The bad part is YES if you make a payment the statue of limitations DOES start over in some states. Be sure to check this out.
I was in court two weeks ago, Aug. 08 in the state of TN. And a man that was in court was told by the Judge that yes even though the statue had ran out, since he made a payment it now started all over. It starts all over each and every time.
If you have an old debt that you think may have outlived the statue of limitations. Find out if it has, if so do NOT pay them a dime.
However i would advise you to check into the statue of limitations laws in your state.
Also, if it has ran out why would you want to pay them anything? They can not place it on your credit report, if they do you can have it removed. - AnonymI received a letter from them too. It is a scam for sure. Dont waste your time with these cons. Don't send them proof that this debt (if any) was paid b/c they may use it against you for identity theft purposes. - Rob Davidson replies to Skip T Racer| 1 replyThe staute of limitations is a maximum of 6 years, some states are less than that. The starting point for the statute of limitations is the date of first delinquency or missed payment. When dealing with any of these predatory agencies always check your credit report first. If a debt is no longer on your credit report (which goes back 7 years) the debt has passed the statute of limitations in all states.
I have had to deal with a couple of these agencies for debt from 15 years ago that was my ex-wife's. The best way to deal with an agency that practices dead-debt collection is to send them a letter stating that the debt has passed the staute of limitations and that any attempt to collect the debt on their part will have to pursued without assistance from the court system. Remember that when a debt passes the staute of limitations that the only debt collection remedy removed is the collectors use of the court system to collect the debt. As long as they follow the collection laws in your state they have every right to try to collect any debt, no matter how old it is. Essentially, once the statute of limitations passes and the agency knows (from your letter) that you know they can not successfully use the courts to collect, (they have every right to take you to court, they just can't win if you have proof that the SOL has expired) they will cross you off their list as they know the threats they use to sue and garnish wages will not work on you.

- Anonym| 1 replyI got a call along time ago from these same idiots. I asked them what debt. I said prove. They said we will send you a letter and 2 weeks no letter. They call me again, I said you have not sent me any proof. I sais send me an email, oh we can't send it because we just sent the letter and cannot send another. Well after ripping that idiot a new one. I thought I was done (BTW this is a 10 year old CC with a $1000.oo charge-off that was settled) So i have recieved since then the usual letters with e $4000 in intereset and as usual toss them. Now Dec. 22 I applied for a Bank Card from Barclays for my Direct TV. I get a call this is Theresa with Barclays regarding your card. So I call back and they basically lie and did not Identify themseleves. I thought well maybe Barclays bought the CC bank company. So I gave them my card # to charge me $50 a month. After I hung up I realized I have been scammed, called back and raised wholly hell and warned them about the statute of limitaions and misrepresentation etc and stated if they charged my card I would sue them. It is obvious they somehow moniter your Credit reort for inquiries is this even legal to have that kind of access>

He didnt say who the message was for and three people live in my home.The number he left to call back was 877-688-8288 ext. 113. He didnt say why he was calling or give a company name where he was calling from. I thought it was kind of fishy. This is when I looked up this sight and glad I did. I am going to assume it was a debt collector only from what is written on this web sight. My credit report has nothing on it.I guess you can say they arent going to scam me,thanks to this website.

- S.BrownI have been living outside of the U.S. for nearly 8yrs.. These people somehow got hold of my mother's phone number and said they had an Urgent Business Deal they needed to discuss with me at my earliest opportunity. When asked what this was pertaining to, the caller Tony Rogers, would give no information and tried to use strong-arm tactics to obtain information on me! After reading an article from other collection agencies and several(un-mentioned)goverment representatives. I have found this agency to be highly suspect and not even sanctioned to make collections that are over the statue of limitations! DO NOT BE BULLIED BY THIS, OR ANY OTHER, AGENCY MAKING THREATS OF ANY KIND!! Instead, contact your nearest law enforcement agency(police, FBI, whomever) and report them for harrassment, illegal mobile phone usage, and giving false information regarding bill payment or debt consolidations! They're crooks and shouldn't be allowed to bother anyone!! Tell them you've handed their information over to the necessary authorities and have them blocked from your phone. To be blunt...THEY S*CK!!

- LJJDPI received a call today both on cell and work from a 'TRACY'. since the first call came in on my cell #, she had left a message saying she was calling from my BANK (which happens to be my mortgage company). since i found that to be a little strange, i did a reverse lookup and sure enough, it is this group of people. has anyone resolved this issue.

- Almost got meI received a phone call from "Mr. Brown" & surprisingly enough, I got the same guy when I called back. I guess they don't hide their phone number. I know I don't accept unlisted numbers on my cell phone. Anyways, he did have a lot of old information. He said that he was collecting on an old AT&T bill from 2003, but he couldn't identify the phone number. He had all kinds of addresses for me all over the U.S. I didn't give him any new information. I told him to email me a letter & when I did get it, I checked really quickly online. I am glad I did. I also looked up reverse phone on different phone number used, all came back different, one was just a household. 815-758-1111,5555,8119. Thanks for posting this info.

- Ceen Enough replies to freaked out daughtr in law| 1 replyYesterday I had a guy identifying himself as Robert Martinez calling me about a Dell Account that has been in collections since like 2001. He was saying the balance with interest is over $6000 but the original finance amount was around $2400. He told me if I did not settle the account he would have his company put an alert on this particular debt telling me if I either tried to establish credit or get a job they would pull my credit and this one bill would hold up everything.
- chrisI got a letter in the mail saying I owed a debt from 20 years ago and they would clear it off my credit record for a third of the cost . and that when I called them to let them know I knew it was a uncolectible debt they agreed it was past the statue of limitations but that they had mad a inquirie of my credit report and it would stay on my credit report till I died or paid the debt and it would affect my credit report . I got pissed and told him in my state I beleaved it was ileagle and I wanted them to prove I owed it . He said fine to send a letter but they would then just sell it to another collection service who would do the same thing and have a credit inquirie show up and credit companies would call them to find out about the debt . I am writing this to let people know this is a scam and the credit inquirie thing with no recourse should be illeagle as far as I am concerned as I never aplyied for credit from them or anyone they repusent .
