They will make payment arrangements! dont let them garnish you or you will pay heavy fees! Trust me I have first hand expierence!

The Borrower's Rights and Responsibilities
The borrower has the right to:
Be sent a notice 30 days prior to ED ordering wage garnishment that explains ED's intention to garnish, the nature and amount of the debt, an opportunity to inspect and copy records relating to the debt, object to garnishment to collect the debt, and avoid garnishment by voluntary repayment;
An opportunity to enter into a written agreement under terms agreeable to ED to establish a voluntary repayment agreement;
An opportunity for a hearing to present and obtain a ruling on any objection by the borrower to the existence, amount, or enforceability of the debt;
An opportunity for a hearing to present and obtain a ruling on any objection that garnishment of 15% of the borrower's disposable pay would produce an extreme financial hardship;
An opportunity for a hearing to present and obtain a ruling on any objection that garnishment cannot be used at this time because the borrower is now employed within a 12-month period after having been involuntarily separated from employment;
Having garnishment action withheld by filing a timely request for a hearing, until the hearing is completed and a decision issued;
Not to be discharged from employment, refused employment, or subject to disciplinary action due to the garnishment, and to seek redress in federal or state court if such action occurs; and
Not to have any information provided to the employer but what is necessary for the employer to comply with the withholding order.
To avoid garnishment of 15% of disposable pay, the borrower must:
Negotiate repayment terms acceptable to ED or the Private Collection Agency (PCA) and ensure that ED receives the first payment by the response deadline date on the garnishment notice, which is 30 days from the date the garnishment notice was sent;
Make a hearing request in writing postmarked no later than the deadline on the garnishment notice;
If requesting copies of documents, make a request for a hearing, because requesting document(s) does not delay a garnishment order;
Provide proof to support any objection made to the existence, amount, or enforceability of the debt, or a claim of legal exclusion or financial hardship;
Pay any expenses he or she incurs to obtain legal representation and to attend an in-person hearing; (All in-person hearings are held at one of the three regional offices: Atlanta, Chicago, or San Francisco. The borrower is responsible for the cost of attending and those of any witnesses to attend on their behalf.) and,
Initiate any legal action against his or her employer if the employer discharges, refuses to hire, or takes disciplinary action against the borrower based on the garnishment action.

- bbbb| 1 replyThe above information is not true. I have no student debt and no wages to garnish, so if this were really a "Wage Garnishment Department" they have no reason to call me. I do have a small outstanding debt, but have never received anything from a court that would allow garnishment of my wages.
I think these are usually either normal collections calls (perhaps my $300 debt was sold to these guys by another creditor) or else simply a pure scam. - firewarden replies to payattentionHa,ha stop it. Your phony story is hurting my ribs.

I highly doubt this is a collection agency for student loans as someone else's post claims since the US Department of Education is already garnishing my wages, and has been for the last 4 years. Sorry, but this seems like a scam and I will not be calling them. I WILL, however, be checking my credit reports.

Please note: Regarding the collection of student loans, the collection agency wants to convince you that you need to pay $200 or more per month. The reason is simple-they make a ton more money that way. If they get you to pay that they make 16% of the TOTAL loan amount. If you pay less they only get 16% of what you pay every month.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- A rose by any other nameI get this call on my prepaid cell. Legitimate sounding maybe but I'm highly doubtful. The voicemail says they're a debt collection agency but they don't say who they're calling for. The same person has called 3 times, says they're GC Services with a call back #886-355-2356. That's not the number that shows up on my caller ID. That # was 732-561-4177. Lastly, I don't have student debt. Paid that off 20 years ago and have a letter to prove it. Be careful if you answer and don't give them your personal info.

- TonyaYes, this is GC Services. They have been garnishing my wages for over a year. Now, they call a year in to the wage garnishment. I think they do this so they can prove their collection costs. They are calling to see if they can rehabilitate the loan and get it out of default.

From the GC Services website. You are not as knowledgeable as you think. They do more than student loans. The number calling is also not their payment contact number and they have numerous complaints and legal action against them. All you have to do is Google them and sort through the numerous non-collection agency companies using that name.
