And for your info, I am Bhuddist and I am far from a thief. If the company you represented had done things correctly and fixed their error, then it would have never gone to collections. If your company hadn't threatened legal action and simply worked within the legal guidelines of the law, both parties could have resolved the issue without an actual loss of anything except interest that they wheren't legally entitled to.
Instead, your company took a hardline approach and continued to threaten legal action. So I beat your company to the punch, retained a debt collector and filed Chapter 13. All within my legal rights. Maybe you guys shouldn't be so radical in your ways and try and be nice to people and fix a problem rather then create one. Any debt collector dedicated to preserving human dignity will try the cell # first. Followed by the home #. Then we call work, then we look for location information. We will call frinds, roommates, neighbors and try to find out location information. If no new #s are attained, we will pull a credit report on you. Every 90 days or less. Everytime we do this your FICO score drops 3 points. Hiding is not helping you. My company has a legal department. Once an assount has reached that far, the account is either reviewed for arbitration in the courts or you will be persued legally. That is the truth. We have every right to call you and attempt to collect your debt. We can offer settlements, there is hope. We are not the enemy. If someone starts to scream at me i know that it is not their fault anymore than it is mine. We all have roles to play.

The truth is that you people that owe money make no effort to pay it. You are all selfish and stupid. You are the sole reason why our country is in so much debt. Instead of spending money on the internet service, going out to dinner, and shopping for things you don't need-pay your bills. You are all very pathetic. By choice. Choose to make a difference and be an adult. Pay your bills. Quit trying to justify your theft. Low lifes, all of you. Even if you have a nice car and a nice house, it doesnt mean that you earned it. You stole it. While other people struggle, you sit back and whine like spoiled children. Only you can make a difference. No effort will only bring an eventual downslide. I never threaten anyone, not even when NCO called. I merely gave you the name of the law firm handling the Chapter 13 and name of my attorney, eventually towards the end (because your company kept calling) I wouldn't give you his phone number, but in the beginning I did so because you wouldn't call his office and just annoyed me - I admit that but at first I gave you all his info including his cell number.

LOL - mine wasn't imaginary. Otherwise your company would not have stopped calling. I noticed though, until you received a copy of the actual Chapter 13 with the case # and trust account info, sent via certified mail, you did keep calling. Once NCO got the above info - they stopped.

Absolutely incorrect and very ignorant of the facts. In my particular case, I had excellent credit for over 15 years with close to 100K in unsecured credit with about another 100K available. My current mortgage right now, is at $438K and my vehicle loan is $31K I think; give or take a few thousand. What occurred in my case is a lender, never closed out a previous mortgage I had even though it was done via a title company and the mortgage company was marked as paid in full on a property I sold in Florida.
See, the title company put the money in escrow and never paid them. Should be no big deal - right? Wrong, the title company went out of business and took all the money from the escrow account and not just with me, but literally hundreds of other people whose payments where in escrow. So much so, that the underwriter for the title company could not provide the paperwork (Luckily my attorney kept a copy) because the title company owner is facing criminal charges and there is still more under investigation.
When I politely proved all this to the mortgage company, they threatened me, claimed that it wasn't their fault and I didn't fulfull my obligation under my mortgage agreement and demanded payment in full. I told them "No, I already paid and they needed to handle the matter with the underwriting company". They absolutely refused. Then "they said they would foreclose on the home". I told them "Go Ahead" - What the heck, I don't own it and I think it would be funny.
Anyway, at this point, I hired a Debt Attorney and asked for advice from him and my family attorney who is on retainer.
After two days, they both told me that legally, the company can demand payment in full, but that I do not owe as payment was received by the title company and the error is not mine and they will not be able to collect. However, because this institution had lost so much money in Florida Real Estate, they refused to accept this and informed my attorney they would still attempt to take legal action.
I was advised to fight this in Federal Court (Because I had moved to another State) which would have cost between 20K and 30K in just up front money or liquidate (HIDE - LOL)all my assets and sell my company with option to buyback in 11 years for a $100.00 and declare chapter 13 and tell them and everyone else to kiss my @rse.
So I discussed this with my wife (Who is not on the mortgage and we do not share any credit or banking institutions - something every couple should consider!!!!!! TRUST ME ON THIS!!!!). Anyway, I decided to do the chapter 13. Why you might ask? Because shouldn't have to pay 20K to 30K to fight a debt I don't own? Keep in mind, I would win, but there was no guarantee I would get my legal fees back so I could end up losing a minimum of 20K probably a lot more depending on how hard the former mortgage company wanted to fight.
So I ask you, does that sound like I made no effort to pay a debt or correct it? Unfortunately, because of this, I openly admit it; other companies had to suffer because I wrote them all off on my Chapter 13 to avoid a higher payment plan. Capital One, MBNA, BOA, AMEX, City Federal Credit Union, they all lost. Casualties of war! On the bright side, they get to write it off and they made plenty on the interest over the past 10 years plus the government is going to aid them. Funny, do you think the government would have aided me? NO, it would have come out of my own pocket. That my friend is theft and that is being a low life.
You want to go after someone, go after predator lenders, go after uninsured title companies, the Country is this way because Banks went crazy giving everyone credit who didn't deserve it or who did but didn't know what they where getting, then sold the loans or bought loans and title companies, realtors, all came out into the market with no experience or bad intentions and ruined the entire housing market Nationa wide.
This is why the Country is in a recession, not because of debt owners - but because of predator lenders, improper institutional paperwork or corrupt companies taking advantage of consumers. But go ahead - assume I just spent 30 minutes typing this up as a joke - it's not, it's very true and it's happening on a National level.
Look on the bright side - because of all these corrupt, stupid companies (NOT PEOPLE), you get to keep your job for a very, very, long time because it's only going to get worse as interest rates go up along with everything else.
I will say this about NCO - until they get a certified letter with the Chapter 13, along with the trust account info, they do keep calling. You guys did for a long time, but now you don't. One thing I want to point out is that I was never rude, even though you did call at odd hours of the evening (Up to 9 p.m.) and you didn't answer half the time, and you called on average 8 to 12 times a day. See - that is rude. If you simply listen to your debtor, ask him or her for not only the name of an attorney, but their phone number, address, and website if they have one. If not, advise them to get one or seek a financial counselor rather then demand money. You know the companies you work for - they make mistakes too believe it or not.
My advise to everyone is the following:
If you get in trouble with debt - seek a professional debt attorney. The attorney can either work out a payment plan, settlement, lower your interest rates, or if need be file a chapter 7 or 13 depending on your income. There is so mch a professional debt attorney can do to help and it's worth it.
However, know this - Chapter 13 and 7 really isn't the end of the world. Under 13 you are not allowed to apply for credit without permission of the court appointed trust for 5 years (At least that is my situation). However, after that - it's a new fresh start and it's really easy to get a good score quickly. You are allowed to have a "secured credit card" which shows up on a credit report as always positive :-) You are also allowed to have someone sign you onto their account to help you regain your credit.
So please, don't threat the debt collectors - they are nothing to hide or worry about. It's what they have to do for a living because eventually in life - even McDonald's fires the really stupid people so they don't have anywhere else to go :-) LATER KARMA & OBSERVER! - Yawwwwwwwwwwwwwwwn replies to RabI really enjoy writing to you debters. So, let me tell YOU something. You are poorly mistaken that any of our jobs are in danger. Freedom of speach and oh yeah, the right to defend ourselves as people. Have a nice life, cry and get mad, or laugh and smile... realisically, you are no better than me or anyone else. That includes the real bums that sit at home on their a$$ avoiding phone calls. My favorite is when they USE their children to lie for them.

And the site only gives info on the company's that the phone number belongs too. I can't see how this could possibly be a work related site, but would love to hear you explain to me how.
