No debt collector has the authority to have anyone arrested for anyone. And for them to threaten to have you arrested is in itself a violation of the law.  I suggest you play hardball with these crooks. Peruse these links for more information:

They keep calling, and after reading all of these comments I am now going to answer the phone..... kind of. I have started picking up and setting the phone back down. Yes this will eat my minutes since it is my cell phone, but I don't have to listen to them.

Or I might hand the phone to my 2 year old and they can arrange for a payment from him.

I have also added contact information for them on my cell phone so when they call it comes up as "Douche"

Many phone companies now offer services which automatically forward calls.  That's the best way to handle these morons.  I've forwarded their calls to phone booths, porn lines, their CEO's office, and other lowlife collecting agencies.  That way they wind up either calling themselves, someone just as sleazy, or lines that ring forever.  And it works: I haven't been bothered for months by any of the collectors who were hassling me over the debt of some distant ninth cousin.  Just remember, they may find your phone number, but you'll always have theirs, and that's enough to slam shut the doors of communication forever.

I don't answer the phone any more. I have been receiving these calls for two months now. I answered it one time and they were rude and hounded me, so I told them to stop calling or I was going to report them for harassment, and they told me that this was not harassment and that the phone calls will continue until my debt is paid. I told them that I will pay them when I have the money. I know that I have a bill; I don't need to be told 12 times a day every day.

Why the cockroaches are so desperate:

    OCWEN LOAN SERVICING
    Orlando, FL
    1-800-746-2936

Services loans for the former Aames Home Loan dba Aames Funding Corp. They used to be a bank, OCWEN FEDERAL, until they ran afoul of the OCC. Now they're just one of the worst predatory loan servicers and lenders. Here's a sampling of the litigation they're currently facing:

    Borrower Class Action Lawsuits:
Over 500 separate class action lawsuits have been combined into one jumbo class to be heard in the Northern District of Illinois. Former employees testifying about how OCWEN intentionally defrauds borrowers -- it's built in to their software which was designed by this IT guy who is blowing the whistle.

Employee Lawsuit(s): Settling in favor of the Plaintiffs

Investor and Supplier/Vendor Lawsuit(s): Just getting started

U.S. Federal Government Lawsuit(s): According to OCWEN's SEC filing, they are being sued by the U.S. in the amount of $700 million +. Suits arose after one of their subsidiaries filed for bankruptcy protection in the District of Delaware Bankruptcy Court for that amount - $700 million in debt. Here's the part the Feds and the investors are upset about: This subsidiary transferred ASSETS to OCWEN just before filing on their liabilities. That's called a fraudulent conveyance.

    Other Lawsuits: Everyone's suing them.

According to the SEC and OCWEN's own report, their net worth is $325 million--oops not enough to satisfy the Feds and investors. Borrowers who were defrauded and wrongfully foreclosed are at the bottom of this 'crumby' food chain.

According to Moody's Rating Service, they've decided not to rate OCWEN's stock--this after downgrading it. The $325 million may be a negative $325 million by this time.

If you work for a collection agency, does your employer know you are on this site? Because what you are doing is harassment it's illegal. I think you should post your name like the big person you are so we can sue your company because of you.

I think it's funny as hell - they call my cell 5 to 8 times a day and I have filed for a chapter 13 and I have a case number for my chapter 13.  I am keeping a record of the calls and my attorney is going to handle the matter once the amount I have to pay monthly to the court appointed trust is finalized.  They are looking at possibly 0.011 on the dollar (basically a penny)- and you want to know the worse part?  If they had accepted my good faith counter offer, they would have gotten close to 0.75 on the dollar back.  If they continue to call after the trust payment is finalized, with the record, my attorney will file against them for free.  These people are idiots and the party they are working for is going to be pissed at them when they see what we originally offered to settle the matter.  lol.

This company just called me and it is Christmas Eve!!!!
I get at least 10 calls a day. Sometimes three calls in less than 5 minutes!
I answer and let it just sit there.
Unlike others on this post, someone is actually there.
Do they really think that I am going to talk to them.
They can send me a certified letter!
That is the procedure according to the FTC.
I will just play their game and have them hang there.
They do not leave messages when the answering maching goes off!
I am not paying my debts because I am having a grand old time with my money. I am a victim of this society with the mortgage that keeps going up and the home owners that will not go down!
Happy Holidays to all the people out there that understand about these idiots!

How will you sue me? I don't break fdcpa... You are all angry about something THAT IS WITHIN YOUR OWN CONTROL. Communication with a debt collector will not hurt you, only help you. If we have the wrong#, let us know so that we can fix it. If you can't pay now, let us post date a check for a day when you can. I do have a heart of gold. I am helping your Karma by getting you out of debt. Please stop and think for a moment. Don't throw blame and judgement on another person. If I didnt think that I would get the third degree everytime my phone rings i'd leave my name.

Being a debt collector is a lot like being a debtor. We get hell over the phone, too. Why can't people treat each other like people? It makes no sense to use so much negative energy on a stranger.

    Cynic replies to 3rd degree
3rd degree: Most debt collectors are aggressive, mean, and profane.  I never speak to them.  I blast their ears out, or let them listen to an interesting commercial message from BILLY MAYS.  Merry Christmas.
