    I had an Amex card. My business has taken a 70% decrease in revenue. I use to float my business on my Amex (30-50K per month) never late once in 15yrs. I had to go into survival mode to take care of my family and Amex gave me a charge off on my credit report. Shortly after that I was able to pay off the 30k balance but still show a charge off. HOW do I get that off my credit report?

    Keep calling for a couple with the same last name as my husband and I. I have repeatedly told them they have the wrong (insert last name), but keep calling anyways.

    So i received a call from a guy from this place and he asked for a person in the household and i put him on hold to look for that person, but they weren't here so when i got back on the phone with him he accused of being that person and every time i tried speaking to would cut me off then  and said i would have to deal with the consequences...and he said the phone call was recorded. Then he hung up. Jerk. So do they actually go through with what they saying in the matter of suing? I thought it was against the law to harass people over the phone?

    These people called me claiming to be attorney's........the lady was smart enough to say SHE was not an attorney, but was representing them. They called me at work......100% unacceptable.

    Good write up.  The first time a company passes debt to a collection agency it is usually on contingency basis.  The collector usually keeps at least 30%.  When the debt is really old then the file is sold for a few cents on the dollar.

    You are right on the money and don't let them get the best of you as it's fun for them.

    These people act like they are lawyers, when in fact they hire an attorney if they sue.

    Charged off debt can be recalled by the original grantor.  For example, AM EX could pull the debt back if it wasn't sold to a collector

    "Stealing" is a criminal offense.  You can be arrested for stealing.  You cannot be arrested for falling behind on bills.

    Although it is true you can be sued by a debt collector (such as Zwicker and Assocates who both buys debts and also directly represents creditors), they cannot turn an unsecured debt into a secured one. I am a legal assistant for my attorney husband who represents consumers in debt collection defense/violations in Florida. Judgements are neither unsecured nor secured and the ability of the holder to collect is completely dependent on the laws of state the suit was brought in. Some states allow garnishment, liens, forced sale of property, etc., and some do not. Florida, for example, disallows judgement collections against homesteads, retirement income, social security or disability, or heads of households. This might sound picky, but it's an important legal distinction. I would urge anyone being collected upon to seek legal advice and representation. There are often legal defenses available, and some lawyers will take cases on contingency since they often recover fees from the other side. See guys like Bud Hibbs (not an attorney but a plethora of great information) at www.budhibbs.com or National Association of Consumer Advocates at www.naca.net for an attorney in your state and area. Don't give up, seek advice and fight.

    i work for zwicker....all u say were scumbags but were just doing our jobs. calling you guys who dont pay ur bills. if you cant afford it dont buy it. I know the economy is bad but that doesnt mean u dont have to pay your bills so before you go off on us remember we HAVEEEE jobs and we pay our bills so dont speak to us like we are below you because were actually above you...some of us make up too 100k a year just calling you deadbeats...whether you pay or not we sleep soundly at night.


    and good luck with your countersuit...you owe money you have to pay if you do get any money out of the suit itll be used to pay me for doing my job

    FYI to all of you who are bitching about the "deadbeats" working for Zwicker. No I don't work there but I do work for a bank. And let me give you a little information. Once an account has been charged off it is charged off. The company that you owe the money to doesn't want to mess with it. They sell it to a collection agency. Who then turns around and collects on it. However, that will stay on your credit for 7 years. If you are wanting to buy anything including a house, you will have to pay it. Right now it's close to impossible to purchase a home with anything less than about a 650 FICO score. If you want to buy a house my suggestion is to pay it because if you don't, the mortgage company will make you pay it before they approve your home loan. And if you think bankruptcy is the answers. Go ahead, try it. Working for a bank, I understand that things happen. The last thing I want to happen is for you not to pay your account. But I don't care if you pay it or not, you're the one that has to live with the consequences not me. And I'm not the deadbeat, I have a job. And I do without sometimes just so I can PAY MY BILLS!!!!

    No you're wrong. Yes you can get them removed all day but in 30 days when the credit bureau or the company verifies the bad debt it can be added back on. FYI

    Anyone can file a judgement against you and they don't have to be in the same court as you. They can hire an attorney the city that you live to do it for them. They also can contact the courts & do it themselves.

    Please do not listen to all these people on here. I work for a bank and see everyday where people get their accounts garnished & levy's attached to their checking or savings accounts to repay a debt. If you are truly concerned about debt that you owe, work with them, get a lawyer, do anything. Ignoring them makes it worse. Banks will always work with you, if it's reasonable.

    Uh David, Yes Massachusetts collection agency can sue someone in Oh, they have more than one location. They have them all over the US, including one in Kentucky which if you can read a map is directly across the river from Oh. All they have to do is drive here. Not only that, they can petition the court in their area & sue someone in OH, or hire a lawyer here to do it for them.

    No but technically you are falsifying a contract. If you read the receipt on a credit transaction or on your card contract, it states that when you are signing the receipt it is binding you to that payment. Stating that you are agreeing to the terms and conditions of the card & will pay it back. So when you are buying something on your card without intent to pay, you are breaking the contract.

    I have worked for Zwicker & Associates Pc and I noticed that you said you have been getting calls from them and calling back and they keep asking for your ss#...In response I have worked the system and if you have a common name they have trouble finding you since they have so many accts so it is almost impossible to find it by name only especially if it is a spouses acct, therefore they ask for your ss# so they can find your acct quickly and accuratly that way they can get you to your case manager to help you try to get something worked out, they cannot located your acct by you telephone #...Also they do not have a calling list that you can be removed off of, they do have a dialer they can work from but if you have an acct with them then they have been retained by the original creditor...They have attrys in every state and if your acct has been placed there they are most likely looking to possibly file suit against you depending on the type of acct..Every phone line there is secure and recorded so my advice from working there & knowing they are legit is to call back & give them your ss# so they can located your acct that way the first time you know which acct they have is not when they have a judgement against you...Good luck & I wish you the best

    Once again I was employed with Zwicker & Associates...Im not saying that every collector there has grace on the phone and can be easy to talk to but it is important that you get matters worked out because what the collector was telling you about the added fees is correct...If they have your acct then they have been retained by the original creditor to possibly file suit against you...So you may have to pay attry fees plus any court cost, most creditors add that stipulation in you contract but most of us never read the fine print when signing for these credit cards therefore in the end get confused when collectors start calling us. If you cant pay the balance and they are refusing to take payments from you for what you can afford the best thing to do is to call them and get their mailing address so you can send in your payments to show your willingness and intent to pay the debt in case they do try to pursue you legally...Also the acct still belongs to Amex, Zwicker is not a debt buyer they are a litigating law firm but since Amex has retain Zwicker & Associates any payment will have to be made to or through Zwicker since they are now representing Amex...If you were to contact Amex they would direct you to Zwicker...With that being said Amex is the Client of Zwicker & Associates so they are the ones that set the guidelines for payment arrangments that any case manager at Zwicker can set you up on, so it may not be Zwicker that is turning down your offer it might be Amex guidelines..You can always call and ask what the guide lines are and why they are not accepting your offered payments any case manager should be able to answer if not ask to speak to a floor manager they will be able to give you the answers you seek...Best Wishes 2 you as well

    An former employee of Zwicker & Associates...They do have outside attry in every state so they can place a judgement against you no matter which state you reside in...Idk which state you reside in and the laws are different in every state but in some states they can garnish wages up to 25%, they can also place leins on any owned property...I would check into your state laws, keep in to mind that they are a litigating law firm and that if you have a student loan with sallie mae that you have a contract with them stating that you would pay this debt & if you do decided to go to court Zwicker will enforce the contract you had with Sallie Mae, and most likely you will spend more money in attry fees and litigation cost than you would if you just paid the balance owed to Sallie Mae, not to mention the impact a judgement will have on your credit...Best Wishes

    Zwicker & Associates does work with both Bank Of America and Sallie Mae and if you believe you have no debt to pay than your acct may have been placed there by accident, I have seen that happen our of error...Dont be scared to call and talk to them about reviewing the acct and seeing why they are calling you, plus if you really dont owe a debt then you wouldnt want this showing up on your credit report...
