    I found this info from this website. I suggest calling THEM at all hours and leaving them HUNDREDS of nice and fun voicemails!! They are unprofessional and use profane language.

    Good news!  No more calls from this group.  Take action and make it clear that you are on the offensive.  They will take your name off their list, if they really believe that you will resort to legal and consumer actions.

    It takes work and you need to continue calling them back until they get the message.  Do not give them any personal details other than your phone number which they already have.

    I am getting up to 12 calls a day from this phone number.  It sometimes wakes me in the morning, and calls hourly, until 8:45 pm.

    add to my last post.  I have no outstanding bills, I own noone.  These calls started after I updated my phone from Alltel to Verizon.  I changed phones but have same cell phone number that I've had for about 4 yrs.

    This number has called my fax number all day since this morning and it is now 8:45pm.  They obviously think this is a phone number and haven't realized it is not a fax as nothing has actually been faxed.

    I just figured this out,  (took me long enough).  Everyone in my contact list I assigned a ringtone.  Everyone not on my list was assigned  no ring .  Now those not on my call list will go to messege but I don't hear the call come in.  I just have to check the calls later and can delete or call back those I want to, and can add whoever to my contact list.

    I've gotten about 15 calls from this number since I've been home in the last two days. Once I even answered it, and they were looking for somebody who doesn't live here.

    I got a call from these people, and it was hilarious! They ask for your 16 digit account number, and i was just like "Why? or "What country are you in?" and stuff. Just block their calls, or if you want some fun you can mess with them.
    BTW, they're calling from the Philippines.

    888-748-4956 started calling me few weeks ago.  They call on Sundays, after 9:00 pm at night..Is it legal for them to call any time they want?  I do not have an account with them and NEVER would after this behavior..My credit is excellent and do not want them calling..

    No, it is NOT legal for a debt collector to call you "anytime they want":

    § 805.  Communication in connection with debt collection   [15 USC 1692c]

    (a) COMMUNICATION WITH THE CONSUMER GENERALLY.  Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt --
    --at any unusual time or place or a time or place known or which should be known to be inconvenient to the consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after 8 o'clock antimeridian and before 9 o'clock postmeridian, local time at the consumer's location...

    18887484956 calls my house atleast 5 times aday,including Sunday....Very aggervating,considering the person they are asking for doesn't even live here nor do I know them!

    When I called the number back they answered "Capitol One".  I went to the Capitol One website and started dialing numbers until I got to a one that would let me talk to a human.  I spoke to an account manager (whatever that means) who did check and confirm that this number is one of theirs, assigned to their collections department.  He claimed he's getting my number removed but I've heard that before.  I've told these people repeatedly that I never heard of the person they're looking for, and they always tell me they're updating their records and it'll take 3 days to process.  I sure hope so, am thinking of getting an air horn to blow into the receiver the next time they call me at 6:15 am, which they have done repeatedly.

    They have called five times in the last 2-3 days. They finally spoke today asking for Sean and indicating that this is a personal call. This is becoming common and rather frustrating. These are most likely collection agencies who may be outsourcing to third parties and individuals. The credit card company will provide them with a name and the amount owed and really nothing more. Will you trust these guys with account numbers, phone numbers and soc. sec. numbers? I had a similar experience some 10 years ago and the collection agency was very aggressive. My actual account was current and there was no outstanding balance.  After many days of dealing with the calls and Discover insisting that they had nothing to do with the calling party Discover confessed that it was a collection agency that was doing work for them. I had them send me a written apology letter! They explained that the collection agency only gets names and amount owed so they will call your home if there is a connection with the last name or someone who had the number before had a similar last name. Unfortunately they either don't trust you or they do not communicate with each other because they will call you many, many time even if someone tells you that they will take you off the list.  I get the sense that we are actually getting the call from a private house but they dial a number first that will make it appears that they are calling from 1-888-748-4956.  The FTC rules to avoid abuse are really lame in that you have to write the letter and certify it to get these guys to stop calling.  The rule should say that the calling agency needs to have convincing proof that you actually owe the money before they are allowed to make the call.  The credit card company has all the information but they will not give it to the collection agency because they will be breaking privacy laws.

    The only time I answered this call, all I got was a bunch of random noise. I DO have an overdue Capital One account, however it is not overdue to the point of collections. I just don't answer. I'll talk to Capital One themselves. These guys also do not leave a message, ever. That raises red flags for me.

    I've gotten several calls from this number over the past few days.  I do not answer calls coming in from 800 or 888. I finally called them back, and they asked for my capital one account number without giving the name of the company I called.  I asked if this was a collections agency and that I do have a captial one loan but it's current. I did not give them my account number but did give my phone number, the rep. said they were looking for Anthony Jacobs.  I told them no one here by that name and they said they would remove my number from Anthony Jacobs' account.  We'll see if I stop receiving calls from them.

    Insult on top of injury; Financial rape by Capital One.
    Capital One jacked my interest rate to 29.9% along with most of my other credit line suppliers. Business virtually dead, had to liquidate, declare bankruptcy. Capital One sends me a 1099 at tax time saying that the discharged balance should be considered income to me. THIS IS HARRASSMENT!!! According to tax code, the debt cannot be counted as income when the debtor is insolvent. By definition, a ch 7 is granted when the debtor is insolvent and all appplicable assets have been liquidated. Capital One tries to advertise as though they’re the good guys, when they’re just as scummy or worse than any other lender. Filing the 1099 is just plain harrassment on the back end.

    There are No Tax Consequences From Discharging Debts in Bankruptcy. When the forgiveness of debt occurs in a bankruptcy case, Internal Revenue Code section 108(a)(1)(A) specifically provides that it is not to be treated as income. Thus, discharge of a debt through a bankruptcy proceeding is excluded from gross income for tax purposes.

    Creditors Sometimes Cause Problems by Issuing Form 1099-C. Even though the law is clear that discharged debts are not to be treated as taxable income, some creditors erroneously believe that they are required to send a bankruptcy debtor a form 1099-C when a debt is discharged in bankruptcy. Obviously this causes confusion to tax preparers who are often accustomed to including all income reflected in 1099 forms as income to the taxpayer.

    ***What Should a Debtor do If Creditor Issues a 1099-C after Bankruptcy? If a credit card company issues a debtor an IRS form 1099-C after a debtor has received a bankruptcy discharge, the debtor has two options. The first would be to contact the creditor to advise them that the 1099-C was issued in error. However, since such creditors have no incentive to actively resolve this, the better option would be for the debtor to directly advise the IRS about the filing of the bankruptcy. The debtor can do this by writing a simple letter to the IRS supported by a photocopy of the bankruptcy discharge order and the schedule containing the specific debt. Alternatively, the debtor or his accountant can file an IRS form 982, which enables the debtor to point out to the IRS that the debt forgiveness (by virtue of the bankruptcy discharge) occurred in a bankruptcy proceeding and has no tax consequences. It is very easy now to go on line and obtain a PDF copy of IRS form 982 (or any other tax form)***.
