Scott Franson use to work for Camco or otherwise known as "Scamco" a debt purchasing company that was shut down by the FTC. What you deadbeats need to do is pay your bills if u legitamitly owe the bill pay it period stop being a deadbeat and pay it. If u walked away with the goods and services you should have to pay it back regardless of the age. - PUT DCS out of business replies to pay your billsI can't even believe this was posted by "Pay Your Bills"! That is exactly what Tracey, the DCS [***] from hell, yelled at me. Never mind that the bill was not even mine.
Tim Luetkenbuenger responded to me directly. It appears the only way I could get through to him was to send a message through his wife's (Trina) facebook account. He is the only real person at DCS as Lee and Tracey are pseudonyms.
According to Tim, DCS made a small error on the SS# and that is why they had my information for an account belonging to someone named Ann Miller. In reading the posts here, it seems they use this strategy often. Tim says that Tracey was reprimanded for her mistake. I seriously doubt it.
I wish I could tell the world. Don't give DCS or any company like this (ERSI) a dime. You are not helping our struggling economy by paying DCS for an old debt, even in the off chance it was real. The statute of limitations is there to protect you. SHe started by referencing the fact that I applied for credit at Wells Fargo and they are getting returned mail. She tried to make it sound like it was returned mail from Wells Fargo. Samething, she wants to verify my "correct" address to take care of a Circuit City bill I owe from 1992-1993... WOW, not only is it 2010 now, but that debt has been put on my Chapter 7 Bankcrupcy I did 8 years ago. She try to tell me that she would call my work's HR Department to verufy wages... bla, bla, bla.

Debt collectors can call you and request that you pay the debt. However, they cannot harass you or abuse you. These are the types of things that they should not do:
* Use obscene or profane language.
* Make repeated frequent calls to annoy you.
* Telephone you without identifying themselves.
* Use threats of violence or harm against you.
* Threaten to arrest you if you do not pay the debt.
* Threaten to take action such as lawsuits, garnishments, or taking your property unless the collector intends to do so and it is legal. (Creditors must usually take you to court and get a court "judgment" against you before they are able to garnish your wages in Missouri.)
Debt collectors cannot make false statements about themselves or the debts. They cannot misrepresent:
* they are government officials;
* that you have committed a crime;
* that they work for the "credit bureau";
* that the papers you received are legal summonses
or legal papers, if they are not;
* the amount of your debt; or
* that there is an attorney involved, if there is not.
Debt collectors are also prohibited from:
* depositing a post-dated check before it is due;
* threatening to take your property unless it is legal to do so;
* contacting you by postcard.

I had no idea who this was. My brother's name is Casey so I got a little worried and called him first. He looked up the name and number on the web and this is how I came across this site. Thank god. I did have some credit issues from back in college, over 15 years ago, but good credit now. I don't want to deal with these people. I don't owe them a thing. Wonder how they got my cell number. Thanks for all the info! This is so helpful and I am not calling them back.

- debI just got a call from Lee Stern too about a debt that was 18 years old and he mentioned a recent inquiry by Wells Fargo as well. I explained to him I have no information on this debt to even confirm it is mine. He kept telling me they have a watch on my credit report and they will contineu to do so. I am glad I found this site as it really provided information about what a scam this is. I am going to see who to call and report this. He said he will continue to call me until it is paid. It is really sad what people will do for a buck....
- bubYa um I havent been getting any phone calls but random attempts at collection do arrive at my home for a sears account that i've never had. I called them once about six months ago turned out the account would have been mine at the age of 16 I laughed and the letters continued. I finally called them back today to hear this chump tell me i opened the account towards my thirties ,lolz. scumbags. Dont plan on giving them a dime. I highly recommend nooe else does either.

When I called to speak to him and tell him that I had either paid off that account (10+ years ago), or that the account wasn't mine, he got very belligerent. Said that I needed to prove that I had paid the debt because their accounts were "scrubbed clean" (his words) and that it was my account and recited my SSN. When I wouldn't give in, he told me to call him back when I was ready to speak to him regarding a settlement and that in the meantime he would call my employer and verify employment. I spoke to the collections person at my company and found out all they can do is verify that I work there. My employer cannot verify wages.
Going to send them the following letter via certified mail and put the burden of proof on them!

This letter is being sent to you in response to a notice of an entry by your company on my credit reports. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.
This is NOT a request for “verification” or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.
What do I need you to provide as the debt validation.
1. What the money you say I owe is for;
2. Explain and show me how you calculated what you say I owe;
3. Provide me with copies of any papers that show I agreed to pay what you say I owe;
4. Provide a verification or copy of any judgment if applicable;
5. Identify the original creditor;
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent
9. Proof that the collection company owns the debt/or has been assigned the debt. (You are legally entitled to collect this particular debt from me.) This is basic contract law.
10. Complete payment history, starting with the original creditor. (I need to have proof of my payment history with original Creditor, what the amount of the debt was when the creditor assigned the debt to your company, and what fees/interest has been tacked on to this debt and how you/they determined these fees.) This requirement was established by the case Fields v. Wilber Law Firm, Donald L. Wilber and Kenneth Wilber, USCA-02-C-0072, 7th Circuit Court, Sept 2004.
11. Copy of the original signed loan agreement or credit card application. (My contract with the original creditor establishing the debt between us.) This is also basic contract law.
At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau’s (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:
1. Violation of the Fair Credit Reporting Act
2. Violation of the Fair Debt Collection Practices Act
3. Defamation of Character
If your offices are able to provide the proper documentation as requested in the following Declaration, I will require at least 30 days investigating this information and during such time all collection activity must cease and desist.
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.
If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.
I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS.
It would be advisable that you assure that your records are in order before I am forced to take legal action. This is an attempt to correct your records; any information obtained shall be used for that purpose.

- CT, SA, TX| 1 replyAfter receiving a call from Kaesy/Casey teling me I had an unpaid debt from 1984 (?), saying that I never paid it (?), it was sold to another agency and I was supposedly contacted by another company in 1990 (?), DCS said they contacted me in 2000 (lie) and I still owe this debt. it is not on my credit report; DCS did an inquiry with Equifax and I was told by the Atty Gen Office and the District Atty that DCS had no right to DO an inquiry and to file a complaint AGAINST Equifax.I filed a harrassment charge with the SAPD simnce they threatend me with garnishment of wages if I did not pay, am filing a complaint with the FTC and have contacted the State Attorney General's office which told me to go to a website that is within both the State of Texas and FTC to get a "Cease and Desist" letter. The Statute of Limitations for Texas is 4 years and State of Illinois (which is where DCS exists) is 6 years according the the State Of Texas Public Law Librarian. DO NOT PAY ANYTHING TO THESE PEOPLE. Send your Cease and Desist Letter USPS Certified and do not give any information to them. Refuse their calls.
