the filthiest mouths who hide behind religion. What about "Thou shall not steal." Doesn't the bible say to pay your debts?
4. Being nice to a bill collector & responding to calls will get you a long way. If you don't want the calls & lawsuits, RESPOND! You'd be amazed at what can be worked out to YOUR benefit if you would just respond. Being rude & hanging up only fuels the fire. I have no desire to help anyone who is outright rude. Don't you realize that the same bill collectors that you are screaming at for "harassing" you because they dialed you number once & tried to help you avoid wage garnishment or having a judgement placed against you, are also the ones who have your social security number, know where you live, know where you work and have a list of your relatives AND neighbors. Think about it! Be nice!
5. The bill is always owed. The ones who claim they don't owe the bill always do. They know it & we know it. 22 year old debtors suddenly develope alzheimers. They really believe claiming no knowledge will get them out of paying the bill. Guarenteed they will have more than one deliquency on their credit report. Forgot'em all did ya??!!
6. They always have plenty of money to pay for their cell phones, satellite TV, internet. Why? Because they get everything else for free. They charge up thousands of dollars & don't pay it back while living the good life. In the meantime, the rest of us working stiffs end up paying higher interest rates & taxes. Again, who's scamming who?
7. Being old will not get you out of paying your bills. You were on a fixed income when you took out the credit, you are still on a fixed income. Pay your bills. Atleast you know what you have coming in month to month. Most of us don't.
8. Debtors will post on boards like this as a way of "cleansing" themselves. It's like therapy for them. They accuse every bill collector, every collection department, every collection agency, every law firm of scamming them. No matter what business is out there, there will be dirt posted by deadbeat debtors who find it necessary to bring them down with them. It makes them feel justified for stealing the money. If they can get a bunch of other debtors to agree with them then they've gotten back at the creditors for asking for their money back. ATTICA ATTICA ATTICA! I'd challange anyone to find ANY collection outfit that DOESN"T have a bad reputation according to the internet postings. Get my drift? Make any sense? Believe me. They aren't all bad. In fact, rarely if ever are they. They just have one thing in common. They've all asked for the money back. Such a crime.
9. Debtors think all credit is interst free. No matter how deliquent the bill is, no interest or late fees should be charged. If that were the case, who in their right mind would ever bother to pay a bill on time??? I know I wouldn't. Read your contract stupid. You pay late, there is a penalty. That penalty grows month to month. Do the math. You are no exception just because you moved or forgot or any other excuse you're using to try to get out of paying.
10. Debtors only answer their phone the 1st time. After that, they hide. Why? Because they're liars. They know they're wrong. They know they owe. So they stop answering the phone thinking the bill will go away. They make promises they have no intention of keeping, so they run & hide like little girls. They lie & say they're unemployed yet never seem to be home between 8 and 5. Why is that? Don't you know we have ways of finding you anytime anywhere if we choose to? Do you really want your neighbors called & your employer & your church & corner grocery store? You want to talk about harrasment? Stop answering your phone. See what that gets you. When we STOP calling is when you really need to worry. - gapeach replies to No NameFYI - I just verified with the New York State Bar Association that Kyle Schwartz is NOT an attorney barred by the State of New York. The Bar reports that this is a scam company and suggested that everyone "called" by them to call your local district attorney and press charges against him, its called "practicing law without a license".

Kyle Schwartz is NOT at attorney in the State of New York, I verified that thru the State Bar Association. The Bar Association reports that they have had NUMEROUS calls about whether or not this guy is a lawyer, they also report that this is a scam company. Call your district attorney!

County of Carson assured I have zero debts owed, and if I did County of Carson would not use a New York debt collector. Calls 1-2 times per day, 7:50am (prior to the FDCPA convenient time of 8am) and 6:30pm . "Mr Houston" reports he is collecting for "Titanium" but refuses to mail any details on purported debt, repeatedly demanding my 82-yr-old penniless mother mail a check to his new york address immediately before he files a law suit.
