    I talked to a Michael Brooks and he helped me settle out the debt I owed for less than I actually owed. Theese guys really helped me out with fixing my credit! I wish all collection agencies were this helpful!

    got the same call from them, they said to me that they bought a bunch of debt from marshall and zikowski when they went out of business. i called the old number i had from marshall and zikowski and i got a customer service rep on the phone that explained the account i had with them was sold to the other company in december

    i talked to a susan from kingman and cole ... she was very understanding with my situation although there wasnt much they could do they did hold over my bill for a couple days so i could get my affairs in order. everyone i spoke with at the company was extremely friendly and concerned with helping me.

    Beware!!! they say they are Kingsman &Cole & asso.They are not.There real name is Marshall & Ziolkowski.they are scam artist that try to frighten you into giveing them money.Do not call them.Have your Lawyer deal with them.Look them up under Marshall & Ziolkowski at the BBB in N.Y..You will see all of there complaints.If they bother you make a complaint to BBB, your phone company,and local police

    Got a call from Kingman, Cole and Associates today.  866-345-4590.  I had a problem with Marshall and Ziolkowski last week.  Turned it over to an attorney and they went away.  My attorney told them to not contact me directly and here they are again, contacting me directly with a different name.  

    I was supposed to talk to a Kyle Shwartz.

    received a call from them about a supposed decades old credit card account.they refused to provide any debt validation only threatned me with a court date and a docket number. i contacted local law enforcement about the supposed court date. nothing there.i then contacted the TEXAS attorney general office. they expresed concern about the conversation i had with these people.i suspect that this is nothing but a zombie debt collector digging up old debt and intimidating people. will post if i find out otherwise. i have an appointment with attorney generals office to discuss this matter.

    These Deadbeat Debt Collectors have tens of thousands in judgments for violating consumer rights, and state and federal law. Save your money, these con men may not outlast the Buffalo snow. Don’t buy their lies and scam, they may be joining the LONG list of Buffalo, NY collectors who have been sued into insolvency that is associated with this group of criminal debt collectors.

    these people called me saying I could be placed in jail is this true can they really do this or are they trying to threaten me into sending them so money?  I tried to explain my situation but they would not listen to anything I was saying

    In order to get them to legall stop calling you they have to be notified in writing.  That is why they never give you a postal address to deal with them or to send a check.  They insist getting a check by phone (illegal in some states to do or ask for) or a posted check by phone (also illegal to do in many states), or insist you give them numbers to a credit card or debit card.

    They know that once you have an address for them an attorney, or even you with a properly worded letter, can invoke appropriate laws to prevent them from calling you again.

    They can go out of business and re-open as a new company almost weekly if they want to so as to keep from tracking them down.  

    That 866 number they use, and the "425" area code often showing on the caller ID box both report to a VOIP pool that the telephone company cannot trace to get the real ownership or do a reverse look up for an address.  Very clever on their part.

    Here's the clue... they will threaten you with court proceedings.  That will never happen.  That is because they will need to contract an attorney to present the case in a local jurisdiction, ie in your city and state.  that costs them money.  And the local attorney will need to have proper name and address data for them that could be subpoenad by a local court or attorney.  If they refuse to give you a working address on the phone they will never give one to another attorney that might fall into your hands, the hands of your attorney, or a court jurisdiction.

    Empty threats by people who are working illegally someplace, or in a state where there are no proper consumer laws.  At one time they were working out of NY state which has some of the laxest laws in the country with respect to licensure of such companies.

    I know of a number of collection agencies in my state (east coast) that moved to NY state simply to be able to work outside of stricter consumer laws.

    If you experience problems with a collection agency, it's important to know your rights. There are two types of debt collectors: creditors, to whom you owe money directly, and third party collectors, which collect on behalf of companies. Under the Fair Debt Collection Practices Act, creditors and third party collectors may NOT:
    * use false, deceptive, or misleading representations or means;
    * harass, oppress, or abuse any person while seeking payment;
    * use any false statements or engage in unfair practices.

    The Better Business Bureau and the Federal Trade Commission offer the following information on fair collection practices.

    Contact

    Debt collectors may not contact you before 8 a.m. or after 9 p.m., unless you agree to alternative times. They may contact you in person, by mail, telephone, telegram, or fax; however, they may NOT contact you by postcard. Collectors also may not contact you at work if they know your employer disapproves. You may stop a collector from contacting you by writing a letter to the agency telling them to stop. Once the agency receives your letter, it may not contact you again except to say there will be no further contact, or to notify you if they intend to take a specific action.

    If you have an attorney, debt collectors may not contact anyone other than your attorney once you've provided the attorney's information. If you do not have an attorney, collectors may contact other people, but only to find out where you live and work. In most case, collectors may not contact such permissible parties more than once and cannot reveal to anyone other than you or your attorney that you owe money.

    Within five days after you are first contacted, collectors must send a written notice telling you the amount of money you owe, the name of the creditor to whom you owe the money, and what action to take if you believe you do not owe the money. If you believe the company contacted you in error, you must write to them within 30 days after the initial contact; upon receipt of your letter, the company must cease collection activities. However, if the company can provide proof of the debt such as a copy of a bill for the amount owed, the company may renew collection proceedings.

    Prohibited Practices

    Debt collectors may not engage in unfair practices while attempting to collect a debt. For example, they may not:
    * use threats of violence or harm against the person, property, or reputation;
    * publish a list of consumers who refuse to pay their debts (except to a credit bureau);
    * use obscene or profane language;
    * use phone calls to repeatedly harass you;
    * fail to identify themselves on the telephone;
    * advertise your debt;
    * threaten arrest if you do not pay your debt;
    * say they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so;
    * indicate that actions such as a lawsuit will be taken against you, which legally may not be taken, or which they do not intend to take;
    * collect any amount greater than your debt, unless allowed by law;
    * deposit a post-dated check prematurely.

    Debt collectors may not use false statements when collecting a debt. For example, they cannot:
    * falsely imply they are attorneys or government representatives;
    falsely imply you have committed a crime;
    * falsely represent that they operate or work for a credit bureau;
    * misrepresent the amount of your debt;
    * misrepresent the involvement of an attorney in collecting a debt;
    * indicate that papers being sent to you are not legal forms when they are;
    * give false credit information about you to anyone;
    * send you anything that looks like an official document from a court or government agency when it is not; * use a false name.

    Law Violations
    If you believe a debt collector has violated the law, you may sue in state or federal court within one year from the date of the possible violation. If you win, you may recover money for damages you suffered, including court costs and attorney's fees. You should also report problems with debt collectors to the Attorney General's office and the Federal Trade Commission.

    i got called on saturday morning and i called them back because i had been getting calls twice a day for a month and i wanted to know who this call was for and what it was about. i called him back and he told me he( kevin kaufmen) was representing a credit card i had. He told me he was a lawyer and that i was going to go to court for my debt and was facing a misdeamnor on two counts for fraud. He told me i needed to go to my local court and tell them my fincail situation and what assests i owned so that they could go about settling my debt. He told me i woed $4000 dollars on cards that i know i Owe less than $2000 dollars. After telling me that i needed to take care of this today or else tuesday criminal charges were being pressed. Then i said what are we talking about me owing here. he told me i woed $4900 dollars and i had already gone to court over this and because i didn't show up i showed the judge that i didn't care and so i was out of luck. He said he could pssibly settle out of court and said to give him a minute. he was gone a second and came back saying we could settle for $2469 out of court and everytihng would be dropped. i let him know all the finicail stuff is in husbands name and so i would have to call him and i would get back to him. I hung up and called husband and then turned around and called him back. I told him before i could pay this my husband wants to you to send us out a paper stating the orginal debt, how much is owed now and what of that is interest. He cut me off and got nasty saying that he wishes he was doing this to my husband not me i sound like a nice lady who just wants to settle this and he is only going to hurt me by being like this. he went on almost yelling at me that as a lawyer and a law office he wasn't obligated to do anything but give me a chance to settle or proceed with charges. He said he could send me a paper stateing the offer and that is was past due but that charges were filed and he wouldn't be able to drop them. other than that he was under no obligation to give me anything. I told him that i couldn't do it without my husband and he said you realize you will be getting charges pressed and this is a one time offer after today i can't do anything for you. i let him know that i had to wait till hubby got home and he told me the office would only be open for another half an hour. He told me that tuesday would be the day of sentencing and judgement and he had to have a check today. I told him i would do the check on the basis that nmonday if i couldn't get the money i can cancel it with no problems and he told me yes. after i hung up i called back and asked him what a misdeamnor entitled and he told me he is a lawyer in new york and that he doesn't know what the state laws of colorado are and so he can't really tell me. but he told me that it would be probation at most and i asked if i would be able to get a job in the future and he told me probably not. sp i hung up and spent the next two days crying and i almost had to check into a mental health facitly from the emtional stress of this situation.

    Here are the facts, even if you owe an insanely huge amount of debt, they can not send you to jail. This is a common scare tactic that people like to use, but it does not carry any water with it, so to speak of course. If they call again and use this threat again, you are in the know. The worst that any collection agency can do is file to have your wages garnished, and that is about it.

    kingman,cole called me said that my wife owed 5,000.00 on a credit card that was not owed and threatened that a court apearance was missed and delivered to an old address and we could settle for less if paid right now i was not sure about this so i said i would check into it and get back to them in the meen time they some how got a hold of my wife and said they were going to put a lien on the house had all my mortgage info and said they would take us to court and throw my wife in jail so they had scared her and before she called me they got some of the payment i will be reporting them ad fraud they used two different names 1-kevin kaufman from#716-689-4267 and kyle schwartz from#866-345-4590

    this place is not a scam and neither was marshall & ziolkowski!  I can tell u from personal experience bc I had to appear in court last thursday.  the guy who started that rumors name is bud hibbs.  he makes his money off bad mouthing literally every collection agency in the US and if u go on his website (budhibbs.com)u will see all of the collection agencies in america on there.  these are legitimate law offices who purchase debt and sue them if you dont pay your bills.  too many people try to take money and run, i was one of them, however you will not get away with it if your dealing with these 2 offices.  the people that work there are very courteous and try to help you but if u dont pay your bill they will sue you.  im dumbfounded by what im reading on here about calling these people a scam.  I found out the hard way and from what im reading on here i guess ya'll will find out real soon.  good luck in court people!
