    For the past 6 months we've been getting phone calls from this outfit....we have told them over & over again the person they are looking for does not live at the number they are calling.  They will not stop calling us...so my husband has been calling them for over 1 hour.....asking for the person they are asking us for.....of course we are being as obsurd as they are being....So far, we've spoken to a Cecilia, Sonya, Paul & Mickey...they told us they are Tate, Kirlin & Associates.......

    These people have called me numerous times.  They are asking for someone named Shane.  I told them I am not "Shane" and I have nobody in my family with that name.  Then, Sunday, October 25th at 4:32 during the Cowboys football game and was RUDE.  He wouldn't let me speak and called me "Antoinette", again NOT MY NAME.  I told him this is about the 10th time someone has called, this is my corporate blackberry and he made fun of that and called me a liar.  I'm sick of this and it needs to stop immediately.

    Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

    Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

    This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

    David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

    [The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

    Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

    So what can you do if you receive "wrong number" calls from debt collectors?

    1. Sign up for the Do-Not-Call registry.
    2. Save the calls captured by your voice mail or answering machine.
    3. Contact a consumer lawyer.

    Been getting calls from this company for the past week from a few different numbers.  I finally answered one 2 minutes ago ready to have some fun (since everyone here provided so much helpful info).

    It was a robot looking for the person who used to have my cell phone number.  I pressed "2" since I was not her, then "3" to indicate it was a wrong number.  I was then quickly transferred to an operator (Indian accent, but understandable).  I just told him that person no longer owns this number, and I do not know them.  He quickly apologized and removed my number from their database.

    Not as much fun as I thought, but an easy fix to stop them from calling... assuming they do stop.

    My suggestion is, if you're not who they're looking for (or even if you are?), just tell them they have the wrong number like I did and they should stop calling.

    They called me about 4 times just today,  I called back several times and all they say is that tye are Tate, Kirklin & associates, they will not give me their federal tax ID number.... they don't even know what that was.... If you are a business in the US you will have one and are obligated by law to disclose it if asked.... it's just a scam.

    Someone from this number called my cell phone and after I said "hello" twice; hung up.  I called the number back and they said that they were calling for someone named Donna.  They said that they would remove my number from their system.

    After hearing the possibility of scams, I don't take their call... but just to give you an idea of how many times they call my cell phone:  In the last week, they have called and not left messages 33 TIMES!!!  A bit ridiculous if you ask me.

    They called asking for my son, that doesn't live with us, very damanding, rude and threatning. I called theM back, they would't give me information about them, UNTIL I called 4 more times, then they gave me give me the name of their company, and address as 2810 S. Hampton, Philly PA 19154.  I told them if they ever called my house again, I would report them to the Missouri Attorney General for harrassment!  The woman on the other end said ... OK, do it, you won't get anywhere!  BEWARE... don't give any information out... ask them to use the address they have on file and write you!  Then HANG UP!

    Tate and Associates - number is 215-464-4500 ... press 0 ... will get live person.  Address us 2810 Philly, PA 19154.  They are registered as a Debt Scam Alert through the BBB... give them hell when they call you!  They will stop!  They want to dish it out... but they don't want to take it.

    I have been called for years, yes I said years by this Tate and Kirklin and I still have no idea why. Best thing to do is buy a phone with call block like the Panosonic. I did and I am so happy. The phone does not even complete a ring when it hangs up on them. It was a small $50.00 or so investment for freedom from these [***] clowns. While they have never gotten my cell # I put iblacklist for the iphone (a jailbreak app) which also blocks unwanted callers. I love this technology. Good luck everyone!

    This group is not the listed identity.  It is a private party that has accessed the federal DNC database or a downloaded copy of it and is using it for harassment or id theft.  There are currently some 47 locations that have this pirated copy and are changing their location periodically.   There is no economic value to what they are doing since virtually no one will give personal information that permits identity theft. Eventually, the feds will catch one in violation of the statute and give the sociopaths involved a slap on the wrist.  Local Committees of Vigilance may be the cure for sociopathic harassment, the same as they are for  highjackers on the internet.  If you find the location for someone doing this in your community, not easy, be sure the local media know about him.
